Be advised, at least in my opinion Trump’s app for emerg cert to the Supremes is a legal fig leaf, attempting to distract from the plain facts that he’s losing this thing, that the 11th will crush what remains of it, and that underneath all that is unfortunately probably some very serious espionage act violations.
In brief, Kise is making a very technical, jurisdictional argument implicating a portion of the injunction. And the application omits the crucial argument for emerg relief of imminent, irreparable harm. So it will be easy to deny. Moreover, even if granted it won’t stop the DOJ from shit. And bottom line where Bratt is concerned is going to be that a registered agent of the government of Venezuela will not have access to top secret documents no matter how much Trump begs.
In my estimation Kise is basically Elvis in the 60s, sleep walking his way through a motion picture studio contract that he now regrets signing. He’ll see this thing through to it’s inevitable demise and then walk away with his money.

He’s given DOJ until Friday for their initial responses to the application. That is not the look of a Circuit Justice leaning towards granting an emergency stay.
And just because Cannon is ignorant, overwhelmed, and incredibly inexperienced does not mean she’s being partisan. And though Thomas is very clearly partisan, he is not ignorant, overwhelmed, or the least bit inexperienced.
I know it’s hard to see two steps forward and one step back. But that is the nature of due process in our system. Thomas may grant or deny the application on his own. Or he can choose to refer the application to the full court. Were Thomas so inclined he would already have done so. Moreover, were he inclined to grant an emergency stay it’s very unlikely he would have given DOJ a full week to file their response.
This case, and this appeal of the Circuit order, introduces no suddenly compelling questions or fiercely debated areas of law demanding clarification. On it’s merits it would not be taken up by The Court in a normal writ of cert after having benn fully litigated at the Circuit. Nor in my opinion is there any fair prospect that the appeal would prevail. An emergency stay is not warranted.
Meanwhile DOJ is able to proceed with their investigation into the classified documents as well as their remaining appeal in the 11th. I take it as evidence of his intent this should be so that Thomas has given the DOJ plenty of time to respond. If he intended to fuck with them he would have ordered a response by midnight.
