Wednesday Open Thread

by Carl Ballard — Wednesday, 7/26/23, 8:24 am

Family stuff ahead, so who knows if I post even less frequently, more erratically. Annnyway.

I love taking the bus. Last night coming home from Drinking Liberally, it was the best! A group of 50 something women having a night on the town got on and were aggressively trying to flirt with the bus driver. “Oh he’s my favorite driver, he can take me anywhere.” Delightful.

Also, and this was 10:30, some teens hop on. Too much time in the summer, but good for them finding things to do. Being able to hang out. Taking the free for them bus Downtown.

Anyway, please wash your hands right now and get vaccinated or boosted if you’re eligible.

Makes total sense that a POS Biden felon would use a POS law firm in his defense. Lying POS.

The plea hearing for Hunter Biden started Wednesday without the judge getting into the allegations that a staffer at the firm representing the president’s son misled the court’s clerk office in an effort to get a court filing from a GOP lawmaker removed from the docket.

It is possible the matter will come up later in the hearing, but the proceedings started with the procedural maneuvers surrounding Biden’s plea.

The law firm staffer was accused Tuesday by court officials of misrepresenting herself as working with the lawyers for the GOP lawmaker, House Ways and Means chairman Jason Smith.

    Again, from CNN:

During the plea proceedings for Hunter Biden, US District Judge Maryellen Noreika, Justice Department attorneys and Biden’s lawyers expressed agreement that the judge did not have the power to order the prosecutors to “redo” the probe if she thought “the investigation was lacking.”

Attorneys for the Justice Department said that would need to be addressed “through the political process.”

How comforting to know that attorneys for Biden’s DOJ have said that Biden’s son’s investigation would be addressed “through the political process”. Nothing to see here, move along.

In vacating the ruling Judge Reggie Walton noted that the presiding judge applying for a position WITHIN the Trump administration at the time he was assigned to the Bergdahl case had an ethical obligation to disclose that clear conflict of interest and that act in itself calls his impartiality in sentencing into question.

So who is this current Judge Reggie Walton?

    Appointed: Ronald Reagan

    Elevated again: George W Bush
Assigned to the FISA court by no other greater judicial ethicist than Chief Justice John Roberts.

Doctor Dumbfuck, in his customary fashion, converts allegation to fact without proof. The CNN article he linked to @9 actually says:

“Hunter Biden’s legal team denied that they lied to court officials …. The dispute ‘appears to stem from an unfortunate and unintentional miscommunication between a staff member at our firm and employees of the Court,’ Biden’s lawyers wrote to Noreika …. Jessica Bengels, a staffer of the law firm representing Biden … said in a sworn affidavit that she never told anyone that she was working with attorneys representing the Republican House Ways and Means Chairman Jason Smith. … Bengels said she had two phone calls with two court clerks, and said ‘there may have been some confusion’ between the officials that led to a ‘mistaken understanding’ about her identity. According to earlier court filings, a court clerk said their office had been told by Bengels that she ‘worked with’ Kittila ….”

So, a court clerk said she heard Bengels said …

Which is plenty good enough for the dumbfuck. As for what actually happened, well, at this juncture we don’t actually know. From the CNN article linked @9 again:

“The plea hearing for Hunter Biden started Wednesday without the judge getting into the allegations that a staffer at the firm representing the president’s son misled the court’s clerk office ….”

It’s because of a Democrat congressman that the White House narrative on the discussions between First Vegetable Joe Biden and his POS son Hunter have shifted:

In an unexpected revelation, Rep. Daniel Goldman (D-NY) acknowledged that Hunter Biden, President Joe Biden’s son, had indeed discussed foreign business deals with the president. This admission stands in direct contradiction to President Biden’s consistent claims of non-involvement.

During a recent hearing, Goldman posed questions to IRS Agent Gary Shapely, seeking to refute a WhatsApp message from Hunter Biden to CEFC China Energy Co., which referenced demanding payment. At the same time, his father was present and implicated the President.

Goldman quoted a segment of the message, “‘I may be trying to start a company or try to do something with these guys.’” Goldman then questioned, “That doesn’t sound much like Joe Biden was involved in whatever Hunter Biden was doing with the CEFC — if Hunter Biden is telling him that he’s ‘trying’ to do business with them, does it?”

Shapely responded, “No, but it does show that he told his father he was trying to do business, and he was talking to his father about the business.”

Prosecutors said the agreements on the tax and gun charges were distinct — but during the hearing, Hunter Biden said he wouldn’t agree to plead guilty to the tax charges without the diversion program and dismissal of gun charges, according to NBC News reporters in the courtroom.

Here we have the POS son of the president refusing to plead guilty to what he has already admitted doing unless he gets a sweetheart deal that means no felony conviction and no jail time.

    genocide
    jĕn′ə-sīd″
    noun
The systematic and widespread extermination or attempted extermination of a national, racial, religious, or ethnic group.
The systematic killing of a racial or cultural group.

In many factors Florida is doing well, However,

A notable economic shortcoming in Florida are wages. Since DeSantis took office, Florida has trailed the nation as a whole in hourly earnings. Even adjusting for Florida’s lower tax burden, the state’s per capita disposable income — that is, its after-tax income per resident — trails the U.S. as a whole.

The average price of homeowner’s insurance in Florida is far higher than the national average.

Central Florida Tourism Oversight District approves of property tax cuts for Disney World.

Once thought of as the ideal place to live out one’s golden years, Florida is quickly losing favor with retirees. Remote workers and the wealthy are flocking to the state and driving up home prices, leaving those on a fixed income feeling the pinch.

Notice the greedy racist incel who wants have LGBTQ+ “eliminated” has NOT moved to Florida. He likes it just fine in liberal Washington.

Showing again how little you know about anything.

Alpha Phi Alpha convention 2023 is happening this coming weekend. Meaning right about now is the 2 year window to pull the plug WITHOUT penalty. Likely the contract was not even finalized. This is about the time that a convention center is sending the agreement to the organization to get a signature and request the deposit.

Maybe they’ll be able to get a Gem and Mineral show to take the place of the largest Black Fraternal Organization. Maybe make some calls and see if one of those “I’ll show you how to flip real estate for no money down” guys can fill 6,000 rooms. Dr. Arakake? Can you book one of your male aging options things here, PLEASE?

As noted by the timing of the announcement, any organization as large as Alphi Phi Alpha has already planned summer 2025 and is in the final stages of signing their deals. And there is no way Alphi Phi Alpha pulled the plug without identifying an alternative. Literally any non-conservative Christian organization planning NOW to go to Florida is getting push back from members and wondering if a 60-70% show rate is worth it.

If wishes and dreams of the Dumbfuck were actual dollars Florida is doing just fine with the empty hotels, documented construction slowdown, unpicked agrecultural crops….

I think there might be some unhappiness in certain circles if the J6 dudes got a deal like this:

    Sol Wisenberg
    @WisenbergSol
This just in: The judge won’t accept the proposed plea deal at least for now.
Some thoughts: Now we know why DOJ didn’t show us the plea agreement terms. What didn’t they want us to know ahead of time? A) a global immunity deal for Hunter; B) A binding plea (that is, the judge must accept the specific terms if she accepts the agreement); C) Misdemeanor probation; D) Other unusual plea terms.
    1. A global immunity deal for Hunter while the overall investigation is “ongoing”, is stunning—a super-sweetheart deal.
    2. A binding plea is extremely unusual in the vast majority of federal jurisdictions. It means for example, that if the agreement calls for probation the judge must give Hunter probation. It is binding.
    3. That the prosecution and defense would disagree about the terms of the agreement in open court is a joke. Ambiguous terms in a plea agreements are construed against the government! There should be no room for disagreement on the key terms of the agreement. So, this was either astounding incompetence or corruption on DOJ’s part. I think it is corruption. This looks like a wink and a nod deal (as
    @shipwreckedcrew
has noted) where DOJ would have plausible deniability if the judge asked no questions and accepted the deal. The scope of immunity is the most important feature of a plea deal. It is inconceivable that the prosecutors were incompetent here. Leo Wise has an excellent reputation for competence.
    4. Think about this. DOJ was about to sanction a plea deal where Hunter would get misdemeanor probation on serious tax charges plus pretrial diversion (no time served or criminal record) on the felony gun charge. Hunter would also get complete immunity on all other charges. And he would not have to cooperate with the government’s ongoing investigation. Totally disgraceful. Merrick Garland and David Weiss should be ashamed. And where is Lisa Monaco? Why hasn’t she been called to testify?

The California New Car Dealers Association (CNCDA) released its second quarter 2023 California Auto Outlook report, and it reveals record performance for Tesla.

Tesla has the two bestselling vehicles in California, and it’s not even close:

Tesla Model 3: 41,718 units year to date (through June 2023)
Tesla Model Y: 74,765 units year to date (through June 2023)
The next best are far behind: Toyota Camry with 27,169 units and Toyota RAV4 with 26,032 units.

Speaking of Toyota, it was dethroned by Tesla for the first time in California during the second quarter.

Tesla was the bestselling brand in California with just north of 69,000 units compared to Toyota’s 67,000 units:

When was the last hurricane to hit Washington state, I wonder? And the one before that?

Hurricanes could bring another disaster: Foreclosures

Roughly 4.8 million mortgaged properties were in the paths of Hurricanes Harvey, Irma, and Maria, representing nearly $746 billion in unpaid principal balances, according to financial data firm Black Knight. In September, the number of loans that were more than 30 days past due rose 48% in Irma-affected areas and 67% in Harvey-affected areas, Black Knight found.
    …
After Hurricane Sandy hit New York and New Jersey, homeowners still had trouble resuming payments once their forbearance period ended, according to a 2013 report by Legal Services NYC.

For many, months of postponed payments were suddenly due all at once after that grace period ended, creating an insurmountable burden.

The other problem: Mortgage servicers tend not to release insurance payments until homeowners have a contractor lined up to make repairs. That’s a daunting task at a time when construction companies have months-long waiting lists due to a surge in demand, and homeowners need money immediately in order to clean out their homes and avoid further damage.
    …
Meanwhile, Rosalez and her husband are living in a hotel, which the Federal Emergency Management Agency will stop paying for on Nov. 27. Her mortgage forbearance ends this month, too. So she’ll have to resume her monthly payments of $893, on top of everything else.

“We’ve had to spend money that we don’t have just to keep going every day,” says Rosalez, 60.

Having now read the transcript, and after so much breathless speculation from MAGA idiots, it’s now perfectly clear that this judge is fine with the terms included in the diversion and plea. But it’s also very clear that she had problems with how it was structured by the government, that the defense did not actually understand the implications of that structure to their client’s interests, and that she’s not at all interested in MAGA demands that she blow the deal up.

    Another day.

Another huge disappointment for TEAM DICK PICS.

I’d caution everyone that the Shit-lord Crybaby is unlikely to process this news as any kind of actual loss or disappointment. He’s a true degenerate gambler. So the fact that these events never represented what Tucker, or Bannon told him they represented is irrelevant.

For however long, as those slot machine jackpot wheels started settling into position in his fevered mind, it was all real enough. And for the degenerate gambler feeding off that rush, that’s more than enough. As with his long shot bet on Tesla last Christmas, a “near miss” pays almost as well as a direct hit. 126,

Not to belabor the point, but if a close relative of a president being paid for anything of dubious value is strong evidence of “bribery”, then it follows that a president himself being paid for things of dubious value is conclusive evidence of the same kind of “bribery”.

This whole line of reasoning backing Republican impeachment rests on a premise that is fundamentally inoperable.

    For them.

It argues therefore that Clarence Thomas may be impeached because his wife earns massive sums of income from work that amounts to little more than introducing people to her husband and his friends. And that’s not to even mention those friends buying his mother a house or paying for his child’s expensive private academy tuition.

I’m obviously choosing Thomas to make the point that offering the income of a close relative as the legal basis for impeachment lowers that bar to an elevation where few key Republicans can breathe safely or at all.

    It is not without consequences.

That’s not what is happening today, is it?

Rejected plea deal leaves Hunter Biden’s team fuming

Zoom in: Hours after the hearing, Biden’s team was still fuming, suggesting that Noreika seemed intent on not letting the plea agreement go forward after deliberately questioning lawyers on both sides about the terms of the deal.

But the judge’s questioning did reveal a disagreement over whether the agreement on the tax charges was linked to a gun charge against Biden. Prosecutors said it wasn’t; Biden’s team thought it was — and they repeatedly argued about it in open court.
Noreika frustrated those involved in the case when, after two hours of questioning, she said she wasn’t sure whether the structure of the proposed plea deal was constitutional.
One member of Biden’s team ruefully compared Noreika to Judge Lance Ito, who presided over the O.J. Simpson murder trial in 1995 and was widely criticized for letting it become chaotic.
Others were quick to note that Noreika was appointed to the bench by former President Trump, and suggested they’d have to take politics into consideration going forward.

As a consumer I am shocked, shocked to learn that range is not a guarantee no matter how much energy I waste through my driving habits.

    From the Tesla owners manual:

    Factors Affecting Energy Consumption
    While driving:

    Elevated driving speed.
Environmental conditions such as cold or hot weather and wind.
Using climate controls to heat or cool the cabin.
Uphill travel: Driving uphill requires more energy and depletes range at a faster rate. However, driving downhill allows your vehicle to regain a portion of its expended energy through regenerative braking (see Regenerative Braking).
Short trips or stop-and-go traffic: It takes energy to bring the cabin and Battery to a specified temperature when starting the vehicle. You may see a higher average consumption when the vehicle is used for very short trips or in heavy traffic.
    Heavy cargo load.
    Windows rolled down.
    Wheels and tires not maintained.
Customized settings or third-party accessories (roof or trunk racks, third-party wheels).
While parked and not plugged in to a charger:

Preconditioning the cabin or using climate controls.
    Summon.
Vehicle infotainment and climate controls system.
    Sentry mode.
Tesla or third-party mobile app requests.

We had a Nissan LEAF for a 2-year lease. I did far better than my wife did, in terms of energy usage. She was the primary driver, it didn’t work for her, and we returned the car 3 months early and paid off the balance of the lease. It wasn’t Nissan’s fault. It wasn’t our fault. I just regenerated more energy with my right foot than my wife did.

Multiple school staffers arrested for neglecting to report alleged sex assault at Palm Beach Central High School

A meeting reportedly took place on August 19, 2021, which is detailed in the report. During the meeting, which involved Assistant Principal Garcia, Garcia said they did not report the assault because they felt the victim would tell her parents and that the parents should be the ones to report it.

The report says one staff member claimed in that same meeting that he conducted his own investigation into the alleged assault and claimed he did not believe the assault occurred. Despite this, the boy allegedly involved in the assault would face disciplinary action such as the removal from school activities. When investigators asked why the boy was disciplined if the staff did not believe the assault took place, the staff member said he was “aware of how it looks.”

During this meeting, it was requested that the school report the sexual assault. The meeting ended around 9 a.m., but the report was not filed until after 5 p.m., nearly eight hours after the meeting and three days after the assault was first reported.

Yabbut it’s a first offense for all of these teachers union members, right?

Edgecomb was previously removed from the campus after he and former assistant principal Laurence Greenberg improperly changed students’ grades in 2019.

In a settlement with the state Education Department, Edgecomb agreed to a three-year probation which began in 2022. The settlement did not come with an admission or denial of guilt. As part of his probation, Edgecomb agreed to take a college level course on leadership.

Houchins, Garcia, and Snider had their bond set at $3,000, while Priscilla Carter and Principal Darren Edgecomb had their bonds set at $10,000 after the judge mentioned allegations that the pair made efforts to hide or downplay the incident.

The Justice Department has brought additional charges against former president Donald Trump alleging that Trump and two of his employees conspired to destroy Mar-a-Lago surveillance footage requested by federal authorities.

In the new superseding indictment, Carlos de Oliveira, a maintenance worker at Trump’s Mar-a-Lago resort, joins Trump and his aide Walt Nauta as a defendant in the case brought by the Justice Department in June. The new charges against the former president and his employees include “Corruptly Altering, Destroying, Mutilating or Concealing a Document, Record, or Other Object,” as well as “Altering, Destroying, Mutilating, or Concealing an Object.”

Prosecutors allege that on June 25, 2022, the day after investigators had requested “[a]ny and all surveillance records, videos, images, photographs and/or CCTV from internal cameras” at certain locations at the Mar-a-Lago Club, de Oliveira met with a Mar-a-Lago IT employee, allegedly at Nauta’s direction. De Oliveira allegedly told the employee something to the effect of “the boss” wanting the server containing the security footage “deleted.” The employee replied that he would need to reach out to his supervisor.

The indictment claims that de Oliveira spoke multiple times on the phone with Trump, including a conversation in which Trump promised he’d get de Oliveira an attorney.

    Did some looking.

However, in 2022, Edgecomb was disciplined by the state Education Department for changing the grades of several students without their teachers’ knowledge.

In 2010, when Edgecomb was the principal of Turning Points Academy near West Palm Beach, he was accused of punishing assistant principal Anne Williams Dorsey, who went on maternity leave, by demoting her and cutting her pay.

Turning Point Academy is not a single school. Rather, it is an educational movement that exists to glorify God and preserve the founding principles of the United States through influencing and inspiring the formation of the next generation.

The “flooded server room” accomplished nothing. The evidence was preserved despite the criminal effort to destroy it. The feds knew who erased the video and who ordered it all along. The subsequent false sworn statements serve to document criminal intent.

The reason why it is so important that rapacious billionaires, Republicans, and the financial media who serve them continue to concern-troll The Biden Economic Miracle is to keep the Supply-Side Myth alive long enough to make it to the next recession.

No other widely applied economic intervention has ever failed so miserably yet retained so much support. It is calculated to serve bankers and other makers of debt at the expense of every productive segment of a modern market economy. And it is far and away the best example of zero-sum in such economies. Market side economic interventions result in net gains. Supply-Side interventions consistently prove to drive poverty, narrow the middle class, and reduce general welfare in order to benefit a single class of owners and investors in a single industry.
