    Something I’m quite curious about is whether or not the campaign decides to try to sue FOX or any of its affiliates over these disclosures.

    It would seem to me that it would depend on what this Dominion/Smartmatic discovery reveals. And it would be strategic for the teams representing Dominion and Smartmatic to tease this kind of discovery in the filings, as they have now done, in order to bring additional pressure to bear on FOX to negotiate a settlement. We don’t know yet, in any granular detail what discovery revealed. But that changes once it becomes part of the public record of evidence at trial.

    And the Biden campaign might have interests and equities weighing against pursuing claims against FOX or its affiliates for these disclosures that constitute material breaches of their contractual agreements. Filing however can produce further discovery. And discovery of this nature could be financially disastrous for FOX and FOX affiliates going into the 2024 campaign. It’s not just Democrats who would have reason to avoid ad placements on FOX and FOX affiliates. It’s very clear that this kind of disclosure could be used to tip primary contests in favor of Trump or any other Republican primary campaign. That could produce a massive windfall to Newsmax at the perfectly wrong time for FOX and FOX affiliates.
