In a further desperate effort to stem the tsunami of lost advertising revenues Team Elon has cooked up another stupid Twitter scheme.
This time it involves compelling users to opt-in to share sensitive personal location data in real time to better micro-target advertising.
As you’ll recall, Team Elon’s first scheme involved selling premium subscriptions for $8. It started out at something more like $10, which might even have been a good idea. But nowhere near enough people would take the deal. So they cut it to $8. Problem is that Twitter was already making somewhere between $10 and $15 per month in advertising revenues for each free account. So at $8 if a premium account was ad-free the company would actually lose money. So in dropping to $8 they also plugged back in ads – only promising “fewer” ads. But with no real information on what that would mean.
So now with user pops falling along with monthly ad placement space and advertisers fleeing, the company is looking at ways to enhance rates (or at least slow the free-fall). Better targeting with more invasive data mining is certainly one way to offer that.
Twitter’s solution: require users to opt in to personalized ads and share their location information, or risk losing access to the service. The company is developing plans to prompt existing users to opt in to personalized ads and will make it the default for new users, according to plans shared with Platformer.
But there are problems with this. Biggest and most immediate is probably that the plan as outlined would be a clear violation of binding consent decrees that Twitter has agreed to as part of data privacy breach and antitrust litigation it lost earlier this year.
I’m the last guy to suggest that @jack had his shit together or was running Twitter toward a bright and successful future.
But he was doing a better job than this.
And probably part of how he managed to do that was by partnering with some talented and loyal employees, vendors, and consultants to help navigate and maintain a very large and complicated machine.

A few things confound this analysis.
One is the change in workforce participation over the period.

Removing so much income at the higher income levels from taxation does nothing to stimulate economic activity beyond yacht building, lavish “not-for-profit” galas that net less than 1% of what they spend, and tasteless custom jewelry.
And these are not things that contribute to the long term well being of a society or improve its capacity to produce. The portion of economic growth that has been systematically concentrated among the top 99.99th percentile of incomes and that has been removed from taxation is diverted almost entirely into non-productive uses that contribute nothing to society.

The video shared does not show any illegal conduct on the part of the individual being filmed.
The act of sharing that video, and accusing the person of criminal acts, though it also may not be illegal, could very easily establish grounds for a civil suit in the state of California.
As the individual being filmed and identified with his license plate is not a public figure, Mr. Musk has an absolute legal duty to be sure that any potentially defamatory public statements he makes about said individual are true to best extent of his knowledge. There is nothing illegal per se about following other people in public in a car. There is nothing illegal per se about filming people, including minor children, in public places for any non-commercial, or otherwise lawful purpose.
Obviously California has had a lengthy history of effort to establish protections for film and entertainment industry celebrities being followed and photographed by freelance photojournalists. The state probably has some of the most protective laws in the U.S. Nevertheless, the Supreme Court has consistently upheld the First Amendment right to film in public and reiterated the principle in the law that no person has any reasonable expectation of privacy in a public place.
646.9 PC states:
(a)Any person who willfully, maliciously, and repeatedly follows or willfully and maliciously harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety, or the safety of his or her immediate family is guilty of the crime of stalking, punishable by imprisonment in a county jail for not more than one year, or by a fine of not more than one thousand dollars ($1,000), or by both that fine and imprisonment, or by imprisonment in the state prison.
The statute goes on to clarify:
(e)For the purposes of this section, harasses means engages in a knowing and willful course of conduct directed at a specific person that seriously alarms, annoys, torments, or terrorizes the person, and that serves no legitimate purpose.
(f)For the purposes of this section, course of conduct means two or more acts occurring over a period of time, however short, evidencing a continuity of purpose. Constitutionally protected activity is not included within the meaning of course of conduct.
(g)For the purposes of this section, credible threat means a verbal or written threat, including that performed through the use of an electronic communication device, or a threat implied by a pattern of conduct or a combination of verbal, written, or electronically communicated statements and conduct, made with the intent to place the person that is the target of the threat in reasonable fear for his or her safety or the safety of his or her family, and made with the apparent ability to carry out the threat so as to cause the person who is the target of the threat to reasonably fear for his or her safety or the safety of his or her family. It is not necessary to prove that the defendant had the intent to actually carry out the threat. The present incarceration of a person making the threat shall not be a bar to prosecution under this section. Constitutionally protected activity is not included within the meaning of credible threat.
As the statute is a pains to point out, repeatedly, constitutionally protected activity is not included within the meaning of any of the prohibited activity described. If the individual appearing in Mr. Musk’s video was in fact following him or his family members in public, that activity alone is not sufficient to satisfy the requirements of the criminal law in California. If the purpose of following was in order to observe or video record Mr. Musk or his family in public places that is a Constitutionally protected activity, and is therefor also not included in the statute as prohibited criminal conduct. No threat is evidenced in the video, other than a possible threat toward the individual being identified by Mr. Musk by the person filming.
Mr. Musk needs to pray either that his efforts to identify this individual are unsuccessful, or that additional conclusive evidence can become available to him very soon establishing criminal stalking conduct on the part of this person. It is California after all. There is a Michael Avenati under every rock you turn over. And only a small percentage of them are dumb enough to try to shake down Nike.
I would further add that by repeating the charge of stalking in published form, this phenomenally stupid troll enjoys some of the same legal risks as Musk, only without anything like his financial or legal resources. Something else to celebrate this Christmas!

As far as I know, Troyer still has an anti-harassment order against him for stalking the ***black*** newspaper carrier after the original incident. My assumption is the judge who declared him a “danger to the community” will now discharge his $100,000 bail bond, because that was based on the charges of which he was just acquitted. I might be mistaken. The bail was imposed after he repeatedly violated the anti-harassment order, so maybe it’ll remain in place. As far as I know, though, he hasn’t been criminally charged for stalking, even though he may deserve to be. If he is, he could hire Bremner again; she’d probably take that case because he’s been a good customer of her law practice.
Yet to come is the ***black*** newspaper carrier’s $5 million civil trial against Pierce County. Although Troyer’s excellent lawyer, Anne Bremner, successfully shifted blame for the massive police response to a non-existent threat to the 911 dispatcher, that strategy won’t get the county off because the county is liable for the dispatcher also.
Presumably Bremner won’t be representing the county in the tort case.
