    The judge is set to fuck the defendant. He should be preparing his appeal.
    The judge clearly has issues with both the statute and the defendant’s constitutional rights.

    It is not defendant’s obligation to clarify his intent. It is the prosecution’s burden to prove it. It would be a sufficient “theory” of the defense to simply argue that criminal intent has not be proved. Something the statue requires. The judge telegraphs very clearly that he is pre-judging the defendant’s invoking of his right to remain silent. That statement in the record of the prelim is a clear tell.

    Team Wife Beater is leaking the questions in order to prod the media to focus on the obstruction case – which is the most difficult case to prove (see above about criminal intent). The real action is probably surrounding charges of conspiracy and conspiracy to defraud. Like good little lazy robots, most of the media are ignoring most of the questions, just like they’ve ignored everything else that didn’t involve a porn star or peeing Russian hookers. And like good little lazy robots most of them are putting their shoulders to the wheel laboring to refute the Pussy-Grabber-in-Chief’s early morning rage-tweets. He tweets. They dance.

    The end game in all this is sweeping pardons and/or firing of the DAG and OSC. This media narrative is crucial to the trailerbilly sell-job. Deliberately skewing or overlooking key elements of the case has helped and continues to help justify very overt White House efforts to interfere with the investigation and threats to terminate it before its work is done. About a third of the questions leaked have absolutely nothing to do with obstruction. Answers to another third could reveal evidence about both conspiracy and obstruction.

    Our media are failing us in this thing bigly. It’s a disgrace. They are doing a lot of the same lazy shit they did throughout 2016. The worst of it is that they are being played. And when the dust settles and they are shown to be wrong as usual, they will once again refuse to report on their own failure, pretend it never happened, create ridiculous myths about “poor forgotten white mill workers” to explain it all, and then pillory some unknown comedian if she dares to point it out.
