    She represents a small district constituency from a small state that is arguably not very representative of the lives and experiences of most American voters. There’s no reason to expect large numbers of voters to immediately connect with her or her messaging. Her entire candidacy seems to be predicated on her relative youth, her gender, and her “outsider” status. But how well the “outsider” framing works in a national election is historically dependent upon timing and events. So far in the Democratic primaries “outsiders” have not done well this year. The appalling incompetence and failure of the incumbent “outsider” probably has a lot to do with that.

    I don’t see where you get “hate”. I don’t see Gabbard being picked on so much as being entirely ignored. Even playing the victim hasn’t elevated her profile – at least not in a positive way. Her SLAPP suit is frankly an embarrassment and has only served to make her look like even more of an out-of-touch fringe candidate.

    At least her attorneys realize they have to allege malicious intent to avoid getting their complaint thrown out on a motion for summary judgment.

    However, in the caption, they’ve omitted what appears to be an essential party: American democracy. I suppose the latter can always retain its own attorneys and file a motion for joinder.

    I hope, for her attorneys’ sake, their fee agreement with Tulsi is based on billable hours, not a contingency basis. This looks like potentially a large investment of hours to me. Especially if they and their client have to pay Clinton’s hourly legal fees, too.

    The complaint itself fundamentally refutes its own premise. It uses the filing as an opportunity to advance opinions critical of the defendant in a public forum that are not materially related to the alleged defamation. That will not go unnoticed by the judge no matter how many times they amend the complaint.

    This use of campaign funds to advance SLAPP suits in order to push a “newsworthy” story into the media is an abuse of the courts as well as an abuse of the democratic process. The important issue at least in this case is that plaintiff’s complaint can be challenged on it’s legal sufficiency alone, without calling into question its factual sufficiency. And so rule 12 and rule 8 analysis would apply and no discovery need take place.

    Often one of the vexatious purposes of these SLAPP suits is to produce a discovery adventure intended to be either costly, embarrassing, or both to the defendant (see Judicial Watch). That will not be the case here. LOLsuits like this one and those being brought by the RapeHero2020 campaign are exclusively intended to use campaign donor money to inflict a financial penalty on the defendant and to manufacture news coverage. That’s why we need a federal anti-SLAPP statute. Federal courts are incredibly costly venues in which to defend a meritless case. The procedural complexity even to reach a dismissal under rule 12 and rule 8 can easily run into six figures. That may be chump change to a nationally funded presidential campaign. But it’s potentially devastating to someone posting to a satirical twitter account.

    Yes and no. Large statutory employers are already modifying policies. So I’m not going to be surprised if these gig contracts are modified at least temporarily.
