The fact SCOTUS made abortion as a constitutional right isn’t that big an obstacle, because SCOTUS has been wrong before, and has changed course before — as in the case of segregation, for example. If Plessy v. Ferguson can be overturned, then Roe v. Wade can be, too. This is especially true given that, while the constitutional right to privacy portion of the Roe v. Wade opinion is rock-solid, the Court’s extrapolation from this of a constitutional right to abortion is on much shakier ground, from a legal reasoning perspective.
It’s perfectly possible, even natural, for good and decent people to oppose abortion on moral and humanitarian grounds, even if you leave religion out of the picture, although the picture becomes somewhat blurrier when you include the negative impacts of forced motherhood in the equation.
Enacting laws protecting unwanted children from their parents’ urge to destroy them is a natural role for government. It’s hard to see how liberals, who support government intervention in a wide variety of other private activities, could oppose such laws on ideological grounds. The difficulty with such laws isn’t theoretical, but rather practical; to wit, the same problem government encountered in trying to protect society from the negative consequences of alcohol consumption. In a word, people are going to do it anyway. But that would be a flimsy justification for legalizing abortion, if that’s all there was.
It isn’t, of course. Our societal conflict over abortion really comes down to a clash of values. The question is whether a fetus has a right to be born and enjoy (?) a human life that supersedes the right of the mother to control her life.
Abortion politics is a result of the fact that simple-minded people see the world in black-white terms, whereas the issue is much more complicated than that, and sometimes requires people to make difficult judgments, which is something the legal system can usually handle okay if given the chance, but conservatives aren’t very good at. They’re more inclined to enact laws that leave no room for judgment in individual cases, which severely bolixes things up. You can’t expect people to support something that leaves them twisting in the wind. To make it work, you’ve got to offer solutions to their problems.
I personally prefer a system under which abortions would be rare, not because they’re illegal or impossible to get, but because women burdened with unwanted pregnancies would have attractive alternatives and incentives to choose them.
There will, of course, always be the obvious exceptions, as in rape cases or where the mother’s health requires aborting a fetus. Elective and necessary abortions have to be thought about and treated differently, and many pro-lifers have discredited themselves and their cause by refusing to do that.
