My guess would be that the need for a substantially lengthier response is driven by the need to fully brief the judge on the host of legal and factual issues relating to classification, national security intelligence, and the espionage act. A Special Master is normally an attorney from outside the government, with appropriate CV and background, intended to be able to act independently. But where very sensitive national secrets may be involved that could present significant problems.
Such a Special Master may not have the clearances needed, and providing them in a timely manner would be cumbersome. Moreover in the case of some information it might be practically impossible and considerably risky. Intelligence agencies with equities into the information involved would have to be involved in the process. And DOJ is probably arguing that before the judge make such a decision in favor of the motion, those agencies should also be allowed to brief the court.
But a substantial portion of the response will probably be devoted to informing the judge about the risk assessment pertaining to the classified materials. The need for an additional 20 pages might suggest that the risk assessment is lengthy and complex.
There might be plenty of other very good reasons for denying Trump’s motion. But one particularly good reason would be if granting the motion would needlessly expose highly guarded secrets critical to national security. If Judge Cannon denies the motion it may provide some insight into the type of classified intelligence Republicans stole and hid in the damp basement of Trump’s private sex club in Florida.

Receipts on a criminal conspiracy.

Last night’s filed response to Trump’s motion for appointment of a Special Master 100% confirms that an active, ongoing criminal investigation is underway. The serving of a criminal grand jury subpoena prior to the execution of the search warrant strongly implied as much. But last night’s filing confirms this. Some will report this as “a criminal investigation of Trump”. That’s premature and probably a misstatement. No targets have been identified so far as we know.
The filing alleges that certain unidentified individuals took specific overt, intentional actions in response to the communications from DOJ and the criminal subpoena to delay compliance, conceal or disguise materials responsive to the requests and the subpoenas, and relocate materials. Obstruction charges are now included in the mix of supporting statutes. And those statutes figure prominently in the response filed last night.
The first evidence of this criminal obstruction was obtained before the seating of a criminal grand jury in the SDFL, and was developed from materials and information included in the previously relinquished stolen documents. This then was prior to the June 3rd service of the subpoena and the certification from Christina Bobb referenced in my post above.
Some of the marked and identified classified documents recovered during execution of the search warrant were located outside of the boxes in the damp basement rooms of the private sex club in Florida. Three classified documents were found and recovered from Trump’s personal office desk commingled with other papers and documents having nothing to do with the White House or the government.
Some of the documents recovered during execution of the search warrant were classified with “additional sensitive compartments that signify very limited distribution” such that the FBI agents and DOJ attorneys from the CounterIntel section were required to obtain additional classification clearances in order to review them.
At no time prior to execution of the search warrant did Trump or any person representing Trump make any mention of any assertion of any kind of privilege over the documents being sought.
The filing states that certain personal items belonging to Donald J. Trump, including documents, that were commingled with the classified documents responsive to the warrant, were recovered during the search and retained because they contain evidence of other criminal activity.
Prosecutors and former prosecutors will probably read much more into the information contained in the filing. But some of that is undoubtedly owing to their personal perspectives as prosecutors. For instance, declining to grant DOJ access to the boxes in the room prior to the execution of the search warrant is not “evidence of guilt or intent”. It’s being a responsible lawyer. Whether or not Christina Bobb was telling the truth when she swore that she had turned everything over, her client still retains his Fourth Amendment rights.
However, that being said, the filing late last night paints a devastating picture of criminality on the part of all the Trump people involved. And it’s very hard to understand the sustained effort to withhold and obstruct these stolen classified secrets for any “innocent” purpose. The DOJ has every reason to be deeply concerned that these most highly classified secrets are now compromised.
I really must add that the emerging position of Trump defenders that “law enforcement are all entirely untrustworthy” and that “the things prosecutors say in sworn filings before a court are no more trustworthy than random media statements” is pleasantly surprising and not entirely unwelcome.
The problem fundamentally isn’t exaggeration, hyperbole, or distortion by prosecutors in motions and responses during an investigation or preceding a trial. Whatever is claimed or alleged must still be proven in court and must still overcome what one hopes is healthy skepticism on the part of jurors weighing such claims and allegations against a rational standard of proof.
The problem is the presumption of credibility and truthfulness absent that proof. If it isn’t already obvious as fuck from the timeline and documentation surrounding the sex club warrant, powerful and affluent white folks like Trump get treated with immense care and respect for their rights. But not every investigation is carried out with such care and respect. And it wouldn’t hurt a bit if a few more “law and order” Republicans, including not a few Never-Trumpers were to develop a bit more skepticism about the claims of cops and prosecutors in the absence of evidence.
We really should consider not using the same statistical modeling for youth turnout we’ve been using for years when doing these polls.

It’s an open goddamn seat previously held by a Republican for the last twelve years. Conceding the seat eight weeks out to an opponent who suffered a stroke and left the campaign for two full months contains some kind of useful information. But being Republican, Degen is immune.
In many ways having nothing at all to do with his health, Fetterman ought to be the ideal opponent for any “modern” Republican. He’s a Sanders liberal Democrat, who began his public service in community organizing and social work. He dresses like your unemployed brother-in-law. And he looks like Shrek.
But the GOP will very likely lose this one. And though even Degen knows it, he refuses to face up to the reasons or make any attempt to learn from them. We’ve talked this over before, many times.

This GOP nominee is a disaster. And this was easy enough to see coming. But the reason he is the nominee, and not the arguably more talented opponents he faced in the primary, is because the entire GOP is enthralled to an ignorant television clown who still, even now, controls their destiny and rules over every critical decision. And knowing this, and knowing with growing certainty what it has cost them, what it is costing them, and what it absolutely will cost them well into the future, they still can’t quit him.
Even now they run to his defense, including Degen. They simply can’t resist doing so. Even as the criminal evidence continues to pile up and the damage to themselves and their reputations continues to pile up with it. Because when they were not paying attention they allowed “party ahead of everything else” to become “Trump ahead of everything else”. And for that he will destroy them.
It remains useful to note that there has never been a point when they could not have easily avoided all this by simply repudiating Trump and forcing him to stand alone to sink or swim on his own. Democrats certainly did that to Clinton over the blow job. Hell, they did it to Barack Obama simply for being Black. But the one enduring fact of Trump’s entire political career is that throughout it all he has been propped up, sustained, and defended by nearly every Republican anyone can name. And those few brave Republican souls willing to put even a smidgen of distance between themselves and support for Trump have been permanently cast out.
They are doing all this to themselves. But Fetterman deserves some credit. His rise in Pennsylvania politics is a study in determination and will power. Up until May the entire campaign strategy was built around the candidate himself appearing everywhere, all the time, and personally convincing small groups of voters all across his state to support him, seemingly one handshake at a time. When his stroke forced him onto the sidelines in May his social media team and communications team pivoted in a way that every other campaign is now going to school on. And it is probably fair to say at this point that Fetterman’s unique blending of working class ethos with progressive idealism has probably decoded the current populist atmosphere for those Democrats smart enough to pay attention.
But all that should have done for him is put him in the running at a disadvantage to a better funded Republican opponent in a cycle automatically putting him six points behind at the starting gate. Instead he is narrowly favored to win based on polling that seems to be oversampling the wrong respondents in a way that might favor his opponent.
Republicans are doing all this to themselves, and they appear determined to continue. We should not be a bit surprised if between now and the summer of 2024 the Supreme Court once again accedes to Republican bigotry and hatred and takes away birth control and marital freedom, producing further skewing of turnout, right before they nominate Trump for the third time in as many cycles.
And the GOP can only flail wildly trying to explain the blood splatters and finger prints and beg hopelessly to change the subject.

During the match BYU’s coaches appear to have been reluctant to investigate “their own students”, delayed notifying campus law enforcement and facility staff, and downplayed concerns at the time. It was not until after the game when a Duke player was physically confronted and a threat of violence delivered in the presence of multiple witnesses that they finally took meaningful action. And that also prompted the involvement of the AD.

I ran across a tabloid story that says Texas has spent $12.7 million of taxpayer money to bus 7,400 migrants to Washington D.C., New York City, and Chicago.
That works out to about $1,700 per bus passenger. The provider is a Texas-based charter company. A one-way ticket on Spirit Airlines from Dallas to Chicago costs 54 bucks.
I’d be very surprised if that company isn’t a GOP donor. I have a suspicion taxpayer money is being converted into GOP campaign funds by washing it through that outfit.

The footnote addresses the claim by stating that, while the previously provided receipt is sufficient under the law, “the government is prepared, given the extraordinary circumstances, to unseal the more detailed receipt and provide it immediately to plaintiff.”
Receipts provided in criminal search warrants are normally scrubbed of details that might be prejudicial to the due process rights of anyone who might later be accused of crimes arising from the warrant. For example a search warrant receipt provided to Matt Gaetz might list “Photo albums” instead of “Photo albums depicting adolescents engaging in sexual activity”.
Once this footnote was published into the court record it notified media organizations of the existence of another “more detailed receipt” held under seal. As of this morning close to two dozen media companies and organizations have filed briefs and motions to the court requesting that the “more detailed receipt” be unsealed. With Trump being on record in a sworn filing demanding it, and with DOJ not opposed, the third party motions will probably be granted in the next day or two. Maybe even later today.

More troubling signs ahead for Democrats?
As I mentioned yesterday, Trump’s parking lot lawyers had pleaded for a more detailed search inventory and DOJ, having baited and set the hook, reeled the stupid motherfuckers in, by notifying the judge “that sounds totally cool to us, judge”.
Judge Cannon released the sealed inventory this morning.
Fuck me. Big fucking jail time.
Among the items that leap off the pages are 46 empty folders with classified labels, and 42 empty folders labeled “Return to Staff/Military Aide”, all from various different boxes and containers. A total of 88 classified documents removed from the White House SCI have been transferred to unknown persons in clear violation of the espionage act.
This is really bad. In terms of national security they’ll have to carefully reconstruct as best they can an approximate inventory of these missing documents in order to determine how what equities and interests have been compromised. That will involve each of the three-letter agencies and the Dept of Defense. And it will probably take a while. It’s possible people are dead right now because of these missing documents. It’s possible more will die. And it’s possible that some of our defense systems are no longer reliable. Very shocking stuff. That’s not partisan. That’s just what it is.
It’s also possible that some of the missing documents are included among those recovered, either with the empty folders or previously. But matching documents with empty folders is obviously not something a Special Master from outside the government would be capable of doing at all. The judge’s response to the demand for a Special Master will be impacted by this disclosure and it will be complicated. I’m not sure there is any way for the judge to grant Trump his motion now, at least not for the time being. This constitutes a kind of breach of national security that only the FBI is equipped to handle. And protecting national security should supersede protecting the due process rights of the assholes responsible for that breach.
In terms of criminality it’s a huge criminal case that would very normally rank easily with Aldrich Ames or Robert Hanssen. It’s very hard for me to imagine how anyone with modicum of familiarity with the law could involve themselves in this kind of stuff. To anyone who has ever received a clearance and training in classified document handling this would be radioactive, “you touch it you die” stuff. I don’t care how aggressively insistent and manipulative Trump may be. All of these people involved knew better. What caused them to ignore that is beyond me. They will go to jail. And they deserve to.
This also means that DOJ is probably contemplating (or should be) additional search warrants. This thing is rather out of control.
10 years is way too excessive for someone who only stormed the capital beat a police officer and committed perjury during the trial.
