There’s a lot of overplay when it comes to the effect, not only of Trump’s picks, but of any president’s picks. There are a lot of federal judges. And if she only serves a single term, it’s almost impossible for a president to create the kind of permanent legacy they are claiming.
But the reason for the claims may have been weakened by more than just those two rulings. Particularly considering the role that Roberts and Gorsuch have played, obviously a lot of culture wars voters will be disappointed in not just this term, but in these four years.
Perhaps the biggest lasting impact in the near future will be the ruling in the Mazars/DB case. For a great many practical reasons no previous administration was quite this interested in pushing the issue this far. This is actually the first SCOTUS to ever hear the question. And the reason all previous administrations have avoided it are now clear.
The Court, theoretically a “co-equal” independent branch, has assigned itself the role of deciding these disputes between the other two branches. That has unique potential for disturbing the relationship between them and putting judges in a more dominant role, albeit limited in scope.
First thing we can look for is that henceforth all presidents will be carefully exploring any potential nominee’s philosophy about “legislative intent”. And we can safely assume that the Senate will develop a similar interest. Consequently, I assume we can anticipate a great flowering of vigorous debate among legal scholars and essayists about what this ruling means in both practical and philosophical terms.

Satisfying the four part test will mostly be a matter of incremental lawyering. I know this is asking a lot of you, desperate as you often are to travel back in time to snuggle safely in the lap of President Ronald Alzheimers, but try and contemplate a future subpoena being resisted by a future president. Thus far (and this will undoubtedly change over time) the key prong(s) of the test are vague.
The first, potentially limited in scope to “papers” and resisting Congress where other means of obtaining the relevant information are available, would not avail this president. Nor would it somehow circumvent the spectacle of swearing officials and then forcing them to admit to misdeeds in a public forum.
The second prong limits the scope to the stated legislative purpose. That’s a standard legal feature of any subpoena, and has very legitimately formed the basis for almost every previous conflict in this arena. Congress has often demanded sweeping access to people and records in the form of a fishing expedition. Presidents have almost always resisted. In a few cases lower courts have intervened (where we derive some parts of these tests) and placed appropriate limits. Not anything new actually. And an area in which the law is already quite well worked out.
The third prong declares some contours surrounding the detail required for Congress to establish a valid legislative purpose. This one is probably the easiest if you think about it. Congress need only identify a legislative proposal tied directly to the information sought. You know who gets to decide what legislation is proposed? That’s right. Congress does.
The fourth test is actually the most interesting one imho, insofar as it reveals some of Robert’s hubris. He slyly sets out some very vague limitations on “burden” citing balance of powers in support. But he simultaneously seeks to exempt his own branch from these same limitations, whatever they may be. It’s this prong of the Vance test where I would look for future litigation.
This question of “burdening” the Executive branch has always been at the heart of efforts to resist Congressional subpoena. And for most of history it has always been set against the question of valid legislative purpose. I’m pretty confident that this administration has overplayed its claims of burden in refusing literally all subpoenas. And I’m just about equally as confident that the courts, even courts hand picked by the Fed Soc, will view sweeping claims of excess burden with great skepticism. There’s not a whole lot of deference to the Executive branch on even the “most conservative” of the appellate courts.

“The Supreme Unitary Executive” position embraced by Rapepublicans, but only when they control that branch.

I have quite a good friend who is a captain in that department.
Obviously we don’t entirely agree about many of these things.
But for what it’s worth he would tell you that despite what the SPOG claims would be the result of reductions based on pure seniority, rank, or similar factors, it won’t happen that way. Like many urban police departments that have been rapidly expanded in the last couple of decades, but particularly because of the consent decree imposed by the DOJ resulting from decades of abuses, SPD is disproportionately staffed with older, whiter, fully vested, near full retirement white guys*. Like most public pension systems SPD’s retirement incentivises rapid escalation in grade and OT in the final four years to maximize retirement payout. But he insists that most of them (probably including him) will simply take retirement.
So the more likely result will some loss of diversity overall. But it will also result in a substantial increase in diversity among the higher ranks as diversity hires are promoted to fill the ranks of white male retirees.
So in other words, no you can’t believe what police say about police. They lie.
* Should point out what a great example of this he is. He’s a college educated white guy. Before the consent decree he sat waiting on the SGTs list for nearly eight years. Soon after the consent decree he began promoting to where he is today. He’s 48 (I think). So he’s within a few years of being fully vested. He says he intends to retire at that point.

Last I checked over half of all uniformed, armed police responses in Seattle were dispatched resulting from reports of “suspicious person(s)”. Further analysis yields a pretty complex and diverse basis for these reports. But clearly a huge percentage of them arise from a large, transient, desperately poor population of people living on the streets suffering from untreated mental illness, drug and alcohol addiction, and a host of complicating additional health problems. The conventional approach relying on an armed police response has been to confront, detain, subdue, arrest, evaluate, transport, and treat in an ER for 24 to 48 hrs before later release. Each one of these responses is incredibly expensive, involving multiple armed police, Fire EMTs, Fire aid units, ER nurses, and ER doctors. Seattle taxpayers pay for all of it each time. The annual total is staggering. It is not part of the SPD budget. And it does no good for anyone. Moreover it obviously puts these people and a great many other people at substantial risk each time Seattle sends multiple armed para-military responders to confront someone having a mental health crisis.
Some people, including not a few police, believe it might be simply cheaper, safer, and better for everyone to provide a safe place for these people to live off the streets. Most conservatives object to this, basically citing “moral hazard” justifications for continuing the current broken response system.

Who’s going to deal with disorderly drunks and domestic abusers? It’s not realistic to think everyone will behave if we have no police, or that cops will never have to use force, because people will comply if they ask them to? As bad as some cops are, some of the civilians are even worse. That’s why I think we need better cops, not no cops, and think in terms of getting rid of just the worst cops, not throwing out the baby with the bath water. I’m a pragmatist being practical.
