Roe v Wade is almost certainly going to be overturned. It’s awful. It’s going to mean a lot of women, trans men nonbinary people, and other people who can get pregnant are going to have much worse life outcomes. Including, but hardly limited to, dying in childbirth and raising unwanted children. Awful.
It will probably be state by state for a while. Here in Washington abortion will still be legal for now. Of course the people who spent the last several decades talking about states rights will try to take bans national.
Anyway, please wash your hands right now. And get vaccinated or boosted if you’re eligible.

There is very real risk that swimsuit inspection/book burning/$5 gas will be knocked out of the top three of voter concerns going into the midterm campaign season.
Not only is the risk that Republicans with a majority in Congress would use this decision to implement sweeping nationwide ultra-bans very real. It is purt near guaranteed at this point. Anyone claiming otherwise is either stupid or lying. Other worries about extending Alito’s reasoning to ban other human rights including marital choice and access to birth control medicine are speculative and would probably unfold only incrementally through a process of legal challenges.
But a nationwide ban enacted by Congress is the whole point of their struggle to game The Court for the last two decades. And they aren’t shy about saying so, either. And they’ve been proposing various versions of this nationwide abortion ban legislation regularly for years now whenever they’ve had a majority in either chamber. Right now that is the deal. Given the majority that’s what they intend to do.
And like Alito’s decision, such a ban would be wildly unpopular with voters. And by “wildly” I don’t just mean by that it would be extremely unpopular with some narrow but highly vocal and highly motivated minority of voters. I mean undeniably it would be unpopular and offensive to two thirds of voters. That’s a big fucking problem for Moscow Mitch, My Kevin, and every other “aggrieved” Trumpaloompa out there end-zone dancing in orgasmic delight right now.
Twenty four hours later Degen has calmed down enough and read enough tweets from Red State to have

Some time within the next 48 hours Degen is going to resume his relentless copy-pasta Firehose of Flasehood about bathroom rapes and economic doom-casting. And whenever their plans to ban abortion nationwide come up, he’ll turn back to speculating about The Mole Hunt, etc. It’s more than just abortion, of course. Right away it’s gender warfare targeting 51% of the electorate. It’s also generational warfare, in that women under 40 will be far more directly and meaningfully impacted by the GOP’s plans for them. And the gender politics will probably go badly for them. They always seem to. They are about to let their Wife-Beater Freak Flags fly just in time for Trump to get his Twitter account back.
So DO AS YOU”RE TOLD AND “STFU”.

I’ve commented on this before, and Wilson is quite right about it.
This process hearkens back of course to Andrew Breitbart and Roger Ailes before him. But it has mutated considerably away from how either of them conceived it.
The stimulation is addictive and self-reinforcing. But over time the “dose” required to obtain the “high” becomes greater and greater. A self-stimulating “conservative” like one of our trolls actively seeks out the stimulation. They look for something “outrageous” to trigger the reptilian brain. This is the “proof” they seek that not only confirms their biases but also provides them with the much needed rush of exhilarating, righteous “outrage”. They visit their carefully curated sources for “the good stuff”. And with the rise of modern, instantaneous, “hot take” media they get plenty of it. The supply is limitless.
But that supply also exists in a highly competitive ecosystem fighting second by second for eyeballs, clicks, dwell time, and click-throughs. As they gradually become desensitized the ecosystem supplying their stimulation is constantly adjusting the dose upwards in response. It’s Oxy-Contin for flaccid angry idiots.
Nearly every single one of Degen’s “Cosplaying Grandmothers” is a perfect case-study. It explains how some guy with a successful business maintaining and repairing Range Rovers for Napa wine makers one day finds himself building pipe-bombs in his shop late at night.
I’m a lot less impressed by Wilson’s analysis of Florida and the Democrat’s big failures there. He’s a communications guy. It is in his interest but also built into his DNA to believe deep down in his dark little heart that voters can be persuaded and that elections are won and lost using persuasion. He’s fairly old school in that sense. And I’m sure he knows the state much better than I do. But there are people who know it better than him and who are not burdened with his biases.
Florida Republicans practically built their entire state apparatus around turnout. And it has paid enormous dividends to them over the years. Florida Democrats are a good decade or more behind. The Florida GOP doesn’t just know their own voters, make sure they are registered, make sure they are registered absentee, make sure they fill out and sign their ballot, buy them stamps, drive them to the drop box, and then follow up religiously to cure every ballot every time. They also know the Democratic voters, probably better than the Florida Democratic Party. They know where they are, where they shop, where they work, etc. They challenge their registrations. They challenge their ballots. They robo-call them to send them to the wrong polling places. They robo-call them to misinform them about deadlines. The Florida GOP’s turnout game is across the board more thorough and more advanced than any other in existence and has been that way for at least twenty years.

It’s lawless in the extreme. But entirely unnecessary. There is absolutely nothing in Alito’s draft, joined by the other four, that requires any disagreement from state lawmakers who want to imprison pregnant women and execute them for murder/attempted murder.
What it illustrates, however, is how delegitimizing this is for The Court. The entire forty year project to politicize the court around this issue is delegitimizing. But ultimately, it is the tortured and flawed legal and textual reasoning that is most delegitimizing.
In hundreds, perhaps even thousands of cases over the last five decades litigating these “culture wars” grievances, courts have routinely dispensed absolute and utter garbage, consisting often of arguments so tortured and crippled with internal conflict and illogic as to be almost laughable if the consequences were not so dire. Lives ruined. While society is tasked with looking away to avoid the cognitive discomfort. It takes a toll on everyone concerned.

Bolstering healthcare to reduce the US’s abysmal maternal mortality rate

Better funding our foster care system to ensure among many other things that thousands of foster kids aging out of care do not end up homeless like they currently do

Extending child care tax credits

Steve spews:

What I say to Republicans like Rick, Cheney, Kinzinger and Jonah Goldberg and other Republicans who are taking a stand and are fighting to save our republic is this, “Your sins are forgiven. Go forth and sin no more.”
Elijah Dominic McDotcom spews:
Since passing the bounty law abortions in Texas have declined by 10%. Overturning Roe will have a greater effect. But best estimates, based on careful statistical modeling, are that in combination with existing trigger laws and new laws in states most likely to pass them, abortions will be reduced by between 16 and 18 percent in those states.
This will ultimately be deeply dissatisfying to guys like Degen and other superstitious womb-worshipers. Put simply, not enough “cunts and bitches” will be suffering. Too many will have easy access to pills-by-mail. Too many will gain free or reduced cost access to out-of-state services. The media probably won’t help. They’ll report on all that activity and they’ll do it in a way that is most “triggering” to these people.
So it’s very safe to assume that before too long, nearly all of the “reasonable” and “principled” opponents of reproductive rights you may be hearing from right now will feel compelled to extend and expand state interventions. It’s only a matter of time. The politics are what they are. They are rigid, inflexible, and based in moralizing zealotry. And the politics are fruitful for “conservatives”. It produces turnout, cash flow, and plenty of free media.
Louisiana’s murder statute is the future. Worse will follow. It is inevitable because of the people and the politics involved. We will watch them change in more or less precisely the same way we watched them change and radicalize under Trump. Things we thought to be ridiculous and unimaginable in 2016 came to be orthodoxies of the GOP. This won’t be any different.
Steve spews:

What it illustrates, however, is how delegitimizing this is for The Court. The entire forty year project to politicize the court around this issue is delegitimizing. But ultimately, it is the tortured and flawed legal and textual reasoning that is most delegitimizing.
Some examples of behavior that, apparently, do not delegitimize The Court:
• Packing it for partisan purposes.
• Accusing nominees you do not like of racism, bigotry, physical assaults, because you do not like them
• Pounding on the doors of the Supreme Court during protests because the Constitution is being followed on the other side of them.
• Issuing executive orders in direct contradiction to issued Supreme Court opinions.
• Lounging in a hammock in a Seattle high-rise while joking about the murder of two SCOTUS justices because a billionaire is paying you to embarrass him, too.
Elijah Dominic McDotcom spews:
The jurisprudence delivered from a court in the form of the arguments and reasoning described in its opinions is the source of true rule-of-law legitimacy and public support.
It’s perfectly understandable, however, that ignorant people steeped in superstitions and fears of invisible powers would instead come to rely upon ceremony, rhetoric, and “sacred traditions” to underpin their sense of institutional legitimacy.
• There is no “magical” correct number of members on a court
• Nominees to a permanent lifetime position on a court with universal and unlimited authority should be judged on their personal character, past associations, and past behavior.
• A legitimate institution enjoying public support can easily withstand criticism
• A legitimate co-equal institution enjoying broad public support can easily withstand challenges from another co-equal branch
• A legitimate institution enjoying broad public approval and invested with universal and unlimited power is hardly going to be threatened by a guy in a hammock

So let’s see what happens tomorrow.

@85 I still like my parsing better:
“Alito got his intellectual inspiration from a medieval English judge who hanged ‘witches,’ supported the death penalty for children, defended marital rape, and didn’t know where babies came from.”
A Huffington Post writer did a pretty decent job of taking down Alito here. As she pointed out,
“Alito repeatedly argued throughout the draft that Roe v. Wade was a mistake because, up until the 1973 ruling, banning abortion was simply the American way. … Alito is right: Abortion was widely banned throughout the centuries of U.S. history when women were legally regarded as second-class citizens, kept out of medical institutions and public office and banned from owning property. They didn’t gain the right to vote until 1920, and Black women faced barriers to voting until Congress passed the Voting Rights Act in 1965 ― just eight years before the court decided Roe. It wouldn’t be until after the Roe decision that all women in the U.S. gained the rights to apply for a credit card without a man’s permission, demand protection from being fired over a pregnancy, and sue workplace sexual harassers. Up until the 1990s, several states did not recognize marital rape as a crime.”
There will be many more parsings of Alito’s handiwork, none of them flattering. Even a cursory reading exposes it as work product that would embarrass a first-year student. The logical conclusion is that the task of burning down Roe was delegated to the least intelligent and articulate justice because Clarence Thomas was busy, Roberts wanted nothing to do with it, and the FNGs decided it was better to hang the mockery on the old guy who’s going to be dead soon anyway, whereas they still have the entire judicial lives in front of them.

Marital rape was not completely outlawed in the United States until 1993. Let that sink in. Hale’s Historia was being invoked in our American legal system all the way up until that point to justify rape by a husband. Alito is well aware of Hale’s lasting influence in our laws.
OMG!!! No wonder the repukes hated Clinton so much. The outlaw of marital rape correlated with the practical downfall of the Republic..

Anyone who uses that as an example of a “bear market” qualifies as a “bloviator.” And then attaching “cherry-picking” language to his bloviating is, you might say, the cherry on top.
Last Friday the DJIA dropped over 900 points, the S&P something closely equivalent. This Monday, the DJIA bounced back over 800 points, the S&P also. We’ve seen this movie repeatedly. A “correction” is not the major indexes spending one fucking day in what is technically and arbitrarily defined as “correction territory.” But if you want to believe that, and sell on the drops and buy on the bounces, I won’t stop you.

I’m going to be plain and say that, fundamentally I find this idiotic dick measuring by Degen and Roger demeaning to both of them, in the extreme. And that is why I decline to get into the middle of it, other than to mock Degen’s side of it.
But I’ve actually known and worked directly for more than a few “real millionaires”(+++). And while I can readily see that Degen is attempting a rhetorical flair here, I must also point out that only someone with at best a distant familiarity with the incredibly wealthy would not pull up short on this kind of statement.
Every single blazingly wealthy person I have ever had to directly serve (yes, that was absolutely the relationship) and come to know fairly well has been, not just greedy in the extreme, competitive to a fault about it, and entirely preoccupied with “how much” everything costs and “how much” everything is worth, but they have all to a one been exactly the kind of person who is keenly aware of and preoccupied by “a five figure movement in an account balance”. I could easily tell stories to illustrate the point. But why bother? All of it looks exhausting to me. And that is coming from somebody who works way too much and knows it.
Degen has undoubtedly done well enough with his financial situation to spend literally almost every hour of every day doing what we see him doing here. That’s nice. I guess.
Seems lonely and weird.
But also not very convincing that he knows much at all about extreme financial success. And as I’ve pointed out so many time before, for a guy who early on in life must have demonstrated an exceptional drive and discipline, to have chosen medicine for a professional career does not qualify him among that rare breed. Any plain idiot knows full well at the age of twenty that, while a person can be financially very well off being a doctor, that is not a path to fantastic, generational wealth. It’s much more often a path to alcoholism, depression, and family dissolution.
Not at all unlike lawyers, btw.

It seems ludicrous, but it’s clear that after the Supreme Court’s draft decision on Roe v. Justice Alito’s draft decision on Roe specifically referenced both Lawrence v. Texas, which legalized sodomy, and Obergefell v. Hodges, which legalized same-sex marriage, saying that “none of these rights has any claim to being deeply rooted in history.”
The Austin American-Statesman reports that Abbott on Wednesday said Texas “will resurrect” a 1982 Supreme Court case requiring states to provide free public education to all children, including the children of undocumented immigrants.

For the GOP, Version 2.0 is right here.
Even as far back as Newt Gingrich they’ve had it in their own power to turn back. They did not have to nominate Trump to defeat Clinton. They didn’t have to vote for him. Having done so they didn’t have to turn back to these long failed culture wars themes to sustain their support. And they did not have to openly declare war on 51% of all voters.
There’s nothing sacred about the Supreme Court. Its composition, funding, operations, administration, and procedures are all entirely subject to the laws of Congress. Its basis in the Constitution only requires that it exist, that its members can only be removed by impeachment, that they are paid, and the scope of jurisdiction.
Beyond those few minor constraints, the people’s elected representatives can change the court as often as they like however they like. Moving into that future the GOP will now be relying on the likes of Madison Cawthorn, Marjorie Taylor Greene, and this guy.
