Looks like a pretty typical piece of campaign literature, huh? An oversized, glossy, folded pamphlet touting Rep. Dave Reichert’s reelection.
Only it’s not a piece of campaign literature, it’s a piece of congressional franking, paid for with our taxpayer dollars, and a clear violation of the spirit of the franking rules, if not the law itself. Oh… and it’s only one of six such mailings Reichert’s office has recently sent to voters.
Indeed, Reichert’s mailings have been raising eyebrows and filling mailboxes for months. At last night’s Drinking Liberally an experienced campaign staffer actually laughed when he saw the congressional seal on the pamphlet, while another knowledgeable politico rolled his eyes in disbelief. And this morning I corresponded with a longtime Republican consultant who confided that there’s a pretty blurry line between what is or is not a legitimate use of franking privilege, but that this one “crosses it by a mile.”
But it’s not just the content of Reichert’s mailings that pushes the limits of the franking rules. House members are prohibited from franking mass mailings to constituents within 90 days before an election; with a September 19 primary date, that means the last day this latest mailing should have been postmarked was Tuesday, June 20th. Yet this latest flyer didn’t start hitting mailboxes until Monday, June 26th.
Of course, presorted standard mailings like this can take over a week to go cross country, but since the cost is distance sensitive and the mailing was likely produced by local consultant Bruce Boram, chances are it was printed locally and mailed from the USPS’s Seattle Bulk Mail Center.
So the question is… when did this mailing drop? If it actually went out after June 20th, then Reichert broke the franking rules. Not exactly the kind of disregard for the law you’d expect from an ex-sheriff.

If you want more of the same, just keep voting for the people who control the Congress now. Abuse of franking was something the GOP said it would clean up in 1994. This and other mailings are simply more evidence of out of control spending by the GOP congress – spending designed to reelect a GOP majority that only postures as fiscally responsible. Real reporters in the mainstream media should be demaning all the data on use and abuse of the frank.

First of all, I offer my condolences to Sgt. Plouhar’s family. Their grief is shared by an entire nation grateful for his service. We’ll never get wingnuts to understand this, but we’re against the war, not the soldiers fighting it.
The volunteer military is a good thing. Let me rephrase that. We need a military, and filling the ranks with volunteers is a damn sight better than filling the ranks with conscripts.
Of course, I want “voluntary” service to be truly voluntary. I don’t think recruiters should lie to prospective recruits, or take undue advantage of gullible teenagers. Only the most naive or dishonest person would deny there have been recruiting abuses. The solution is not to be against the military — we need a fully manned military — or against the recruiters, who are trying to do their job. The solution is proper guidelines, and adequate oversight of recruiting practices, so that abuses don’t occur.
I don’t have a great problem with the fact minorities and poor kids are over-represented in the military, compared to the general demographic. Many of these kids see the military as an open door to opportunities that would otherwise be closed to them. It was for me — I went to law school on the G.I. Bill. For no one is this more true than the immigrants who dream of become American citizens, and realize that dream by enlisting in the U.S. armed forces. A door that otherwise might never open for them.
So where am I going with this? Simply this. There are people who claim “supporting the troops” means we have to be for the war. They are wrong. Sgt. Plouhar’s dad says his son believed in the mission and disagreed with Moore’s criticism of the war. I don’t doubt that, and I respect Sgt. Plouhar’s right to his opinion. But — and here is the huge but …
Whether soldiers want us to support their mission is irrelevant.
That’s what I said: Irrelevant. It’s not up to the soldiers to decide whether our country should go to war, or not. Someone once said war is too important to leave it up to generals. In that case, it’s certainly too important to leave it up to sergeants, or privates, to decide whether we should be there or not. Questions of war and peace are for citizens to decide. That is our right, and our obligation. As citizens, we have a right and a duty to insist that our government go to war only when war is justified and necessary. We can’t let Marine sergeants make that decision for us. As citizens, we owe it to Sergeant Plouhar and others like him in our military services to make sure their lives aren’t squandered needlessly or foolishly. Sgt. Plouhar may have disagreed with our opinion of the war he died in. We have our duty, nonetheless; and just as he pressed forward in the line of his duty, so we must press forward with our duty.
And I mean that with the greatest respect for him, his family, and all who loved him and will miss him.

I would agree that McDermott has less need than Reichert to send out campaign propaganda. But, campaign material should be produced and paid for by the campaign (i.e. not produced and paid for by the taxpayers).
There is no reason that McDermott would have any more or less reason to send out franked informational mailings (which are official U.S. Government business). The fact that you refer to this as “political material” and hint that it should somehow relate to how “safe” a seat is, betrays a complete misunderstanding of the franking privilege.

I was always under the impression that we were supposed to contact our congresspersons with our opinions. Almost any time a constituent contacts a congressperson the get a letter in response. I wasn’t trying to discourage “outsiders” from calling him…rather I was trying to encourage people in the 8th district to call.
Anyone should be able to call, but they will ask for your address and “prioritize” your comment by whether or not you live in the district—if you live outside the district I suspect a negative opinion will go right into the circular file. I live outside Reichert’s district, but have emailed opinion to him from his house comment form page. The last thing I got was a screen saying that I was outside his district and therefore would not get a response.

Hey, I’ve got an idea. Bush says it is the essential perrogative of the President to decide what is, and what is not, necessary for national security, and his decision is not subject to being second-guessed by the courts, Congress, or… well, anybody.
So when Bush leaves office in 2008, lets make sure the new Democratic president keeps Gitmo open. Then arrest Bush, Rove, Cheney, Rumsfield, Gonzales, etc. for endangering the national security of our country by violating the Constitution. According to the NY Times, it was because SWFT executives were worried about the program’s legality and were discussing pulling out because of their concerns about legal and financial risks if the program were revealed, which is when the administration placed the first controls on the program, in 2003. Was it legal before that? Not known. The applicable laws, including the Right to Financial Privacy Act, have not been tested in national security cases.
