In the 29 page ruling issued yesterday by the 11th Circuit, the panel found unanimously that so long as the documents in question bore proper marks identifying them as being classified, then the DOJ has met the statutory requirements set forth in 18 U.S.C. § 793 establishing that a crime was committed.
Here, perhaps unlike many others, I don’t rush immediately to the conclusion that Trump is fucked. The DOJ has established to the satisfaction of an appellate panel of “Trump” judges that the espionage act has been violated in this case. But no individual has been indicted. And no defense of the charge has been mounted, other than Trump’s wasteful and discrediting self-destructive lawsuit. This finding by the panel does, however, confirm for us some things we may have previously speculated about.
This is a very serious felony criminal investigation.
The criminal investigation is a lot farther along than initially suspected.
“The documents at issue contain information ‘the unauthorized disclosure of which reasonably could be expected to cause exceptionally grave damage to the national security.”
With respect to any espionage act charges concerning those marked documents, challenges to the warrant and motions to exclude are likely to be completely fruitless.
The DOJ prosecutors already know all of this, even if thanks to the circuit court the rest of us (including Trumpland) are just figuring it out.
The thrust of the criminal investigation at this stage will be to determine which individuals had specific, knowing “possession of, access to, control over, or (were) entrusted with” those marked documents,
and…
“willfully retain(ed) the same and fail(ed) to deliver (them) on demand”.
That’s going to include some people who’ve been on television in the last two weeks talking shit out of their pie holes. Whether or not that includes Trump may depend entirely upon how willing those fucksticks are to take a charge and do time for the boss.

It should be clear at this point to anyone who is not a groveling partisan to Trump that the DOJ proceeded very slowly, deliberately, and forgivingly with respect to the strong evidence already in their possession that Trump had retained marked documents. They very painstakingly went through a series of steps designed to allow Trump, his lawyers, and his custodians of documents to produce the marked materials that were later recovered in the search. They held meetings at which they briefed the Klown Kar real estate lawyers about the relevant federal criminal statutes, highlighting the important passages just like I have, and just like the 11th Circuit panel has. They invited the lawyers and custodians to make additional searches and gave them months to conduct those searches. They issued multiple subpoenas over many months ordering the return of the marked documents. With each subpoena they reminded Trump and his lawyers that the law made it a felony to retain these very documents after receiving such a subpoena. They even had Trump’s lawyers sign statements attesting that they had read and understood all of it.
The crime being mentioned here in the 29 page decision from the 11th involves the willful retention and failure to deliver.
And there’s a good reason for that. Charging people who are authorized to have such documents with “mishandling” is not actually easy to do. Reading 18 U.S.C. § 793 (c) should make that somewhat obvious. For one thing it’s got a complex and difficult intent requirement.
…for the purpose of obtaining information respecting the national defense with intent or reason to believe that the information is to be used to the injury of the United States, or to the advantage of any foreign nation…
An intent requirement like that one is actually much easier when the accused is not authorized to possess the material. That’s a good starting point for establishing the intent. Other evidence regarding the methods used by the unauthorized person to obtain possession of the material, and conceal that illegal possession also provide good circumstantial evidence. But even then, such individuals are seldom charged under this statute unless they duplicate it in violation of (b) or transfer the material in violation of paragraph (e).
But when the person in possession of the material is authorized to possess it, the intent with respect to copying, transferring, or mishandling is very tough to meet and is liable to all sorts of effective criminal defenses.
Bratt’s job is to secure this material and that’s what he was trying to do. I see no evidence at all that he was seeking with prejudice to build a criminal trap for these stupid assholes. If anything it’s the opposite. Over the course of six months he provided them with a series of escape hatches and begged them to take the outs. But given his job and its requirements he also knows that paragraph (d) is the criminal statute that gives him the authority and the leverage to make anyone the president designates return classified material or face going to jail for refusing to do so. For six months they willfully and intentionally refused to return the classified material.

I was a participant in the First Gulf War, and, while we in the military were very successful at defeating Saddam Hussein’s forces, the whole thing was a tremendous mistake.
We became involved in saving an Islamic monarchy for the glory of George Bush the First and his friends in the Saudi Royal Family. That’s not what a representative democracy like ours does. The better course of action would been to quietly meet with the Iraqi government to tell them we would not become involved in their Kuwait invasion if Iraq agreed to two terms. First, stay out of Saudi Arabia and limit your territorial conquest to Kuwait alone. Second, keep Iran in check as a way of insuring non-intervention against them on the part of the US and other Western powers.
These two simple ideas would have dramatically (and for the better) altered the course of world history. Had we never become involved in the First Gulf Misadventure, Iraq and Afghanistan would not have disintegrated into an international basket cases, Iran would have been kept busy with Iraq as its main enemy (and not the US) and there would have been no 9/11 attack on the United States by bat-shit crazy Islamic extremists.
It’s hard to believe, but the people who did the 9/11 Job actually were seeking revenge on the Western infidels for daring to tread on “holy” Islamic ground, i.e., Saudi Arabia. Does anyone not think the attack on the Maine battleship wasn’t an inside job? It was staged to allow us to have an excuse to invade Caribbean lands to expand an American Business/Government Empire.
The Spanish-American War set the stage for later horrible presidents getting the US into asinine situations. Woodrow Wilson, a disgusting president, engineered the US into World War I after making campaign promises to keep us out of war in Europe. He knew the Lusitania was going to be attacked by the German Kaiser’s U-boats, and he let it happen because he wanted to put America in the middle of international disasters to boost his ego.
Then, FDR used Pearl Harbor as an excuse to get us into World War II. He and his incompetent economic policies did nothing but prolong the Great Depression, and he couldn’t figure out a way to end it without taking the country’s attention away from his failed economic policies.
And don’t forget about Lying Lyndon Johnson and his redneck persona producing the Gulf of Tonkin Lie to justify stepping into the Vietnam quagmire, and Nixon continued the same stupid policies. George W. Bush used the “weapons of mass destruction” lie and the 9/11 revenge attack against the US to justify a twenty-year international disaster that he, Obama, Trump and finally Biden have turned into a clusterfuck of epic proportions.
It’s past time for the United States to unwind all overseas military involvement. Close all 900+ overseas bases and return the troops to defending the US, not the rest of the world. Anchorage area – we had to use our Alaska Airlines 2021 companion ticket and decided in December to book a trip here.
