A few points, employees STILL are barred from suing employers for damages caused by on the job injury. Employees must prove that the accident was by zero fault of their actions. Employers can choose the facility or specific doctor that treats the employee if the employee does not have insurance. All a business needs to do to claim the worker is at fault is state that they worker did not follow any portion of the safety protocol properly and therefore are negligent.
So yeah, back to the 1910s with labor law.

It was a historic compromise between employers and workers and both sides got something: Employers got immunity from tort suits (and the possibility of large judgments) and predictable liability (under a standard payment schedule), and workers got swift and guaranteed compensation. No-fault was the linchpin of the new system.
If employers and their Republican lackeys want to renege on that deal, then I say let’s go back to the old system under which a jury could award millions of dollars to a worker injured on the job as a result of employer negligence. Plenty of my fellow lawyers would like to have that business. Then we’d see how much employers like the idea of tampering with the workers compensation system the next time an oil refinery or fertilizer plant blows up and fries a dozen workers alive. With juries making the compensation decisions, that should be worth about $5 – $10 million per dead worker.
