Kenneth Starr and 19 other Republican lawyers have signed a letter repudiating a Liz Cheney ad that impugns DOJ lawyers who formerly defended detains.

Roger Rabbit Commentary: The overall record of a judge, not a single incident from his career, is what should determine whether he is elevated to a higher court. As the above quotes indicate, Judge Chatigny is highly respected, and is supported by two Republican former U.S. attorneys who know him well.
There is no more important decision a judge makes than one involving the death penalty. The controversy over Judge Chatigny arises from a hearing on a stay of execution for Michael Ross, who was convicted of murdering 8 women and girls. It was an emotionally charged case that received massive publicity.
The facts are complicated. Ross, who fought execution for 17 years, abruptly waived his appeals and hired a lawyer to facilitate his execution. His father hired a lawyer to fight the execution. One of the legal issues in the hearing was whether Ross was mentally competent to waive his appeals.
Some of Judge Chatigny’s critics describe his conduct of the hearing as “heavy-handed.” They particularly cite the judge’s comment to Ross’ lawyer to “have his license” for arguing that Ross should be allowed to die. Chatigny told the lawyer he should “be in his [client’s] face” and that what the lawyer was doing was “terribly wrong.” He was also accused of a conflict of interest because of his prior involvement in the case.
Judge Chatigny had crossed paths with the case some 10 or 12 years earlier when, as a practicing lawyer, he filed a “friend of court” brief on behalf of a group of criminal defense attorneys who were “gravely concerned about the trial court’s rulings on significant evidentiary issues in this case.”
According to a newspaper, “State prosecutors filed a complaint against Chatigny, who was later absolved by a federal judicial review panel. The panel found Chatigny’s actions unusual but not improper.”
Here are the points I would make:
1. Although Ross committed horrific crimes, this fact — and the emotion and publicity surrounding the case — are not relevant factors in resolving the legal issues the judge was called upon to decide.
2. It is not a given that those who commit monstrous crimes are “monsters” who should be executed. Under our system of law, if they are insane, we do not execute them.
3. In a death penalty case, it is standard judicial procedure to not accept the condemned’s stated wish to waive his appeals without inquiry into his mental competency to make that decision. Thus, Judge Chatigny’s consideration of this issue in the stay hearing was not only appropriate but required.
4. Judge Chatigny’s handling of the hearing and the alleged conflict of interest were found by the reviewing authority not to have violated judicial ethics. This determination is authoritative for all purposes.
4. In general, the lawyer representing Ross had a duty to advocate for his client’s wishes; however, lawyers are not free of responsibility to consider whether what the client wants is in the client’s best interest, especially when the client’s life is at stake, and while I personally think the judge’s remarks exceeded proper decorum, it was appropriate in the circumstances for the judge to inquire as to whether the lawyer had properly counseled his client with respect to the decision the client was making.
5. Where life is at stake, I would rather have a judge err on the side of issuing a stay than allowing an execution to proceed which may later come into question after it is too late to rectify any error. See, e.g., Texas GOP Gov. Rick Perry’s shameful handling of the Todd Cameron Willingham case.
In this case, partisan Republicans have turned a Democratic judicial nominee’s handling of a highly charged death penalty case into a political football. Far from offering a reasoned discussion of the judge’s qualifications for higher judicial office, they are seeking to inflame public opinion against him. When the Senate considers whether this nomination should be confirmed, light will be much more useful than heat.

1. I’m a liberal propagandist and Democratic party hack, and shilling for that viewpoint is what I do on this blog. Deal with it, or seek counseling for your hurt feelings.
2. That said, I did not endorse Judge Chatigny’s nomination for the federal appellate bench in my comment. I don’t know enough about him to take a position. On paper, he appears to have good credentials, having followed the usual judicial career track (top student/Law Review-judicial clerkship-practicing attorney-trial judge experience). But to really evaluate any appointment to an appellate court, you have to review a cross-section of the nominee’s past work, particularly his judicial decisions, which I haven’t done. Presumably, he was vetted by the White House and his general views were found to be consistent with Democratic values — which is no reason to keep him off the bench.
3. The only categorical argument I would make about the death penalty is that it should be limited to murder cases. Whether it is warranted must be decided on a case-by-case basis, considering the specific facts of the case. Thus, I am unable to make any general statement on this question.
4. I am well aware that Connecticut Attorney General Richard Blumenthal (a) is a Democrat, and (b) criticized Judge Chatigny’s conduct of the stay hearing. I wonder if you are cognizant that, unlike the two former GOP U.S. attorneys, Blumenthal was not a disinterested or impartial observer. As AG, he is the state’s chief prosecutor, and was a litigant in this case advocating on behalf of the state court’s death sentence. In general, attorneys involved in a case are not permitted to personally criticize the judge, as that tends to undermine the impartial administration of justice, but they may do so in the context of legal argument in an appeal of the judge’s ruling and/or in pursuit of a judicial conduct complaint against the judge, which is what happened here.

I really find it difficult to imagine anybody paying Marvin to troll here. On the other hand, his sense of humor could easily have led to his claiming to be a paid troll, like I said, to pull Darryl’s chain. So, yeah, I kind of concluded that Goldy, Darryl or whoever, just used this as an excuse to ban him. The only reason I could think of was that Darryl was fed up with Marvin’s repeated references to the negative student comments. And that’s fine. It’s their blog. I would just have prefered a more up-front explanation.

Stamm seemed to know what he was talking about in the music department. He even claimed to have played with Akiyoshi/Tabackin Big Band which was one cool band, one of my favorites. I tried looking up horn players with the various bands he claimed he toured with but couldn’t pin him down.

I don’t mind finding some redeeming quality in a few folks on the other side, not that I’ll ever agree with their right-wing politics. But there’s more to life than just politics.
