Open Thread 9/27

– The map for the 7 proposed Seattle districts does a better job of keeping the downtown area in one district than the state or county districts.

– I have not finished reading the Living Under Drones report, but so far, it’s pretty awful.

– There will still be blown calls, but the NFL refs will be back, and will be significantly better than the old ones.

– The 36th is an interesting race.

– People in swing states don’t like bad policy either.

– Those forest fires fucked up the air.

The fallout from the 9/11 terrorist attack (Hillary said so, finally) by Al Queda on the Libyan Benghazi site is just getting started.

WaPo points out that the moves Team Obama is making have political undertones:

“For political reasons, it certainly was in the White House’s interests to not portray the attack as a terrorist incident, especially one that took place on the anniversary of the Sept. 11 attacks. Instead the administration kept the focus on what was ultimately a red herring — anger in the Arab world over anti-Muslim video posted on You Tube. With key phrases and message discipline, the administration was able to conflate an attack on the U.S. Embassy in Egypt — which apparently was prompted by the video — with the deadly assault in Benghazi.
Officials were also able to dismiss pointed questions by referring to an ongoing investigation.”

    http://www.washingtonpost.com/....._blog.html

There might be some pretty tough questions about leaving our people unprotected on 9/11. Even the State Department on its own website posted a memo about ‘Terrorism and Important Dates’, and specifically referenced 9/11 in this post.

So that would look pretty bad, right, if the State Department wasn’t prepared on 9/11 despite posting that it was an ‘important date’?

Team Obama obviously thinks so. They removed that post from their website:

Bombshell: Obama Administration Deleted State Dept. Memo From Internet After Discovering Al-Qaeda Was Behind Benghazi Attack

    http://www.thegatewaypundit.co.....zi-attack/

How obvious an admission of fault is this? Imagine the HA outcry if the GWB43 administration had done it.

Lib Despair continues to maintain that we should all just wait for the official report. Problem with that is that it’s been two weeks and the FBI is still in Tripoli. Apparently they haven’t been allowed into Benghazi yet, according to CNN.

So I’ll just have to point out what we do know.

How bad is the economy tanking? Because of some revisions to earlier figures, monthly new job creation in the past five months is less than half of what it was in the previous year.

In a press release, the department said it would likely raise total employment by about 386,000 or 0.3% in the year from April 2011 to March 2012.

This is a bit over an average of 32,000 additional jobs per month, which would bring the average monthly job growth during that span up to 194,000 from 162,000

By contrast, the economy has added an average of just 94,000 jobs in each of the five months since March.

We had 3.1% GDP increase in 2011 Q4. This slowdown can’t be blamed on Bush.

As kos points out here, the reason the “47%” tape is SO DEVASTATING is because it fits in a narrative that already exists in peoples’ minds – that Rmoney is a ruthless, greedy dick.

It’s been an easy narrative to work with, given that Mitt Romney is genuinely a dick. From the way he treated his lessers at prep school to his tenure at Bain, from the way he demeaned NASCAR fans to the insufferable entitlement of his wife—all of that has allowed us to paint a picture of Romney that has left him the most unpopular GOP nominee in modern polling history, and the first to have higher unfavorable than favorable ratings.

This ad, from Obama, is nothing more than Rmoney’s words, and pictures of people who fit the Republicans’ favorite term, “Real Americans” (though I don’t think that means what they think it means)

    Watch for yourself, it’s devastating.

Shall we all start reading Kubler-Ross so we can deal with Cap’n Crunch’s emotions over the next few weeks?

its about the economy. Its about the party that crashed it and then tried to lit a club on the steering wheel just to win the White House. They’re on to you.

I absolutely agree with Cap’n Crunch that the economy sucks.

However, fact #1, it is vastly better than it was 4 years ago.

And fact #2, people believe Democratic policies will continue to make things better; corollary of course that doctrinaire Republican policies were responsible for the economic catastrophe that occurred under Bush II (I actually wrote a typo “Bust II” that would have been accurate as well)

In the midst of a catastrophic evaporation of demand, what is needed is massive government borrowing at effective negative interest rates (ie we profit merely by holding the world’s money) and SPENDING on infrastructure and capital investments – power grids, wind and solar, trains, schools, libraries, teachers, fire and police, municipal governments – we all get really cool stuff that will pay for itself multiple times over decades, AND we put people to work right now.

Now, it’s clearly questionable that we will get this under a second Obama administration, particularly if the House stays in the crazygreedy peoples’ hands, but there’s NO CHANCE that anything like that will happen under Rmoney.

People know that Rmoney is out to fuck them over.

We’re way past impeachment now … this is looking far more like treason, and it’s about time someone had the guts to say it. Some people do, yes. If this is that question 34 in the poll discussed on anther thread yesterday, it’s less than a ringing endorsement, for reasons discussed.

Yes, things were better than they were four years ago. But Obama didn’t pass TARP, Obama didn’t provide AIG, C, BAC large amounts of assistance (more than was needed, it’s turning out according to some reports), and he was the beneficiary of a quick response to an initial over-reaction.

Shorten your period of concentration – after all, in 2011 Q 4 we were in a decent recovery – and the justification for re-election is far less substantial.

Finally, I think it’s important to point out what no one around here ever mentions when they talk about how cheap it is to borrow large amounts of money at prevailing interest rates:

WE HAVE TO PAY THE FUCKING MONEY BACK.

“idiotic borrowing” is borrowing a Trillion dollars to invade Iraq. “idiotic borrowing” is borrowing to have massive tax cuts benefiting the rich. “idiotic borrowing” is running a deficit as a consequence of supply side economics.

Sensible borrowing is borrowing to either/both provide demand as a buyer-of-last-resort, or for capital investments that will pay back multiples of the initial investment. That the borrowing costs are essentially negative is just icing on the cake.

The bottom end of the housing market is recovering, in part because it’s oversold and people with cash who don’t want to invest in a 2-3% CD are buying small houses and renting them out for a 4-5% return in the form of rent and a likely 2-3% increase in valuation according to historic norms of home appreciation, in addition to the depreciation deduction they take.

    That’s not a housing recovery. That’s opportunism.

Just about everything around me that’s a house under $200K is under contract.

Seattle is not the US. Looking around and seeing yard signs supporting Obama doesn’t mean he’s going to have a landslide victory.

Yes, there is some housing recovery. We’re nearing the end of the foreclosure crisis, unforeclosed inventory is thinning, and the easy money on oversold starter homes has been made. The rest now cost more.

That’s not an indication of an economic recovery, just an indication that people with cash did what they needed to do when their CD rates had plummeted and bond interest rates and pricing susceptibility to inflation are scary.

    Nice try.

    That’s not an assumption, it’s a fact.

“Assume we have learned from that experience.”

There’s no evidence Republicans ever learn anything from experience. The rest of us knew better all along.

“Why would you support Obama’s efforts to do the same thing?”

There are many layers to the answer …

    1) We support Obama, but not necessarily everything he does.

    2) He’s better than any alternative we’ve been offered.

    3) The premise of your question, that Obama is doing the same thing as Bush43, is incorrect.

    4) In rough outline, Obama’s economic policies are similar to what FDR did to pull the U.S. out of the Great Depression, which more or less worked. The austerity approach favored by Republicans from Hoover to Romney has been shown to make things worse, so why would anyone do that?

    5) To the extent Obama’s economic policies have fallen short of what might have been achieved, that is largely due to Republican obstructionists in Congress, so why blame that on Obama? We should blame that on the Republican obstructionists. And how much sense does it make to try to solve the problem of Republican obstructionism by voting for Republicans?

“Pointing to a guy you despise and saying ‘Bush did it, too.’ isn’t a defense of Obama. It’s an indictment ….”

Bush was despicable on many levels, such as his warmongering, authorizing torture and kidnapping and lying about it, borrowing from China to give unproductive tax breaks to billionaires, supporting job outsourcing and tax breaks for financial sharks who dismantled healthy companies, etc. But I will defend Bush on his bank bailouts, which conservatives and tea partiers hated, because those bailouts saved us from another Great Depression.

(You can google for economists, professional economists not radio hosts who pretend to be economists, including a nobel winner who agree with that assessment.)

I think TARP worked. Once everyone is done doing their retrospectives it probably will turn out to be overkill. But clearly AIG needed support – the mark-to-market thing was killing them, as their assets were performing but just valued so low that their capital levels dropped dangerously.

I think ARRA created or saved some jobs. I think the manipulation of what jobs were put in those ‘saved’ categories is such that we’ll never agree on whether it was worth it. Hard to give credit to a program when the goal of capping unemployment of 8% was so divorced from the reality.

The money was spent unwisely and not swiftly. The market bottomed out and recovered before anything was disbursed and entered the economy. The trough was March 9th. Significant money didn’t hit the economy until a few months later. That’s not cause and effect in my book.

    Have a good day, all.

Lib da dunce works wonders with words…

Michael Fredrickson, general counsel for the BBO, says he does not believe a law professor would be considered to have “a continuous presence” or “an office practicing law.”

“If they actually practice here – as some part-time law professors at some of the smaller schools do – they might,” Fredrickson says. “But being a professor at one of the large schools, their office is a professor’s office, and the fact that they tend to dabble in the practice of law doesn’t run afoul of our rule. I don’t think Elizabeth Warren would fall within that, such that she would have to register here.”

Where is the real ruling? Just because this person DOES NOT BELIEVE, doesn’t make it not so Lib da dunce.

It was inappropriate for Fredrickson to make these comments without knowing the facts; perhaps he is a Democrat and went overboard to try to help his party’s candidate.

This is a killer paragraph Lib da dunce… so much for that debunking…

This section is one that frequently applies to my own law practice. I provide legal services in jurisdictions where I am not admitted to practice all the time, under the pro hac vice rules of the local state and federal courts. Under those rules, I can apply to practice in the courts of other states, including Massachusetts, as long as I am licensed and in good standing in Minnesota, and agree to abide by the ethics rules of those states. But you can’t practice under pro hac rules in the state where you reside, and no one claims that this exception applies to Elizabeth Warren’s practice in Massachusetts. So the question is, what “federal law or other law of this jurisdiction” would allow Warren to practice law in Massachusetts, even though she doesn’t have a Massachusetts law license? Neither she nor her supporters have suggested any such law that might apply.

Since puddl and Cap’n seem to want to discuss Elizabeth Warren, I’ll repost this from the other thread:

    73. Liberal Scientist is a Dirty Fucking Socialist Hippie spews:

I was doing a little web-based research on Scotty Brown this morning, and came across a bit of irony.

First, I (re)learned that Scotty and I are both Jumbos – we both went to Tufts, though he’s a few years older than me and we didn’t overlap there.

I was friends there, however, with this man’s daughter, a lovely and intelligent and liberal woman, from a very liberal family. Her dad was a prominent jurist in Massachusetts, and we, apparently, have him to thank for saving Scotty Brown’s future, as he seemed to rescue him from a very difficult childhood and the road to petty criminal obscurity.

    From Brown’s wikipedia page:

He shoplifted many times, and was arrested for stealing record albums and brought before Judge Samuel Zoll in Salem, Massachusetts at the age of 13 or 14. Zoll asked Brown if his siblings would like seeing him play basketball in jail and required Brown to write a 1,500-word essay on that question as his punishment. Brown later said, “that was the last time I ever stole.”

So…we have Scott Brown, broken home, abused, teenage petty criminal, son of a Republican politician, who has the good fortune to come before a caring, thoughtful liberal judge, who intervenes, and to Brown’s own admission, saves his future.

What does Brown then become? A tool of monied interests and the “I got mine” crowd that would have cared less if an inconsequential little thief swirled away into the prison industrial complex’s series of inescapable hellholes.

    There’s character for you, puddl.

Shouldn’t Massachusetts voters know whether a candidate for the Senate willfully and flagrantly violated the rules of her profession? Wouldn’t that fact, if true, have a bearing on her fitness to serve in the U.S. Senate?

Just had to keep looking for the checksez Massachusetts Court vs Federal Court issue… Link given above… wrongly rejected by checksez

The lien enforcement arose out of state law. Even though there were bankruptcy related issues, the question was whether the state law lien survived. As noted on the court docket and in the ultimate decision, the case only was in federal court because of what is called “diversity jurisdiction,” which permits a plaintiff to file in federal court if the plaintiff is a citizen of a different state than any of the defendants, and the dollar amount exceeds a minimum threshold (now $75,000).

The First Circuit ruled in favor of the creditor.

Proves once again checksez is usually on the wrong side of the issue!

Having the judgment go against her client doesn’t change the fact that it’s a federal court. That’s the only point im making and once again piddles, you’ve dug in your heels when a not crazy person would notice they’ve misread something complicated.

The site in question, Ethics Alarms, seems fine, though the page puddl linked to is just a reprint of more Jacobson – the guy who is a right-wing partisan hack and who has been going after Warren for some time – the guy who originated the whole law license issue.

From the comments at puddl’s link comes a sentiment I share, and wrote above:

I’m sorry, but at this time I have to call bullshit on this entire story until someone, ANYONE puts their money where their mouth is and files a formal ethics complaint against Elizabeth Warren with either the Mass BBO or relevant New Jersey body as it seems the New Jersey was her last active license.

Oop…I was wrong…about the proprietor of the website puddl described as ‘libtard’, and at first look that I thought appeared apolitical and innocuous.

A few quotes in the comments from the ‘libtard’ who runs that site:

    5. And in Massachusetts, a very political and crony-operated state, one can’t discount the fact that many lawyers in a Democratic monopoly state dominated by Harvard would be afraid of the long term consequences of reporting a Harvard Democrat who might get elected Senator. This doesn’t apply to Jacobson, but keep it in mind.
    6. Jacobson is the only one keeping the press and the Mass Democrats from burying this story, and it is still pretty much being ignored. As you can see from Freedman’s reaction, the overwhelmingly liberal/progressive legal establishment is inclined to look the other way. I don’t think focusing on Jacobson’s conduct is germane. He’s right: he’s raised the issue, and based on what he’s raised, Warren should be answering questions.

The question is, is this like Harry Reid’s claim that Mitt Romney didn’t pay his taxes, a bogus claim meant to force a candidate to deal with a non-issue based on nothing?

Doesn’t sound like a ‘libtard’ to me. Sounds like someone giving cover to a hack like Jacobson while he tries to kneecap Warren, which he’s done in the past, and which comes just as Scotty needs a distraction from the attention on his “Native American Detector Vision”.

    Shameful, deeply depply shameful.

No. If she was council on the case before the appeals process, you’d have a point. But, in everything I’ve seen quoted, and I’m willing to admit that some evidence could still come up that she was involved in the Massachusetts Superior case, just because the case originated in Massachusetts doesn’t make the 1st Circuit Court of Appeals a Massachusetts court.

there’s a fundamental difference between a state case and a Federal appeal that you are either too stupid to grasp or, as I suspect, you know you’re wrong and keep digging in so as not to admit it.

If Roger Rabbit argues a case before the 9th Circuit Court in Seattle, even if the case originated in Washington, he’s not arguing in Washington State Court

Poll: Obama leads grow in Ohio, Fla.

    By David Jackson, USA TODAY
    Updated 1d 18h ago

If new polls are any guide, President Obama has big leads in two states that could nail down his re-election: Ohio and Florida.

Obama leads Republican Mitt Romney by 10 points — 53%-43% — in Ohio, according to the Quinnipiac University/New York Times/CBS News survey.

Obama’s lead is 9 points in Florida, 53%-44%.

The president leads Romney by 12 points in Pennsylvania, a state the Democrats have carried in five straight presidential elections.

“Voters in each state see President Obama as better than Gov. Romney to handle the economy, health care, Medicare, national security, an international crisis and immigration,” Quinnipiac reports. “Romney ties or inches ahead of the president on handling the budget deficit.”

    So what, jerk.

The President is winning, the Republican Party is in shambles…

    …AAAAND…

…if I were the guys in Libya (and I am certainly glad I’m not) I’d be worried about waking up staring at the barrels of an armed Blackhawk.

Unlike St. Ronnie and Lil’ Georgie, this President takes out the bad guys…I thought “The League of Delusionary Assholes” liked the strong silent types.

There was a whole HA post about it.

    Today:

Just throwing this out there. I wasn’t watching closely and haven’t gone frame by frame through any video.

    Here’s my question:

What if HA ran a thread based on a falsehood by MSNBC?

So Cap’n, while you’re attacking MSNBC for allegedly giving Romney a sad, could you give us five itty bitty little improvements that Willard Mitt Romney will make in the lives of average working Americans, should he be elected President?

(I know that seems ever more remote, but that is why you’re defending him, right?)

I don’t need no stinking license. I am a native american law professor at Harvard. Fauxcohantas or Lieahantas. Either works!

Of course nothing about her will be posted this evening in the Friday Night Comics section!

Warren has been on inactive status in Texas since June 1, 1992. Inactive status means a lawyer is not authorized to practice law.

    Ouch!

The other thing from the link is this…

    (a) Qualifications. Except as provided below, no person shall practice law in this State unless that person is an attorney holding a plenary license to practice in this State, has complied with the Rule 1:26 skills and methods course requirement in effect on the date of the attorney’s admission, is in good standing, and, except as provided in paragraph (d) of this Rule, maintains a bona fide office for the practice of law. For the purpose of this section, a bona fide office is a place where clients are met, files are kept, the telephone is answered, mail is received and the attorney or a responsible person acting on the attorney’s behalf can be reached in person and by telephone during normal business hours to answer questions posed by the courts, clients or adversaries and to ensure that competent advice from the attorney can be obtained within a reasonable period of time. For the purpose of this section, a bona fide office may be located in this or any other state, territory of the United States, Puerto Rico, or the District of Columbia (hereinafter “a United States jurisdiction”).

Butt, butt, butt, all of her defenders claim she didn’t use her Harvard office to practice law. Therefore she’s not a member of the New Jersey bar either. Hence she’s not a member of any bar! And she told the federal courts she was a member in good standing in Texas! Oopsie…

Glaring is his utter siilence on the vile racism that white-boy Scotty Brown and his posse have been showing the world.

Nothing puddl? Nothing about the ‘obviously not a Native American’ x-ray vision? The war whoops? The Warren picture doctored with the war paint and feathers?

How convenient for you not to notice such vile displays of racism – you really are a good servant, carrying water for the worst people in the world.

When FAIL is just not good enough, only EPIC FAIL will do

When the data from the Fox News poll is unskewed by weighting their reported percentages between Romney and Obama to the partisan affiliations showed by Rasmussen’s extensive data results on that issue, the overall picture of the race is different. With Republicans weighted 34.8 percent, Democrats at 35.2 percent and Independents at 30.0 percent, the results calculate to Obama leading but by a smaller 46 percent to 44 percent margin over Romney.

Why does TX has four more electoral votes? I believe this is why.

Why, yes — there will be a Victoria’s Secret at Cowboys Stadium

    http://sports.yahoo.com/blogs/.....1;nfl.html

On the other hand, people are leaving New York in droves, and NY lost two electoral votes as a result.

Wow. That ad make Murphy look like Jane Hague..

I don’t believe Murphy was serving in public office at the time.. Nor was he driving.

So Murphy made a mistake. West fired a fucking gun next to a captive’s head who was innocent of wrongdoing. Not in the army’s interrogation manual afaik. He was fined and drummed out of the military..

And this idiot’s been on an ugly resentment binge ever since.

I wonder how the fundraising went after he accused his Dem colleagues of being communists. About as well as Michelle Bachmann’s after her Muslim witchhunt I’m sure.
