The company has done/is doing three things that will victimize these victims further:
1. It delayed disclosing the data breach for over 5 weeks.
2. It’s now exploiting the data breach to sell services to victims.
3. It’s requiring victims to waive legal claims arising from the breach as a condition of receiving “free” credit monitoring.
“Equifax is allowing people to sign up on its website for free identity theft protection and credit file monitoring following the disclosure Thursday of the data breach, which Equifax said was detected July 29 and affected 143 million consumers.
“But the credit monitoring service, through an Equifax company called Trusted ID, has a provision that limits liability to the company, and consumers who sign up for what is billed as a free service will be charged for it after a one-year trial period if they don’t call the company to cancel their subscription.”
And they’re being sneaky about it: “The provisions [are] buried in the fine print of Trusted ID’s terms of service ….”

ATLANTA —
There’s no way around it: The news from credit reporting company Equifax that 143 million Americans had their information exposed is very serious.
The crucial pieces of personal information that criminals may need to commit identity theft – Social Security numbers, birthdates, address histories, legal names – were all obtained. And once your personal data is out there, it’s basically out there forever.
If your information was exposed, Equifax is offering free identity theft protection and credit file monitoring services. But the offer comes with some conditions that may make you think twice.
You can’t get help right away. When people enter their last name and part of their Social Security number on the site to see whether they were affected, some are being told: “Based on the information provided, we believe that your personal information may have been impacted by this incident.”
But even in that case, Equifax is not offering the credit monitoring service until next week at the earliest. Monday is the first day you can sign up.
Equifax released a statement on Friday afternoon clarifying that its terms of use do not apply to this incident:
“NO WAIVER OF RIGHTS FOR THIS CYBER SECURITY INCIDENT. In response to consumer inquiries, we have made it clear that the arbitration clause and class action waiver included in the Equifax and TrustedID Premier terms of use does not apply to this cybersecurity incident.”
At first, Equifax said anyone who gets the credit monitoring service, TrustedID, must agree to submit any complaints about it to arbitration. Those people wouldn’t be allowed to sue, join a class-action suit, or benefit from any class-action settlement. To view the Equifax terms of use, click here.
After public pressure, Equifax added an opt-out provision on Friday. Customers can get out of the arbitration requirement by notifying Equifax in writing within 30 days of accepting the monitoring service. Letters should be sent to:

Something to be aware of re the Equifax fuckup:
Often times the best initial step is to place a freeze on your credit reports. This will prevent anyone from initiating a new application for credit with your private data that Equifax has negligently released to the global criminal underworld. The reporting agencies will quite often want you to pay for this. Many states have laws that require them to provide this very minimal service free of charge to anyone who has had their data stolen. If your state law grants you this protection then you need to affirm in writing and by sworn affidavit that you have good reason to believe that Equifax released your identifying information to global criminals. So first check the Equifax shitty website to verify that you are included in the fuckup – nearly everyone is included. Next get an affidavit form:

Use that when you request credit freeze/thaw, etc from the reporting agencies if they require it. It depends on your state law, but you probably don’t have to file a police report. But don’t be surprised if some CSR with a community college degree demands one. Research the relevant state law and cite that to them. Personally, I’d do all this by reg mail with proof of receipt. I know my state requires the fuckers do this free of charge within 72 hrs of notification. Retain all the docs and receipts and it’s on them. After that, summary judgment is easy. A well documented file with a high likelihood of easy summary judgment is what you need if you ever hope to seek damages. The same documents will protect you from creditors who negligently open new accounts without first checking (many in the consumer world still do). If some shitty used car lot in California turns you over to a collector you need to be able to quickly dispense with their asses. If you can prove that your credit was frozen when the loan was made that’s ends it.
Sign up for credit monitoring if you want. But it will only tell you you’ve been fucked after you’ve been fucked. Freezing your credit reports is a better way to go for a start.
Oh, and get ready for the whole fucking system to crash in the next week or so.
