The Seattle Chapter of Drinking Liberally meets on Tuesday evening. You are welcomed to stop by.

We meet every Tuesday at the Roanoke Park Place Tavern (2409 10th Ave E, Seattle) starting at 8pm. You will most likely find us on the patio off the back of the pub. The kitchen isn’t open quite yet, but will be soon. Carry-in food is okay when the kitchen is closed.

    In the Trump Terror Attack plea deal of Oath Keeper Caleb Berry, unsealed this morning, Berry confirms that he and other Oath Keepers established, and maintained a cache of weapons and ammunition at a Comfort Inn Ballston in Arlington, VA.

    This is now the second Oath Keeper plea deal in which the preparation of weapons caches is confirmed by the defendants who took part in the terror attack on The Capitol.

    The 5 Republicans not-named-Liz-Cheney will seek to issue their own separate report. I believe Bennie Thompson should prevent that, and most likely will.

    What that will mean is that the five will have to spend their own money producing such a report and that it will not bear the title of the United States House of Representatives or of any other government office or agency*. They’ll have to raise private money to fund it and hold their own separate news conference announcing it. Probably from the truck yard of a landscape company.

    Gym is about the only one of the five likely to be interested in that sort of performance art. But the Minority Leader will ultimately decide.

    *Republicans in control of the House were unable to prevent such “alternative” reports from issuing following their two year investigation into the Benghazi attacks because they were not in charge of the White House or the State Department.

    If this upsets you as a taxpayer (and I believe it should) then the correct response is to get rid of all the extra cops who are so bored and frustrated with their stupid, meaningless make-work jobs that they go out of their way to pull these kinds of stunts – and much worse.

Setting the question of qualified immunity aside, even in cases of a “well established right” where QI can’t apply, it can be impossible to bring a civil cause against asshole cops who beat the fuck out of old men and children for sport. Unless you can get pro bono representation or have money to burn there’s risk. Courts suck at this. And juries do to. And even when they see through the cop bullshit, they are still reluctant to award money damages just because you were arrested, hog tied, cavity searched, and tossed into a cell face down in two inches of standing urine. So a contingency fee seeking lawyer may be unwilling to take the gamble. Cops know this very well. That’s why they love saying shit like “you can beat the rap, but you can’t beat the ride”, etc. But fee awards transform this calculus for lawyers. If the case is strong, and the facts and law are on the plaintiff’s side, then even if the jury award is tiny they can still be made whole. A cottage industry is born.

    An examination of the case by BuzzFeed News also reveals that some of those informants, acting under the direction of the FBI, played a far larger role than has previously been reported. Working in secret, they did more than just passively observe and report on the actions of the suspects. Instead, they had a hand in nearly every aspect of the alleged plot, starting with its inception. The extent of their involvement raises questions as to whether there would have even been a conspiracy without them.

    Clearly all right-thinking persons should laud BuzzFeed’s editorial decision in 2017 and condemn it for its 2021 choice.

    (4) a teacher, administrator, or other employee of a

    to another race or sex;
    (ii) an individual, by virtue of the

    It also states:

    Nothing in this section may be construed as limiting the
    teaching of or instruction in the essential knowledge and skills
    adopted under this subchapter.

    The text may reasonably be interpreted to read that a teacher can be required to teach slavery as a deviation/betrayal/failure of the American values of liberty and equality. . Which is pretty much the same as teaching that slavery was/is morally wrong.

    What you don’t like, QoS McHillbilly, is that the bill states that The 1619 Project can’t be crammed down the throats of students. So just come out and say that instead of lying.

    One of the things I like about the 20 July Plot remembrance ceremony in Berlin, is swearing in of new recruits to the Bundeswehr. Although lately, they have had penetration of the Armed Forces by far-right extremists. The FDP should have thought of that when they got Merkel to abolish compulsory national service.

An entrapment defense must demonstrate “Inducement” that includes articulable acts of coercion overcoming a law-abiding citizen’s will to obey the law. And that raises the second big element, which is the defense must prove that the defendant was entirely without criminal intent prior to the act(s) of inducement. Any evidence showing predisposition toward the indicted criminal conduct obliterates an entrapment defense. Evidence of predisposition would include written, oral, and electronic communications describing or declaring that intent.

    The Buzzfeed reporting is sensational and theatrical, And like any good story, it tries to put the reader in the mind of the main characters. But it describes that mind from the point of view of the attorneys defending them against the crimes they are alleged to have committed. And most importantly of all, it doesn’t show the elements needed to make the defense. They were tricked. They were encouraged, and even assisted. They were not coerced. And they all made abundant expressions of their predisposition toward the criminal acts. It’s a one-sided, “feels sorta like” story. It’s not a criminal defense. It does not allege misconduct.

    But still there must be some reason why this is so important to Tara right now. And I suspect that’s because she hopes it will be useful in a general effort to discredit federal prosecutions of right-wing terrorists, specifically the ones who attacked The Capitol on Jan. 6th. This is a “conservative” taking the side of the terrorists attacking America. It’s become a theme with them since Trump was defeated at the ballot box. They now want to burn it all down. And they’d like very much, thank you, if the DOJ would agree to make it easier for them to do so.

    This won’t be as terrible looking as you might normally expect, given that he’s a lawyer (sort of). He’ll come across as competent and professional. But all the evidence makes a compelling argument to the contrary. And though he will present as “insightful” and “probing” and we can also expect plenty of smirking facial expressions, etc. it won’t help him overcome the mountains of evidence against him.

    He’ll put on a pleasing performance. And then probably lose.
