      I think you are substituting his discretion in ruling on jurisdiction for his discretion in hearing the case, and therefor issuing such a ruling at all.

      He must hear the case. He should rule that he lacks jurisdiction.

      Similarly if Roberts moves to protect FOX and creates a new stupid rule, judges like Kacsmaryk will be bound to hear whatever cases are filed in their jurisdictions and apply the precedent of that stupid rule. If they ignore the precedent then that leaves the Roberts Court to either uphold their own stupid new rule, or replace it with a new one. But they haven’t the time on their calendar, the capacity or the energy to do that thousands of times every year, switching this way and that to provide customized outcomes for each litigant they favor. And any attempt to do so would interfere with the agenda being pursued by Thomas and Alito.

      If a lower court ignores precedent but the Roberts Court denies cert, then that denial triggers adoption of whatever standard the lower court applied, at least within that circuit, going forward. And while it might not create new binding precedent on other judges in other jurisdictions outside that circuit, those judges would then be free to apply it in individual cases until such time as their own circuit issued substitute guidance.

      That all would result in a framework of thirteen differing and perhaps completely unique standards for weighing First Amendment protections against defamation statutes. And that would all be presiding chaotically and unpredictably over thousands of different lower courts and cases with differing and unique issues at stake. This kind of thing hasn’t been entirely unprecedented in history. But it’s been confined to poorly defined legal questions of great controversy that often did not involve such significant financial stakes for businesses.

      The property taxes paid to the Island County Treasurer are redistributed to the State of Washington to fund public schools, the special purpose districts that provide services (hospital districts, school districts, cities, fire districts, parks and recreation districts, diking districts, drainage districts, the library district, emergency medical services, etc.), and Island County (roads and public services).

      Too much money is too much money. $127M paid by 9500 households, on top of the existing tax burden, is too much money.

      But is that it? Is audience alone enough? Or doesn’t the setting of that communication channel matter?

      Where, when, and how the President chooses to communicate with the people who elected him has important effects on what meaning and message are communicated and received. This is fundamental communication theory. Good communications, intending to accurately and truthfully convey a clear message to an audience must account for the audience, AND the medium by which the message is conveyed. The size of the audience FOX represents is very important. But it’s not the only important thing.

      Pornhub has a huge audience. It’s a huge audience that actually overlaps substantially with FOX News viewers. And it’s bigger. And that vast audience of Americans who regularly consume media from Pornhub are just as deserving of the President’s time, attention, and messaging. But would it be appropriate for the President to appear on Pornhub to address that audience?

      I’d argue it would not. In seriousness, the POTUS has a responsibility to the audience but also to the office. And in truth, such an appearance would degrade, diminish, and humiliate both the Office of the President and the audience being reached. Not just or even particularly because Pornhub is porn. That matters. But really only because of how it would offend and alienate so many people who are offended by Pornhub. But the same can be said about NBC, or The Wall Street Journal. There are a lot of Americans who are offended and alienated by all kinds of different things.

      So why not Pornhub? What makes that channel inappropriate? If it isn’t just “porn”, then what is it?

      I think the enduring answer is that Pornhub, as a communication channel, is not structured to convey a message in a sufficiently neutral, objective, and sincere fashion. The audience of Pornhub viewers are not in an appropriate frame of mind to receive important, sincere, or meaningful messages from their government as represented by the President. The surrounding and adjacent media and messages on Pornhub are themselves too fundamentally insincere, cynical, and exploitative to provide a supportive context or setting for any legitimate message from the POTUS.

      Which brings us to FOX. And just as how with Pornhub it isn’t about the porn, in the case of FOX it isn’t about the extreme right-wing motivating and controlling bias. Whether it’s the porn on Pornhub, or the ultra-MAGA, authoritarianism on FOX, it’s problematic because it offends and alienates substantial portions of America. But that isn’t what makes FOX a bad fit or an ineffective channel.

      Even for something apolitical and soft, like what a Presidential appearance on the network broadcasting a Superbowl would be, FOX is broken. Because such an appearance inviting the audience to come together as Americans to share in the celebration of great athletic performances in a national pastime, when it appears on FOX, would be surrounded by too much insincere, and cynically exploitative pandering. It’s precisely the opposite of the setting you’d want.

      It’s impossible for any such message, however well crafted or delivered, to overcome that setting. FOX is an incredibly good communication channel for what it provides to its audience. And in very much the same way, Pornhub is an incredibly good communication channel for what it provides to its audience.
      But neither is an appropriate channel for the President of the United States to address the nation.

      Selling a naked put at a strike price ~ 20% below the current market price means one of two things:

      • Seller of the put expects the shares will remain above the exercise price at expiration. That’s not a bet the shares will rise, it’s a bet the shares will either rise, stay the same, or fall less than 20%. The seller wants the premium and expects not to have to own the shares.

      • Seller of the put expects the price of the shares to fall below the exercise price and is willing to buy at the exercise price, minus the premium. IOW seller wishes to own the shares if the price is right but thinks that the $97/share paid by Robinhood Dumbfuck Rabbit was too high, and that $95 minus $5 premium equals $90 is a good entry point.
