Man, I don’t know if it’s just me getting older or something to do with the quarantine, but I am not sleeping well at all. I am still going to sleep and getting up at the same time as before. But now I am just exhausted all the time.

    Pike Brewing Co-Founder Rose Ann Finkel passed yesterday morning. For beer fans around here the Finkels are legends. Most of the first wave breweries here were founded by people who came through Pike including Elyssian, Big Time and Georgetown.

    The second wave led by people who came from those last three are too many to try to list off the top of my head.

    She was a lovely person who often manned the booth at beer festivals while most breweries send a sales rep or a server or two.

    I met the Finkels long before I lived here. They rode a tandem bike in two Tour De Pints events I did. They were heavily influential in the growth of the Seattle Slow Food organization. Just all around sweet people with so much passion for quality food and drink and history.

    Go order a XXXX Stout or pick up some Pike IPA. Farewell.

    These arguments they are making are not merely bad.
    They are fundamentally unrelated to contract law. And they seem to demand a massive departure from established First Amendment precedent. They can’t be serious. I can only assume that this is performative for political purposes. But it is also bound to be humiliating for DOJ.
    DOJ’s remedy lies in the contract. And the limitation on available remedy can also be found in the contract.

    The third parties in possession of the suspect information are entitled to exercise their First Amendment rights and publish it. They are not parties to Bolton’s contract with the govt. Bolton may not be entitled to profit from publication, since having breached his contract with the govt they are now entitled to those profits as compensation for the breach.

    Think of it this way: You, a degenerate Trumpalo, hire some asshole like Bolton to paint your house and you sign a contract with him and pay him a deposit. He takes your deposit and uses it to buy paint that he then applies to some other degenerate Trumpalo’s house. The other Trumpalo pays Bolton for the cool paint job (presumably orange).

    That was “your paint” you argue. And try to get a court to force the other degenerate Trumpalo to remove the freshly painted siding from their house and put it on yours. That’s more or less how batshit DOJ is on this.

    Bolton was not entitled to take your money and buy paint for some other customer. You can be made whole with a sum of money taken from the proceeds of the other degenerate Trumpalo paint job to refund your deposit and any other direct costs. It isn’t complicated.
