Jared Moskowitz (D-Fla.) who offered amendments to Brave Kevin’s ridiculous gas stove distraction bill that would rename the Speaker’s bill “The Appliance Bill of Rights”, and would require the installation of a 4X scale, stainless steel, six burner, gas double oven in Congress’ Statuary Hall in order to “accord gas stoves the honor they deserve.”

    It is highly problematic that in less than 24 hours after Trump’s indictment on 37 criminal counts, the Washington Post (and many others) have adopted a specifically Republican frame of the Constitutional and political aspects:

    “Trump indictment thrusts Biden into unprecedented territory
    “Biden’s leading adversary is being prosecuted by Biden’s Justice Department — a highly sensitive dynamic that is already fodder for Republicans”

    The indictment obtained by the Department of Justice is a distinct challenge that is unprecedented in American life. But that challenge is to us all, not to Joe Biden alone. It is a challenge to our democratic principles, our reliance on the rule of law, and our conviction that no person stands above or apart from the rule of law.

    Peel back the hyperbole and the profound falsehoods accompanying every Republican partisan attack on this indictment and you will find one single, unifying, and very simple premise: Trump is “special” and perhaps belonging to some undefined “special” category of persons.

    That idea, here being validated by the Washington Post, is a complicated and dangerous one. It is very definitely one of the ideas required in order to usher in authoritarian, anti-democratic, dictatorial styles of government. Gaining widespread recognition of an “elite” group of public citizens who are seen as standing apart from the normal rule of law and subject to special handling and consideration is a critical step in elevating that group into an echelon of unrestricted authority.

    That key, underlying idea behind every single Republican objection to this indictment is what must be consistently examined and resisted by all of us in every case.

    Bill Clinton, Hillary Clinton, and Joe Biden are not “special”. As individual public citizens they have never been granted special privileges or considerations under the law. Demand that Republicans show actual evidence that they have. Their attempts to justify creating a special zone of protection around Donald J. Trump will blow away.

    Yes. Of course. Republicans will respond with more of the Firehose of Falsehood, repeating and restating the same baseless claims for which there exists no evidence. The paranoid suspicions of tens of millions of Republicans have a lot to tell us about modern media manipulation. But they don’t tell us anything at all about the rule of law and how it has been applied prior to Trump.

    The affidavit of information in support of the search warrant issued to search MaL contained much more than mere suspicion. The contents of hundreds of unsecured, randomly scattered boxes, the records of communications, and the false sworn statements are more than mere suspicion. Suspicion alone is not enough. And at some point mere suspicion must either be substantiated or set aside.

    Upholding our nation’s most important laws, created to protect all of us, requires the minimal ability of all of us to separate mere suspicion, even if it is a politically cherished suspicion, from actual, factual evidence of very serious criminal wrongdoing. Seventy million of our fellow citizens have lost that important ability. That imposes a greater burden on the rest of us. And with it an obligation to continue to hold everyone to account for that separation.

    Smith’s filing in SDF specifically designated this indictment as a “related filing” to Trump v. United States, 9:22-cv-81294, the lolsuit Trump filed in Miami to sue the DOJ in August of last year.

    That designation choice in his filing is entirely elective. What this means is that Smith chose to have this case come before Judge Cannon.

    Paranoid lunatics could draw the conclusion that Smith wants to tank the case. I can’t see any evidence of that. Nor can I comprehend any political outcome from such a course, favorable to Democrats/Biden, that would advocate for it.

    So what might it mean? Smith does not want this case to suffer prolonged delays. He correctly chose SDF to avoid venue challenges. He preemptively designates the case as related to avoid that further avenue for procedural delay. He’s confident enough in his evidence that he doesn’t give a shit if the trial judge is in the bag.

    It really looks like 76-year-old Donald J. Trump is going to be heading to big-boy prison for some extended naps in the relatively near future.

    But not before obtaining considerable procedural delay.
    One thing Judge Cannon ably demonstrated last fall was her capacity to entertain even the most incompetent and frivolous of motions filed to her court seemingly via telepathy. Discovery could be very prolonged.

    Even the most confident of federal criminal prosecutors have a tendency to bury the defense in evidence. I’m not sure if Smith is the rare exception to that rule. The normal tendency will create ample opportunity for Trump’s real estate and insurance lawyers to present hundreds of incompetent, incomplete, foolish discovery motions, requiring briefs, hearings, responses, etc. At each step Cannon will grant extended time whenever Team Treason requests it and probably even when they fuck up, file late, or forget to file by deadlines entirely.

    But if by some miracle Smith really does have a bomb-proof criminal case and is entirely confident in the evidence, then maybe he can keep it simple enough to avoid most of that delay prior to trial. Fat Midget and the rest of the GOP primary Klown Kar should all pray that he does. Because the worst thing for the GOP primary would be for Trump to go into trial in March or April of next year.

    Here’s how Trump’s Florida trial might play out. The case stays with Cannon. She sways jury selection as much as she can to fill the jury box with MAGAts. She makes every procedural and evidentiary ruling in his favor. She waters down the jury instructions. The jury convicts him anyway because they have no choice; he’s fucking guilty, and the evidence is overwhelming, much of which came from his own mouth.

    You get them both. Trump has to be sentenced according to the guidelines, and the MAGA mob turns on Cannon for sending him to prison. She becomes an object of their hatred for failing to save him.

    She deserves this assignment and all that might flow from it.

    One interesting reason I have heard ver the years that we don’t have meaningful mainline electrification is the railroads would have to pay property taxes on the land that the substations and other infrastructure uses. Haven’t seen a mainline substation, but what Metro and Sound Transit use, they are about the size of a shipping container. That’s between 600VDC and 1500VDC.
