That level of desperation is terrifying. Perhaps it should be.

It’s truly remarkable at this stage to note that the single, overriding reason a Republican would offer to oppose any such nominee would be in a desperate effort to preserve a bad decision that is enormously unpopular with the overwhelming majority of Americans and American voters in the overwhelming majority of states, that strips more than half of our population of their most basic, fundamental, and intimate personal rights as citizens, and that has exacted and will continue to exact a terrible toll of misery and needless suffering on those citizen’s lives.
And not for nothing, it is a decision that has ruined and will continue to ruin Republican electoral prospects with those voters on a national basis and on a statewide basis in most states. As was already well understood for a long time leading up to it, Dobbs would be more than terrible law. It would destroy the Republican party, slowly but inexorably eroding voter support, as emboldened and ungoverned Republican state lawmakers competed with each other for the most extreme policy positions.
Sweeping out four of the nine for arrogantly refusing to abide by common ethical norms would do much to heal the institution’s growing legacy of corruption and illegitimacy. For any nine people to credibly wield so much sweeping power over 300 million other people, without ever having stood for election and approval by those people, must demand better than this. That the members themselves fail to see this and are unwilling to address it speaks volumes about the compelling need for a change. As a body they have lost perspective and any shred of respect for the people they serve. And it is the people they serve first, before the law. A reminder is in order.
Sadly, I’m quite confident the yearning for power and the instinct for individual self preservation will prevail over any concerns for the institution.

As we already know, the federal judicial branch has its own judicial ethics panel, overseen by the Chief Justice. All of these revelations have been brought to his attention. In the interests of institutional credibility, legal norms, and out of respect for the due process rights of all involved, that is naturally where any formal investigation and hearing process should begin. The Senate should stay the hell out for now.
But of course, Roberts, the weakest, most feckless and incompetent Chief Justice in the court’s entire two hundred year history, dithers. He mocks himself and the institution to which he has dedicated his career. At some point time will run out. And at that point the Senate would be entirely in the right, and it would be their duty, to initiate their own independent investigation and public hearing process. Being the Senate, there will be political considerations. And they would likely prefer to wait until after the 2024 election. But this cannot go on hoping it will be forgotten. Not when extremist, ultra MAGA Republicans in backward states are prosecuting women for needing health care. People will run out of patience for that shit long before they forget about this rampant corruption and arrogance.
The Senate will then have a duty to act. But until then they should stay out of it, and let Roberts continue to destroy the institution through his remarkable cowardice.
