I think the clearest, best interrogation into the legal quality of the original two week late filing, and today’s refiling of the Trump “complaint” motion is to be found in the response issued by Judge Cannon late this afternoon.
As we might have expected this Trump-appointed judge is being patient and professional. She’s basically taken the rambling 27 page complaint, styled as a motion, and spit it straight back to them with a series of red-pen notes calling for restatement in the form of a valid complaint, argument in support of jurisdiction, statement of the legal standards the plaintiff would see applied and why, and an explanation of remedies sought.
I guess it’s fair to point out that these things she’s asking for are basic, normal, and fundamental elements in a normal people lawsuit (as opposed to, for example, the pro se federal prisoner lawsuits that judges like this one have to review). Graduates of good law schools are familiar with the standard form. So she’s basically giving them an outline for how to refile in a way that she can then consider it. And she’s giving them until Friday to do the homework. I’m not optimistic for them. And another week goes by.

Louisville police officers have now formally admitted under sworn testimony that they knowingly fabricated various claims in order to obtain a no-knock, guns-a-blazin’, high-risk felony warrant to break down the door of Breonna Taylor’s home in the dark of night and shoot her to death as she slept. They admit that they knew the suspect they were seeking was not there. They admit that they knew he was not receiving any mail or packages delivered to that address. They admit that they knew that at the time Breonna Taylor was no longer in any kind of relationship with their suspect nor had she been for a very long time prior to executing the warrant.
Why they lied remains a practical mystery. The police who were involved in the conspiracy to deprive Breonna Taylor of her constitutional rights that led directly to her murder all claim it was because they were “eager” and “aggressive” in their pursuit of their felony narcotics suspect, all the while admitting, albeit reluctantly, that they knew there was no practical connection between their suspect and the woman they slaughtered in her bed. It can’t really be explained in terms of practical police work.
They knew she wasn’t connected to the suspect. They knew there were no exigent circumstances present that would justify breaking and entering in the pitch dark of night, unannounced into private home with weapons drawn in a tactical formation, ready to open fire at the slightest provocation. They knew they were not at any real risk for serving a standard search warrant. They knew there were no practical reasons for any kind of warrant at all. They knew that all the situation really justified was a polite visit with a few polite questions. But they did what they did anyway and it resulted in a completely innocent, law abiding, hard working citizen being shot to death in her own bed as she slept.
Does it matter that Breonna Taylor was Black?
Remember now that in the months following Breonna Taylor’s murder as the facts began to slowly emerge, we were told by the Louisville Police Department that this was going to be a case of incompetence. That “lazy” cops had failed to check the facts and confirm details contained in their files that led to the no-knock shooting gallery armed attack. But now we know that was never true. Louisville Police had not been lazy. They had checked on the details. And they had learned that the details were wrong. They had learned that there was no longer any connection between Breonna Taylor and their suspect. It was not lazy or incompetent.
It was deliberate. They deliberately chose to lie about the circumstances in order to place Breonna Taylor at the center of a harrowing, traumatic, life threatening armed assault.
Can you speculate why that might have been? Knowing that it was completely unnecessary, can you imagine a reason why Louisville Police would deliberate choose to put this woman in that terrifying and horrific situation that led directly to her murder? There is a “law enforcement” reason.
It’s because they wanted her scared to death. It’s because they wanted to coerce an innocent, hard working, law-abiding citizen with terror. They wanted her scared for her life, traumatized, and willing to do anything to regain her sense of safety. That was the plan, I absolutely guarantee you. I’ve seen it before. This is how police gain cooperation. Could she have been of use to them? Who knows? Instilled with enough fear some people will take incredible risks. To the Louisville Police Breonna Taylor was not a human being. She was a tool.

With regards to Biden forgiving student loan debt, I’m all for it. I had student loans and I paid them off (many years ago). I think it is good for the economy and morale of people saddled with huge debts.
I know Dr. Dumbfuck come on here and rail against it, forgiving debt to English majors and such is just bad form and people that take out student loans and don’t pay them back are ripping off the taxpayer.
With regards to that last point, I’ll point to no other than Donald J. Trump and the poster child for ripping people off. He utilized bankruptcy court to shirk his debt repayment obligations, not once, not twice, but at least five times.
Interesting how it was the Republicans that objected to including student loans in bankruptcy codes, that is to say you can’t use bankruptcy to get out of repaying your student loan debt.

If the 100 largest universities in America simply took half of their endowment funds and applied the monies to pay off student loan debt, about 25% of all outstanding student loans could be retired. The other 75% should be paid by those who borrowed the money for educations. I believe this is a better solution, initially, than forgiving student loans at the national level. Canceling existing student loans is a cheap give-away to buy votes in November.
One thing definitely certain – the government needs to exit the business of student loans. The borrowers need to borrow carefully and make the education mean something other than having a nice piece of paper to frame and hang on the wall.

During the 2007-2008 financial crisis, when many states faced budget crises due to plunging tax revenues, big chunks of higher education funding were offloaded onto students.
By writing off a portion of student debt, the federal government is, in effect, filling in for the state support that was taken away from these students.
It’s really not much more complicated than that.
It’s not a gift. Historically, governments have underwritten higher education because it’s a good investment, one that more than pays for itself, because higher earnings produce higher tax revenues. Giving these students some debt relief will enable them to spend more in the economy, producing higher tax revenues.

When I started college, I couldn’t have borrowed at all, much less carefully. Who lends to an indigent, emancipated teenager who has nothing, and for whom a decent-paying job is still four years away?
Government-insured student loans made it possible for me to go to college, and converted me from a Goldwater conservative to a lifelong Democrat. Conservative philosophy, which looked good on paper when I was a kid with no life experience, is fine for people who don’t need a government cosigner for their student loans, or unions to get them livable wages and safe working conditions. It dishes out nothing but shit to those starting from the bottom of the socioeconomic ladder. I had no choice but to become a Democrat. Conservative ideology and policies forced me to be a Democrat.
It isn’t vote buying. No one bought my vote. I simply learned which party cared about me, and which one didn’t. There is no reason why someone with an IQ in the top 1% shouldn’t get a college education simply because they don’t have a family willing and able to pay for it, which was my situation. When Republicans talk about “pulling yourself up by your shoelaces,” they’re referring to people who started out with only a few million and became billionaires. They’re not talking about a penniless teenager working his way through college on $1.25 an hour.
Today a college degree is almost a necessity for a decent job. Most of those seeking degrees aren’t in a privileged status. You fuck them over enough, you’re gonna turn ’em into Democrats. That doesn’t mean the Democrats bought their votes. It means you fucked them over.

As far as I can tell, the only thing we learned from the MAL search warrant affidavit is that in June when DOJ CounterIntel served the last subpoena on Trump at MAL Trump’s parking lot attorney concluded that DOJ would probably seek a search warrant. So they drafted and sent a letter to DOJ outlining their (quite erroneous) reasons why such a search warrant would not be proper. They included with the letter a demand that the letter be shared with any judge considering such a search warrant. So DOJ went (shrug?), and included the stupid, vapid letter with the affidavit.
It’s kind of remarkable in a couple of ways. Just to have included the letter in the affidavit is remarkable. It has no bearing on the 4th amendment reasons justifying a non-permissive search. Especially since it is a judge’s duty to protect the 4th amendment rights of a target when considering a search warrant. A judge is as likely to be insulted by it as ignore it. But it’s also quite remarkable because it proves that in June Trump expected a search warrant. And even more so because in the stupid fucking idiot letter Trump argues that he can’t be prosecuted for retaining classified documents. Which proves that at the time the letter was drafted in June Trump knew he was withholding classified documents covered by the June subpoena.

Seems likely the defense at this point will have to morph yet again to the position that, despite whatever “The Derp State” says, Trump’s sincerely held belief was/is that he has a legal right to keep any document he likes. That’s cute. And it might work with any other prosecuting agency. But DOJ is conditioned in these cases to specifically notify targets suspected of having improperly retained classified material or other government property about what the actual fucking law says. Trump received the last such notice in June in person, hand delivered. And his parking lot attorney signed a sworn statement to that effect.
They knew they were breaking the law. And they didn’t give a fuck.
Count on Garland to be personally invested in this now. It was and is a personal affront to the Attorney General and a general affront to all federal law enforcement by a retired TV celebrity living in a private sex club in Florida. Assume that Garland will be as thorough and as painstaking as is humanly possible. But this will be a subject of daily update memos and weekly staff meetings from this point forward. Making a case against Donald J. Trump just became an agency focus. God help him. Because nobody else can.

Timeline:
