One person’s lying and fraud is another person’s “strategic curation of their personal brand”.
These are the times we live in. When “fake it till you make it” is all you really know, eventually “fake it” is enough for some.
More telling is what this episode tells us about how this person views their own record of accomplishments. She gained admission to and attended a top 100 university. And according to the university she completed a substantial portion of the coursework toward her undergraduate degree. But for whatever reason she never completed the program. No crime in that. Plenty of people have stepped out of their chosen degree programs late without completing them and gone on to careers of great merit and accomplishment. Probably just as many have completed rigorous coursework to completion only to enter careers that never required it, or even valued it very much.
But something about this for some reason does not sit well with Ms. Howard. And I take a greater interest in that reason. She doubts herself in this respect. She is sufficiently gripped by those doubts to drive her to these kinds of extremes. Most people faced with sufficiently compulsive self-doubt can be driven to acts of very low character. Our trolls prove it nearly every day. But so do plenty of otherwise good people.
It’s the pretense that represents the greatest danger. Once any
Republicanperson succumbs to the relief from self-doubt granted by pretense it can lead to a precipitous decline in character and behavior. Florida Republican voters would be wise to avoid Ms. Howard, not for what she did in the past, but for what it demonstrates about what she is likely to do in the future.But of course this is the party that overwhelmingly nominated a serial child molester to run for the Senate and overwhelmingly nominated an admitted finger rapist and rawdogger of greasy porn starlets to run for President. She’ll probably win the nomination in a landslide. Trump won. Elections have consequences. This is who they are now.

Not personally hoping for Warren in 2020. But I’m willing to track this down for the sake of fairness and because I think it illustrates a very good point about the intersection between “identity” and politics – a point likely to be lost forever on the party of “Jews will not replace us”.
In a 1996 Harvard Crimson article, a Law School spokesman at the time Mike Chmura was quoted:
“Of 71 current Law School professors and assistant professors, 11 are women, five are black, one is Native American and one is Hispanic.”
..
“Although the conventional wisdom among students and faculty is that the Law School faculty includes no minority women, Chmura said professor of law Elizabeth Warren is Native American.”
Reporting during the 2012 MA Senate campaign in the Boston Herald focused on these quotes, and others in The Crimson, from a period when the Law School was under fire for its record of failing to recruit a diverse faculty. BH followed up with the Law School concerning the origin of Chmura’s quotes from sixteen years before:
“Harvard Law professor Charles Fried, a former U.S. Solicitor General who served under Ronald Reagan, sat on the appointing committee that recommended Warren for hire in 1995. He said he didn’t recall her Native American heritage ever coming up during the hiring process.
“It simply played no role in the appointments process. It was not mentioned and I didn’t mention it to the faculty,” he said.”

“Fried said he learned about Warren’s Cherokee and Delaware background later when he found a picture of Warren’s mother and asked her about it.”
That the Warren family had a long history going back several generations of belief in a native American heritage is not disputed. They were from Oklahoma. It’s a thing.
But it also makes a few good points. Regardless of personal circumstance, there’s nothing really innocent about appropriating cultural heritage, even if you don’t do it formally, never seek to advance yourself professionally, and only mention it in passing among friends and family. Admiring and celebrating someone else’s culture is fine and a particularly worthwhile thing for its capacity to open us up to new ideas and new ways. But claiming it for your own, however innocently, can all too easily become mockery.
But as a law professor, and as a candidate for the U.S. Senate, surely Ms. Warren would have also understood more than that about the significance of Native American cultural identity. Raised in a middle class Methodist home in largely white, suburban university town outside of Oklahoma City, and even with family hardship from her father’s illness, like most white Americans she would have known absolutely nothing of the experiences and culture of most Native Americans. Though she is surely possessed of a great many diverse experiences and perspectives, that can not be said to be among them.
This episode appears to have caught her off guard at the time. Our understanding of the issues of cultural appropriation have evolved a lot since the Law School sought without her knowledge to exploit this family story of hers more than two decades ago. And she ought to be forgiven for not instantly pivoting from defending against a partisan smear to a more thoughtful discussion of why even innocent cultural appropriation in family stories passed down from generation to generation can be wrong.
She knows she isn’t someone who can give voice to the Native American experience. She may be right that even now, and more so in 2012, addressing that head on would be politically costly for her. But she’s missing an opportunity here to make the point that more truly diverse experiences and perspectives need to be represented in our public life, now more than ever. In its entire history, only 52 women have ever served in the United States Senate.

“The indictment or formal charge[s] against a defendant is not evidence of guilt. The law presumes that every defendant is innocent. A defendant does not have to testify, and if a defendant chooses not to testify, you cannot consider that in any way during your deliberations. The Government must prove guilt beyond a reasonable doubt, and if it fails to do so you must find [the][that] defendant not guilty.”
Tough call, unless you are afraid to subject your client to cross examination. The bulk of his defense is that the other guy did it, and that he was an unsophisticated, inattentive victim. The problem with that defense is that its success will often depend on presenting evidence of the defendant’s lack of sophistication, inattentiveness, etc. There are plenty of ways of doing that without looking like a complete idiot. And plenty of examples of high powered dudes pulling that defense off with some success.
But generally the best way of presenting that defense is to put your client on the stand and have him or her convince the jury. When your defense relies upon discrediting the prosecution evidence and witnesses as part of an even more sophisticated scheme that victimized your client it tends to leave the jury waiting for “the rest of the story”. When the defense turn comes and they don’t give the jury that story, juries tend to notice, regardless of what a judge instructs.
My guess: after closing tomorrow they’ll enjoy dinner on the taxpayers and a free night of Skinamax before rendering by Thursday evening. But thunderstorms in Alexandria could keep them in for another day if more than one or two jurors own boats.

Ballsy move maybe, then again they may think their defendant is screwed on some minor charge, so why irritate the jury as the jury may let him walk on it if the Prosecutor just looks mean and venal. The real question is whether there are laws prohibiting discrimination based on sexual orientation. If not, she would have to prove some sort of breach of contract, or breach of implied contract, to get compensation; and that won’t get her her job back.
Also, keep in mind that Trump and the GOP want to legalize this kind of discrimination, and not just by churches and church-affiliated schools whose doctrine doesn’t embrace the reality that some people are born gay.
Nor do they merely want to legalize discrimination against gays in employment. They want to allow businesses to refuse service to gay people.
And, although they haven’t overtly said it because they’re not sure they have enough public backing for it yet, one may suspect there’s at least some possibility they want to throw gays off rooftops, too.

It’s your idea of yourself as “white” and therefor kinda, sorta, absolutely very much special, even if you never, ever admit it. It’s an idea that’s baked into the culture and reinforced every day in every way. It gives you the liberty to assert with absolute confidence and not even the slightest hint of doubt, much less irony, that academic performance gaps between racial populations in public schools is because of “weak family structures”, and “lack of community support”.
It’s what makes you feel an overpowering sense of outrage if you, as a “white” person, are among a half dozen top scoring applicants for an academic or employment position, were to be passed over in favor of the one minority in the group. Yet it indemnifies you completely from even remotely sympathizing with that minority if they were to be passed over.
It’s what puts you in such a state of confusion when you see another “white” person called out, and perhaps even brought low (however briefly) for using marginalizing, dehumanizing, insensitive language toward racial minorities, while simultaneously seeing non-“whites” using similar language with little or no social opprobrium. It’s the invisible wall between “doing” and “being” that keeps you safe in a world made especially for you. It’s the wall that is the foundation of your stupid question.
Of course non-“white” people can be racist by doing racist things. But they can never be “white”. And they are not the people who need to change in order for things to get better for everyone.

The problem is, you can’t affidavit an appellate judge or justice for bias, so if this shmuck gets on the Supreme Court, the best solution is to not be a worker.
