Watching the video with that CNN article, it appears — especially in slo-mo — that the teen with the knife pushed another girl against the side of a car and cocked her right arm holding the knife raised in a striking position, with the point of the knife aimed at the other girl, and then was shot. And it sure looks like if the cop had hesitated, the other girl would’ve taken a 5 or 6 inch blade in the armpit or ribcage. Whether the girl with the knife was just making a threatening motion with the knife, or would have stabbed the other girl, is the sort of judgment that a cop who has maybe 1/10th of 1 second to determine is probably going to make by erring on the side of interpreting the arm movement for what it looks like. I’m pretty sure this one will be ruled justified.
But obviously there are some larger issues that a conclusion as to on-scene justification doesn’t answer. We’ve been told the dead girl had a history, was in foster care, and under Children’s Services supervision. Should she have been in some other, more secure, setting? What was the history between the girls? Should they have been kept separated before this happened? Where there previous threats or fights between them? Ultimately, a caseworker’s job is to figure out a suitable placement, so I suspect the state likely ends up settling with the dead girl’s family.

The suggestion is that the time to close this distance by some imaginary model “perp” armed with a souvenir Swiss Army knife on a key chain in their pocket is the time to unholster their weapon, arm it, and fire.
The claim is that this is “science”. Tara won’t find any scientists to back it. Just more cops, gun lunatics, and murder-bots. Actual scientists have concluded that no such rule can ever be relied upon. They argue that specific circumstances are everything. And besides, and most importantly in our case cops have absolutely no need of any such rule.
The current, existing legal standard for a police officer’s use of lethal force has no need for any such specific distance. Why? Because the legal standard relies on the LE officer’s “reasonable belief” given the “totality of circumstances”. It is essentially acceptable for a police officer to shoot anyone at any time and for any reason so long as they can convince a reviewing authority that “the totality of circumstances” would lead a “reasonable officer” to have a credible belief that they were in danger. No tape measure required.
So why then do cops trot this out? Why do we hear this number from cops at all? After all, it goes against their interest. Talking about a “21 foot rule” weakens their claims any time they shoot a suspect from 22 feet. Which is a thing they do all the fucking time. Talking about a “21 foot rule” puts them on a back foot whenever they shoot a suspect who is seated in a car, which is a thing they do all the time. How about a suspect who is seated in the middle of a four lane intersection who is shot by a police officer from the cover of a vehicle parked 35 feet away?
Or an unarmed suspect who is following orders and crawling on his hands and knees in his underwear toward a covered officer aiming at him from thirty five feet away? Etc. There are simply too many to count. The mythical “21 foot rule” is useful to police for one reason and one reason only. And it has nothing to do with “self-defense”, at least not as a criminal defense.

A question here, though, is why didn’t the cop grab her knife arm and wrestle her away, instead of shooting her? Or, if he thought he was too far away and couldn’t reach her in time, why did he shoot her four times? And didn’t he endanger all the bystanders and witnesses milling around by firing repeatedly?

As much as I think of the outcome as a tragedy and excessive force, the victim shot by the police, without knowing all the circumstances (I don’t watch death videos) and whether she was defending herself from what may have occurred from the onset of the fight, is partly responsible for being in that circumstance.

Should the kid have appt counsel? Should counsel be able to hire experts to testify at trial? Should counsel be able to hire an independent psych eval?
There are states (courts, judges) that routinely railroad 14-year-olds in adult courts for adult crimes paying their appt counsel a flat fee, with no budget for adequate defense.
When all that goes wrong, at the end of that process, after years of sexual abuse, physical abuse, living on streets, eating out of garbage cans, beatings by police, beatings by parents and siblings, rapes, torture, starvation, and neglect, should the judge at sentencing be required to take any of that into consideration before imposing a sentence of death inside prison?

A CNN story tonight says the fight was between the victim and two former foster children who came over to wish the foster mom a happy birthday, and the fight was about housekeeping and criticizing a “dirty house.” Where the knife came from, it doesn’t say; I would guess the kitchen, it looks like a kitchen knife.

“How” a judge considers mitigation in youthful offender sentencing is maybe a few more steps down the road of progress from where we were before this ruling. But at least they could not skip it entirely. They had to at least provide some kind of formal hearing, even if it was merely pro forma. Now they don’t even have to do that.
As for your hypothetical of an adolescent youth offender engaging in a mass school killing, I’m aware of only about six such instances, and only two of them where the perpetrator survived to face trial and sentencing – both 15 at the time of the offenses. Both were tried as adults.
One, plead guilty in California in order to avoid trial. In March of 2004 following his 18th birthday he was transferred to Chino. His sentencing is currently under appeal to the 9th circuit. This ruling will represent a setback for him. Since in his 2002 original sentencing there was no formal consideration of his age at the time of the offense. However, he will at least be eligible for parole consideration in another fifteen years.
The other took place in Kentucky where state law forbids sentencing youth offenders in adult court to life without parole, and must be made eligible for parole consideration after 25 years.
And just to be clear, I’m not arguing for the Court to prohibit sentences of death in prison for youth offenders. Only that some formal consideration at sentencing of mitigation including age, and background is required by the due process clause and also by the 8th amendment before such a sentence is imposed.
That wouldn’t be the only benefit, if we had universal healthcare more people would retire early, opening up the doors for the employment of the younger hires and the unemployed, with a shift of employment. In addition, if people retired early maybe the pensions would see less blood.
