Now let’s examine the Colorado GOP’s arguments.
Argument #1: “By excluding President Trump from the ballot, the Colorado Supreme Court engaged in an unprecedented disregard for the First Amendment right of political parties to select the candidates of their choice and a usurpation of the rights of the people to choose their elected officials.”
This argument would not get Arnold Schwarzenegger on the ballot.
Argument #2: “The state Supreme Court incorrectly broadened the Constitution’s ‘insurrectionist ban’ to apply to presidents.”
This argument would not have gotten Jefferson Davis on the ballot.
Argument #3: “Only Congress – not courts or state election officials – can enforce the ban.”
This argument would not get Bill Clinton, G. W. Bush, or Obama on the ballot even if Congress voted to lift the 22nd Amendment ban on third terms.
Argument #4: “Rejecting a long history of precedent, a state Supreme Court has now concluded that individual litigants, state courts, and secretaries of state in all 50 states plus the District of Columbia have authority to enforce Section Three of the Fourteenth Amendment.”
This appears to be an issue of first impression, but in general, elections are conducted at the state level, not by a national authority and certainly not by Congress.
Argument #5: “With the number of challenges to President Trump’s candidacy now pending in other states, ranging from lawsuits to administrative proceedings, there is a real risk the Colorado Supreme Court majority’s flawed and unprecedented analysis will be borrowed, and the resulting grave legal error repeated.”
What other states might do is simply not before the court in this appeal. Whether other jurisdictions might “borrow” the Colorado Supreme Court’s reasoning is not a justifiable question, nor a complaint on which the court can grant relief. Every rule of law and interpretation was “unprecedented” at first, so the mere lack of precedent won’t keep a rule or interpretation form being established. Whether SCOTUS will address the alleged “grave legal error” depends on whether the appeal brief raises a constitutional or federal question or, if it fails to do so, the justices decide to address the question anyway as this majority has been known to do.
Now, it’s my own view that a fair interpretation of the Colorado statute used to disqualify Trump is for assessing candidate qualifications only, and therefore could be used to keep Arnold Schwarzenegger or G. W. Bush off the ballot, but does not establish a process for adjudicating 14th Amend. Sec. 3 disqualifications, therefore can’t be used to keep Donald Trump or Jefferson Davis off the ballot. I expect the Colorado Supreme Court’s ruling to be overturned at SCOTUS on that basis.
And, in any case, Congress lifted the disqualification from Davis in 1978, indicating that Section 3 (which authorizes what amounts to a congressional pardon) is very much alive and in use in modern times.

CNN released additional reporting, including audio tapes and emails, about the interviews that Kenneth Cheseboro gave to Michigan investigators looking into state level criminal charges for the forged election certificates.
In his sworn testimony to Congress, the General Counsel of the Trump 2020 campaign testified that he had originally conceived of the forged electoral certificates as what he termed a “cast and hold” strategy in which the fake certificates would be created and then held by the campaign to be made available in the even that their court challenges should prevail. He testified that he directed a top aid to send a letter to Cheseboro terminating the campaign’s involvement in December once it appeared that there was a big effort to somehow send the fake documents to Congress with the help of Republican lawmakers. But the emails and audio contradict that claim, and illustrate a frantic effort undertaken by the campaign lawyers to obtain copies of the fake documents once it was determined that they had somehow become “stalled” in the mail. The emails show campaign lawyers coordinating an effort to send staff by air to collect copies and then hand deliver those copies to designated Republican lawmakers at the same time the campaign’s General Counsel testified under oath that he had “terminated” the campaign’s involvement.
Cheseboro also complained to the Michigan investigators that had he known that he was being set up as a fall guy for the Trump 2020 campaign he would have cooperated with the House committee and disclosed all of the information he is now sharing because he would have been released of any privilege restrictions. And that because of his “loyalty” to Trump he lost all of his net worth, having to sell his home at a loss, and liquidate other assets to retain defense attorneys. Now Trump 2020 General Counsel Matt Morgan and Trump 2020 Director of Election Day Operations Mike Roman find themselves in precisely the same uncomfortable position that they had planned to put Cheseboro in.

Well, I’ve said all along we don’t really know what Smith’s case is in DC. Unlike the Mueller investigation, where the Barr DOJ systematically managed leaks to the media to selectively nullify the impact of the 2016 campaign corruption, there’s been no media outreach from Smith’s office. They don’t leak. And while there’s been a similar tight lipped approach in the Florida case, the Trump legal team’s pretrial challenges to the warrant resulted in them having access to and thus also leaking much of that evidence. But the DC District case has been a lock box.
So these leaks from Michigan to CNN may be the closest we are going to get. And they make it look like there is not only disunity among the conspirators that has led to cooperation, but that the cooperation has likely been productive in turning up corroborating documents. So the he said/she said aspects of Trump’s defense are presumably weakened by the presence of documents confirming key details of the eyewitness testimony.
Again, we still don’t know how Smith ties Trump personaly to the conspiracy. But I’m led to suspect from this that these campaign lawyers are going to finger him one way or another. And that also then would tend to nullify his idiotic immunity claims as well. Since a president does not employ his campaign lawyers to perform legal work on behalf of the people of the United States, he loses his claim that the scheme was undertaken as part of his official capacity as POTUS. I think it also reveals what a general stink of illegality there was surrounding this thing. Many of the fake electors apparently were balking at their role absent some kind of official legal indemnity from the White House. And it was campaign lawyers who were dealing with those fears and concerns and who ultimately made the decision to “fuck those guys” and leave them hanging out to dry as well. Legally a shit stick like Matt Morgan has no authority to extend or deny the legal protections of the Office of the President of the United States. And any effort a guy like that might take to coordinate such protection on behalf of conspiring minions would be just another violation of federal law.

I can absolutely agree with you here. I’m just not yet convinced that this is what the framers of the 14th had in mind. I do agree that it is very likely given the circumstances. But it was also a complex time.
Had those framers in 1868 intended the restriction to apply only to those convicted in a federal or state criminal court they absolutely would have included that limitation in the language of the amendment. This was 100 years after the founding. By this time the complex and challenging interplay between “lawmakers” and “interpretors” was well understood. If those framers wanted a decisive conviction by a jury they’d absolutely have said so.
But there are other complicated equities involved. The United States needed the talents and experience of those who had served The Confederacy. The scale of human carnage that we had suffered was incomprehensible. These were traitors. Undeniably. And yet…
As we should probably expect there was plenty of hypocrisy woven into how we reconstituted “The Union” following the war. And plenty of compromises were made, not all of them great. So I’m content for now to see this question fought over in the courts for now.

Poland has reported today that some of the missiles in Russia’s latest terror attack targeting civilian areas in Kyiv violated NATO airspace in order to do so.
This marks a very dramatic escalation, brought on undoubtedly by Republicans in Congress stalling further aid shipments to Ukraine this winter. And it obviously puts the lie to Putler’s claims to be seeking de-escalation and negotiations.
As I previously mentioned, in just the last few weeks Ukraine has demonstrated a dominant capacity to shoot down Russian ground launched long range missilies and advanced tactical aircraft, venturing within range of launching these kinds of massive air strikes on civilian areas in cities like Kyiv. Owing to security agreements with NATO and neighboring countries, AFU is significantly constrained from conducting these kinds of defensive missile shield operations in any way that might implicate neighboring airspace. Russia has now decided to use those agreements as a vulnerability they can exploit, daring NATO countries to respond to this violation of their sovereign air space and their own national security.
Poland has Patriot batteries of their own. Under NATO security agreements they should be permitted to begin defensive strikes against Russian tactical aircraft using Polish airspace to conduct missile attacks against Ukraine. NATO has an obligation to defend member nations from these kinds of attacks.
