Matthew J. Kacsmaryk was born in 1977, graduated from Abilene Christian University summa cum laude in 1999, and from University of Texas Law School with honors in 2003. A bright and studious guy.
After law school he was a litigation associate at Baker Botts, a Houston-based law firm with over 700 lawyers representing corporate clients in the oil business among others. He stayed there 5 years, then was an assistant U.S. attorney prosecuting high-profile criminal and terrorism cases for 5 years.
In 2012, a year before leaving the U.S. attorney’s office to become deputy general counsel at a prominent Texas Christian conservative legal nonprofit where he defended discriminating against LGBQT people in employment and housing, he joined the Federalist Society.
He’s also a Catholic, and a member of the “Red Mass” committee of the local archdiocese. “Through prayerful petition and thanksgiving the Red Mass requests guidance from the Holy Spirit for all members of the legal profession.” That’s probably not quite as innocent as it sounds, given the Catholic Church’s position on abortion and … contraception.
Five years after joining the Federal Society (5 years seems to be a significant timeline in Kacsmaryk’s professional ascent), Trump nominated him to the federal bench. After being renominated, and voted out of committee by 11-10 vote, he was confirmed by the Senate by a 52-46 vote.
A Dallas independent media outlet described him as a “religious hardliner.” He’s a very smart one, which makes him dangerous.
This is who you’re dealing with. Every case filed in the Amarillo federal district court goes to him. No judge shopping required. And Kacsmaryk is not hesitant about issuing injunctions with nationwide reach. Sure, he may get overturned, but probably only at the Supreme Court, because his orders first go through the conservative-friendly Fifth Circuit which Trump stacked with extremist appellate judges. And that takes time.
Meanwhile, the United States is under one-man rule. By this man, in whose stiletto legal mind there’s no such thing as precedent or judicial overreach. So Amarillo is where the lawyers representing the religious right’s bigots will file their challenge to Obergefell.
