    I’m on board with 2, 3, 4, and 5.

    I think we have a problem with attempting to ban any otherwise lawful firearm by categorical distinction if that category cannot be rationally well defined and if the characteristics defining that category are not absolutely tied directly to public safety. “Military style” doesn’t mean anything. “Assault” as a category has no good definition. It might be possible to eventually produce such a category definition. But not without considerable difficulty and legal challenge. Within the existing legal framework, consistent with both state laws and prior federal laws, bans on specific firearms features and accessories is more appropriate and workable. Call it “assault weapon” if you like. But also bear in mind that, having broken the Republican logjam on firearms regulations, it must evolve over time. Manufacturers will continue to develop and market features and accessories attempting to produce the same capabilities getting around whatever existing law.

    I’m also deeply suspicious of empowering law enforcement to pick and choose who gets to carry firearms. Let’s face it. They already do that. And we know exactly how that works right now. The shit pulled nearly every day by lily white Proud Boys, Oath Keepers, III percenters, YouTube “auditors” and any random White Supremacist gets Black and brown men killed instantly.

    Knowing what I do, I also would not trust most judges with that responsibility without reservations. Many states already have such laws allowing law enforcement to petition a court. I’m comfortable with those laws as they are currently structured. But almost all of them are very new and I’d like to see some study of them before we considering removing protections for those accused or expanding authorities and definitions. These laws ultimately come down to local authorities, even if Congress passed some kind of nationwide law. It does appear that there is a lot of local inconsistency in the application. Some counties simply never issue Red Flags. Some only do it, apparently, when the subject is poor or a minority.

    But I’d also go further than your 6. I’d definitely like to see some carefully developed restrictions on possession numbers and volume outside of a federal dealer’s license. I think Congress can pass restrictions on the number of rounds possessed in a home or office. I think restrictions on rounds carried in vehicles are workable. I think uniform, nationwide restrictions on numbers of loaded and unsecured firearms in homes or carried in vehicles are also workable. Nobody needs sixteen fully loaded and unsecured firearms in their car, for example. “Hobbyists” driving around in pickup trucks carrying multiple bags filled with dozens of firearms and thousands of rounds of ammo is unsafe and should be uniformly restricted.

    If we implement these laws we have to think carefully about how they are and will be enforced. It’s very clear now that in states currently with red-flag laws that police now decline to report and file when responding to DV calls involving other police, knowing that it may cost them their job. Cops beat the shit out of their families all the time. We know this. They stalk ex-girlfriends. They threaten new boyfriends. They show up at workplaces behaving erratically and deliberately try to scare people. They knock their own kids around. They even fuck their own dogs.

    These victims deserve our sympathy and they need our help. If laws like these are going to work the way we intend we may have to fix police culture, accountability, and oversight first. Or we risk abandoning huge numbers of police domestic violence victims.

    @24 Researching this for a Handbill.US story, I didn’t find evidence of racism. What I found is the Indian kid allegedly made threat, including threatening to rape the white kid’s little sister. The white kid, of course, should have reported him to school authorities instead of handling it in schoolyard fashion. But it appears to have been provoked, and both appear to be guilty. The disparate punishments, though, is a bad look. Given the violence of the assault, there should’ve been a police report and a referral to the juvenile prosecutor.

    After observing in real time the law enforcement authorities in TexASS producing a series of falsified reports (I stopped counting at 12) deliberately intended to misinform a terrified, and grieving community in Uvalde, it is not enough for more people to finally understand that police agencies lie.

    We all have to hold media to a higher standard. Police lie. Not just rank-and-file patrol officers lying on sworn affidavits or in reports. But senior commanders and public information officers lie right to the faces of journalists all the time. They tell them things they know are not true. They intentionally misinform reporters.

    Journalists have got to stop relying on “official reports” issued to them by law enforcement without checking those claims very carefully and without comparing the claims made in police public statements with observable facts and eyewitness statements. We have to demand it of them. We have to push back.

    The small child hiding in her bedroom was not “struck by a bullet” while police were “serving a warrant on a known drug-house”. A cop shot someone’s child after carelessly and negligently kicking down the wrong door at the wrong house. When the tape is right in front of you showing the cop stepping out of the police line to target pepper spray directly into the face of a citizen obeying commands to leave the area, then that’s what should be reported.

    The lying has gotten completely out of hand. And “journalists” are a big part of the reason. As citizens we should not trust the reporting of the media when it relies almost entirely on the “official statements” of law enforcement agencies. They lie. Reporters who pass along lies are just as responsible for the lying.

    There will be issues regarding the quality/admissibility of any BAC evidence. Long delays can indicate a few things which raise doubts.

    California implied consent only applies to testing performed subsequent to a lawful arrest. It does not allow police to go fishing in your blood. It is every motorists right to refuse roadside tests. Smart assed rich white business dudes with lawyers on retainer normally refuse, having been previously advised to do so.
    In Birchfield v. North Dakota, decided in 2016, the Supreme Court held that a state statute may not criminalize the refusal to submit to a blood test incident to an arrest without a warrant. Standard advice of council is to refuse warrantless blood testing.

    The result is that if a suspect refuses PAS and other field sobriety tests (which pretty much gets you arrested every single time*), and subsequent to arrest refuses to submit to a blood draw, then a warrant must be sought. So now you have an arrest based on “suspicion” followed by transport, refusal, further transport to a medical facility, and waiting for a judge before blood is drawn. A lengthy delay before obtaining a warrant for a blood draw raises questions about their relevance and validity. So a decent defense attorney can make a good argument for exclusion.

    Waive speedy trial and move for continuance. Line up two highly qualified mad scientists to provide their expert analysis of the report, raising valid reasonable doubt about the results and move for exclusion. Chances are best if the BAC result is close to the threshold. One of your experts is a pro at challenging the quality of lab results. If the motion is denied, move for another continuance. A year from now negotiate a negligent plea and pay fine. Prosecutor accepts the offer to avoid risk of losing at trial in front of a jury.

    *If forced to go to trial, cop is forced to confess under cross that the main reason they decided to make an arrest was the lawful refusal of the roadside testing. This also gets argued in the motion to exclude, but only to paper the record for an appeal. BTW if you find yourself as a motorist in this situation, ask the cop to explain why they are arresting you. You’d be surprised how often you can get them to admit on BWC that they are arresting you because you exercised your right to refuse. That alone will get you a dismissal about half the time.

    Let’s say for once Degen Bob’s predictions are within the corral and Republicans gain somewhere in the neighborhood of 25-30 House seats (allowing a margin for error of minus ~10-20), and the new majority elects Gym Jordan as Speaker.

    The next Congress will be focused on three things, and only these three things:

    (1) Repeatedly impeaching Biden. These will go nowhere in the Senate, of course, but following the defeat of each impeachment resolution, he will promptly be re-impeached on a continuously recurring cycle of roughly 8 to 10 weeks per impeachment.

    (2) Investigate Hunter Biden. Following an avalanche of subpoenas issued to his parents, there will be extensive public hearings, lasting many months, exposing the Bidens’ criminally negligent parenting.

    (3) Investigate Paul Pelosi. Again, many many subpoenas, and prolonged hearings into every facet of his life leading up to the DUI, with particular focus on his wife’s culpability for his drinking (“you’d stay drunk all the time if you were married to that witch, too”).

    Nothing else of any consequence will get done, least of all doing anything about military-grade weapons being legally purchased by teenaged psychopaths bent on slaughtering grade schoolers.

    Degen Bob extols this kind of governance. And votes for it.

    They don’t understand that the cheap gas they enjoyed for lo! these many years past is responsible for today’s high gas prices.

    That cheap gas was a byproduct of the ultra-low oil prices engineered by Saudi Arabia in a (failed) effort to destroy the U.S. shale industry.

    Their strategy did succeed in slashing E&P investment. That meant less production in the future. Those chickens are now coming home to roost.

    Meanwhile, Americans’ en masse exercise of their God-given right to fly, drive, run their boats and jetskis, etc., is spiking demand for gas precisely when supplies are tight.

    I can fill a long list with the names of Boomers I know who, having patiently hunkered down through two years of COVID closures and restrictions, are simply not willing to let “price” stand in the way of their travel plans.     Even Walmart is selling beef brisket packers for $6/lb as a loss leader to help sell $1000 pellet smokers. Neighbors down the road were bragging on social media how they pooled over $30,000 for neighborhood fireworks this year (Fire Marshall is paying them a visit).

    Folks are really hurting out there. Like a post apocalyptic wasteland filled with brand new class A RVs. It’s just horrible to see.
