These races keep right on defying the polls. And the conventional sources of wisdom like Cook and Sabato, relying on polling, spending, and historical trends continue to get these races wrong. That’s signaling something about a big decline in GOP energy. But the other part is the big upswing in motivation among D-leaning voters and persuadable Indys.
Even holding the GOP to a few seat majority opens up a completely different world for the next two years. A retirement here, a gun cleaning accident there, and major House votes go the other way. A failure of that magnitude would almost certainly spell the end of McCarthy’s speakership and produce a power struggle within the GOP ranks. Whatever way such a power struggle is resolved, it will produce a huge delay of their agenda of fake HUHRDUHRHAMs and LOCKHERUPs. The results will be less effective and much more disorganized.
But keeping the House. I still can’t talk myself into believing it’s possible. But it would be a tremendous accomplishment for Americans opening up a huge opportunity to continue to produce the Biden agenda for all of us.

Nah. Not so much. Control of the Senate includes control over what bills may be introduced in the Senate. Not so in the House. Any House member may introduce a bill at any time, for any purpose by simply handing it to the Clerk of the House or, in the event the Clerk runs away, simply placing the bill into the hopper. In the Senate, because of course the Senate has lots or rules regarding “privileges” of members, it’s much more complicated.
A member must first gain recognition by the chair, which may be denied. And they may only seek recognition during the first hour of a session. Any member (gaining recognition from the Chair) may then immediately object, in which case the introduction of the bill must be postponed until the first hour of the following day. And after all that, the Senate majority can still just kill it in committee.
This isn’t to argue that it’s all smooth sailing in the House. Once assigned to a House committee a bill must survive sufficiently intact to emerge from committee for a vote on the floor. A determined majority can stop this by holding a bill in committee and refusing to schedule it for a vote. This is actually quite common for lots of bills.
But what happens to a bill that is very popular with voters and with the public? What happens when an determined House majority uses a committee to obstruct such a bill? In that case there are a few options unique to the House. But the one most available to a close minority would be the use of a discharge petition. In a discharge petition the minority needs to only carve off a small number from the majority to bring the bill out of committee and force a vote.
Why haven’t we seen this from Republicans recently? Mostly, because Republicans don’t actually support anything that is popular with voters, especially voters in swing states. So the kinds of bills they’d like to force out of a committee are simply not capable of bringing any pressure on moderate Democrats.
Now, would that also be true of a Democratic minority if Republicans succeed in gaining a narrow majority next year?
Game it out. A bill ensuring access to all legal forms of birth control. Can Democrats pressure three or four swing state Republicans to support a discharge petition? You bet! Especially since this imaginary Republican majority will be presided over by fucked up, crazy, strident Trumpist lunatics who will have staged a revolt against so-called “moderate” Republicans.
If Republicans gain a six seat majority next year all Biden and Democrats in Congress really need to do is stick to legislation that is popular in swing states and they can force a bunch of terrible votes on freaks like Elise Stefanik. Everything else Biden just does using EOs and rule making wherever he can. The result will be Biden and Democrats getting shit done, while Trump, and Louie Gohmert threaten mob violence and Cathy McMorris Rodgers squirms and offers excuses.

It hasn’t been brought up yet by DOJ because they are not trying a criminal case in the media, but rather they are investigating a criminal case in the real world, and simultaneously responding to an incompetent lawsuit by a team of idiots before a bad judge. The venue for jurisdiction for a federal criminal search warrant is the district in which the warrant is to be served. That’s why DOJ was initially in SDFL
However, Judge Cannon’s order is in response to a lawsuit filed (eventually after some prolonged struggle to spell their own names correctly) against the DOJ (and a couple of other parties) by the named plaintiff Fuckface Von Clownstick in the SDFL challenging that search warrant, seeking the return of items recovered in the execution of the search warrant, and raising a great big shit ton of other, almost entirely irrelevant issues, some of which are both premature and moved in the wrong jurisdiction. The question of any “executive privilege” claims against NARA would be one such issue.
So DOJ was focusing their response in the SDFL on the issues raised in Trump’s steaming pile of a filing that were relevant to that court’s jurisdiction over the search warrant and their handling of the materials recovered in the search. Cannon is making lots of glaring mistakes here in her order. Extending her jurisdiction over the National Archives and Records Administration located in Washington DC is just one of many.
It’s mostly prudent to assume that a federal district court judge understands that their jurisdiction is limited to matters and parties in their own district. And it’s normally safe to assume that a plaintiff who files a suit that fails to even assert the jurisdiction will get tossed. In his initial filings Trump failed to follow rule 8(a)(1) (or any other part of rule 8) and provide a statement of jurisdiction. Trump’s delayed response to the prolonged do-over order was a limited statement that failed to address all the complex and overlapping claims in his complaint. Judge Cannon appears to have taken it upon herself to address all of the deficiencies in Trump’s final filing by including these missing elements in her final order. But in her apparent zeal to be of assistance to the plaintiff she got ahead of herself.
The problem here then is not that DOJ failed to respond to the plaintiff, but that there was nothing for them to respond to. The plaintiff never made any statement of jurisdiction with regard to their complaints about NARA. Moreover, in nearly any other instance if you tried to sue an agency of the federal government exclusively located in the DC district by filing your suit in Columbia Missouri it is normally ignored. This actually happens all the fucking time. Right now some QAnon MAGA Republican is undoubtedly filing just such a lawsuit challenging President Joe Biden in the Utah district for hiding a space laser behind the moon. Somewhere else a prisoner is suing Pete Buttigieg in the middle district of Alabama because a train whistle keeps him awake at night. The clerk responds with a friendly note. And that’s the end of it. If agencies had to respond to every single one of these things the government would grind completely to a halt.
I can only assume that the DOJ was initially as shocked and appalled by this order as nearly everyone else. I’m sure they are studying it very carefully and finding every single issue available for challenge. My best guess is that they’ll move forward on several fronts simultaneously to obtain relief from the order on multiple grounds and in multiple jurisdictions. I hope that seeking a change of venue with regard to Trump’s complaints about NARA would be part of that, since failing to do so would produce a terrible precedent.
And as usual Degen is completely wrong. If Trump wants to sue NARA he needs to file in the DCDC.

We will be looking at a shrinking workforce for the foreseeable future. If we wish to maintain domestic economic growth we have to increase worker productivity. DOJ appeal to Cannon is wise, measured, and sensible. There is no credible claim of any kind from any private party over documents that have been officially classified and labeled as such. They cannot fall under executive privilege ever. Nor can they have anything at all to do with attorney client privilege. Beyond those two relevant forms of privilege there are the concerns that Cannon expressed in her order about protection of Trump’s reputation. Those documents can have no relevancy to those concerns.
The limited stay of her order should be granted.
She’s a fool if she denies it. It’s going to bring all of her other conduct surrounding this into sharp relief and turn members of the 11th against her. And it addresses the very powerful legal interest that the government has in avoiding further exposure of those classified materials. Because her order is overly broad in this way, on appeal a stay is likely to be granted on that issue alone.
It also tells us something about what DOJ believes it has. It indicates that just with those 100 or so officially classified and marked documents they have the criminal evidence they need to continue from here in pressing forward with additional subpoenas, search warrants, and indictments. And it also indicates that they are probably intending to do some of that inside the sixty day window. I don’t see why not. Trump is not a candidate for any office, nor are any of these other assholes.

But while I always had grave doubts, around about the time Degen declared it was his political judgement that Dobbs would have no impact on the midterms, I concluded that his prolonged capture within Teh Orange Even Horizon has now completely deprived him of practical or even intelligible insight into any politics but pure MAGA. Predicting that the MAL search warrant would help get Trump reelected was bouncing the rubble.
Degen isn’t alone here. And that’s fantastic news for midterm Democratic campaigns, far too many of which are not aggressively raising either Dobbs or the profound reasons why Republicans are no longer fit for office. It’s just lucky for them that their opponents are unable to steer themselves around those rakes but keep right on stomping on them, especially whenever a camera or microphone is available.
To wit I offer you Degen’s own comments herein. He gives us a minor Nevada county elected Democratic official whose duties primarily involve settling property estates in the county, who works in a cubicle, and whose name is not on any ballot this November as his example of unfitness for public office.
And we are supposed to weigh this against a countless number of Republican nominees for Congress and their state’s highest offices who regularly share tips on their social media about the best ways to drink their own pee, burn crosses, and bash cop’s heads in with fire extinguishers.

Along with their motion to Cannon for partial stay DOJ as filed their Notice of Appeal. Simultaneously the ODNI has informed the court that it has suspended its risk assessment of the exposed materials citing the uncertainty surrounding the court’s order.
One effect of this will probably be to suspend the appointment of a Special Master. Whether Cannon grants the limited stay or not (she ought to if she isn’t a fool) the grant of privilege and the involvement of a Special Master is mooted for the time being. The only question that remains before Cannon is whether or not the DOJ can continue to move forward limiting their criminal inquiries into only the documents that are officially classified and marked as such. If Cannon denies the limited stay then presumably DOJ will move for immediate relief in the 11th.
As far as Canon goes and how this makes her look, etc. it’s up to her. If she grants the limited stay the DOJ goes on their merry way cleaning up the criminal mess left behind by Trump and his clown car. DOJ’s appeal of the rest of her order is calendared and taken up at some point in the future. The most glaring national security defects of the overly broad order are cured by the limited stay. And the questions about “privilege” and the use of a civil suit to stay a criminal investigation are left for another day.
If she denies the stay, then DOJ moves forward with a motion pending appeal for an emergency stay out of the 11th. ODNI chimes in to brief the circuit that national security remains compromised until they can move forward with a risk assessment. And DOJ briefs the circuit that an active criminal conspiracy involving obstruction is allowed to continue unimpeded by legitimate law enforcement. That motion has a very good chance of success. The briefs to the circuit will make Cannon look very, very bad.
It’s her call. As I’ve mentioned, she’s only 41. She’s going to be there for decades.

Just look at it. Degen’s interpretation of the DOJ motion for stay asks us to believe that they are engaged in a conspiracy to make Trump look like a crook. You know. The guy who stole classified documents, then lied to the government and obstructed their lawful investigation for more than eighteen months. As if after all that Trump needs any help.
Beyond Teh Orange Event Horizon where Degen is now permanently trapped, this motion to allow DOJ to continue it’s investigation of the limited set of documents is supposed to be another FALSE FLAG operation whose only intent is to color our view of Trump. If somebody really, really neeeeeeds to find a way to believe that nothing bad or criminal took place here, I guess this is where they find that.
The alternative is to consider the very limited amount of what we actually do know about this investigation, as opposed to pretending that LIZARD PEOPLE have burrowed into the administrative state to serve ADRENOCHROME to wealthy global elites. Trump had a some substantial number of highly classified secret documents in boxes and files in his office and in basement rooms in MAL. He had them there since he left office in January of 2021. At that time, acting through his custodian of records, he lied to the National Archives and Records Administration about his retention of these and other documents. After more than a year of negotiations Trump returned some documents. Included among that set were materials bearing markings and labels indicating the highest levels of secret classification. NARA informed DOJ and left it to them. Starting in March DOJ began obtaining and serving subpoenas for any remaining documents. Trump’s lawyers responded to those subpoenas with false statements. In June prior to obtaining the search warrant DOJ’s top officials in counterintel served one final set of subpoenas, briefed Trump’s staff about their criminal investigation and the potential criminal status of refusing to comply with the subpoenas, and obtained sworn statements containing material falsehoods relevant to the investigation. Citing these and other evidence DOJ then obtained a search warrant. The search warrant produced thousand of additional documents responsive to the earlier subpoenas, including hundreds of documents and empty folders containing markings for the highest levels of secret classification.
Given all that, true believer that he is, Degen has told himself that it’s all just FAKE NEWS created by politically vindictive career bureaucrats seeking to smear Trump.
