– You planning on going to the No Kings rally and march? June 14 starting at Cal Anderson Park and marching to Seattle Center. Also a rally at the UW, and many others across the state and county.

– With ICE raids announced, I’m glad the Ferguson administration is preparing for dealing with the Feds.

– King County has no confidence in John Arthur Wilson.

– I don’t trust any police chief, but if Shon Barnes does get arrested to protect my rights, that would be something.

– Good riddance to Larry Haskell. Hopefully Spokane can do better.

Interestingly, though, I haven’t heard of windows being broken or looting (although there’s been plenty of graffiti painting). And the most serious injury to date is an Australian reporter getting shot with a police non-lethal round.

    But this doesn’t address Trump deploying the National Guard when neither local law enforcement nor the governor thought it was necessary. Everyone understands this is another case of Trump abusing his authority and wasting millions of taxpayer dollars for the sake of political theater.

    President Trump’s approval rating dipped to … the lowest of his second term, according to the latest poll from Quinnipiac University.

    In the June poll, 38 percent of registered voters approved of the way Trump is doing his job, while 54 percent disapproved. The results mark the first time Trump’s numbers dipped below 40 percent since returning to office in January — when he enjoyed an all-time high job approval rating of 46 percent.

    In February, that number slumped to 45 percent; in March, to 42 percent; and in April, to 41 percent. Quinnipiac University did not release polling data in May.

    Immigration remains the president’s best issue, with 43 percent approval and 54 percent disapproval ratings. But the numbers have declined slightly from April, when 45 percent approved and 50 percent disapproved of his handling of immigration.

    The order stands on its merits, only paused pending a hearing. This is consistent with all court’s standard of maximal deference where “national security” and the president’s Article 2 authorities as “commander in chief” are invoked.

    Once again the DOJ shows up completely empty handed, unable to provide useful citations to the law supporting almost any of the claims they made in court (much less the ridiculous claims they make in the media). Breyer had little choice.

    And it’s time we began to consider if this is more than stupidity and incompetence on the part of the government. There are Article 2 authorities that can be interpreted in the unique way the government claims. There are interpretations of Title 10 that rely on more than twisted language. But they presented none. I don’t expect that to be the case in the hearing scheduled for Tuesday.

    It looks to me like the DOJ are using these pointless legal exercises to paint a certain picture for the gullible media and the public who barely pay any attention otherwise. The arguments that Rob Bonta’s office made are the ones that make the most sense given the history and the plain language of the laws.

    But there has been nothing offered yet to weigh against those arguments, at least not in any court of law. Just a lot of lying.

    Since it would be too much to ever ask our media to do it, I thought it would be useful for all to have a brief focus on the legal issues in Newsome v Trump.

    Fat Hitler’s memorandum federalizing the CA NG relies on Title 10 U.S.C. § 12406 which authorizes the President to federalize a state NG under certain statutory conditions. Whether or not the statutory conditions are met in this case is in dispute. The DOJ argues that the determination of the existence of those statutory conditions is unreviewable. There is Supreme Court precedent supporting this view (Martin v. Mott, 25 U.S. 19 (1827)).

    In addition there is a procedural requirement in Title 10 U.S.C. § 12406 that “Orders for these purposes shall be issued through the governors of the States … .” Governor Newsome argues that no such orders were conveyed through him or his office. He asserts that there was absolutely no consultation with respect to or in contemplation of federalizing his state’s National Guard from the President. He learned about it when the state’s Adjutant General cc’d him a copy of the order revoking his command of the California National Guard and transferring it to the Northern Command. The DoD orders revoking and transferring the command included the label in the title block “THROUGH: THE GOVERNOR OF CALIFORNIA” despite the Governor of California never having seen the orders or having any awareness of their existence prior to their being isssued and executed. There is a host of precedent in both statute and court decisions supporting the view that “through the Governor” requires the affirmative, active involvement of a state’s Governor before such orders have any legal authority. Furthermore, the relevant orders directed Whiskey Pete to coordinate with the Governor in the process of calling National Guard members to federal service. This was never done. Nor does Fat Hitler claim that it was. (Probably too drunk, and forgot)

    These issues may change, as conditions on the ground change. What the DoD orders troops to do and how they do it can and probably will implicate other statutes and authorities and the suit may be ammended further or granted further review based upon those changes.

    He could be right, if Republicans stay in power. They’ve always opposed the 16th amendment, but didn’t see repealing it as necessary. Instead, they came up with the so-called “Fair Tax” (which is anything but), which would replace the income tax with a national value-added tax equivalent to about a 30% federal sales tax. That being a tough political sell, however, they’re now willing to finance the federal government entirely with borrowing, making them the leading practitioners of Modern Monetary Theory.
