I did a quick perusal of Judge Mizelle’s airline* mask decision (here).

Lot of states’ rights stuff in there, which on its face makes no sense. For example, she wrote that the CDC’s authorizing statute contains “no ‘unmistakably clear’ language indicating that Congress intended for the CDC to invade the traditionally State-operated arena of population-wide, preventative public-health regulations.”
(And I doubt the “unmistakably clear” part was ever a generally accepted rule of statutory construction; IIRC, she quoted Gorsuch.)
Now visualize 50 different state policies, and try to apply that to an airplane full of passengers flying at 30,000 feet and 500 mph; every time it crosses a state, the policy changes. How are you going to implement or enforce that?
More broadly, how do you manage a nationwide public health emergency without federal authority, relying solely on each state to manage it as it sees fit, with millions of people crossing state lines every day? Her decision posits that Congress never foresaw, nor provided for, such a situation.
I think she fucked up. (But I would word that differently if I were writing an appeals brief.)
