Washington State refuses to enforce the car insurance laws. They let uninsured drivers drive right away when caught. Watched it with my own eyes after he totalled my car and MY insurance had to pay and I ate a deductible until it was recovered.

Muzzle loading long rifles were the standard rifle of the times (when the Constitution was composed). My reading is that the founders encouraged citizens to own rifles so that if the country needed defending, they could call up a large, armed citizenry — after which the “regulating” would commence.

Your argument about the Kentucky long rifles only works if you also limit First Amendment rights to presses in use in the eighteenth century, and to religions that existed in the eighteenth century.
No television, radio or internet publisher would be covered, and no currently operating newspaper would be covered either.
With the various divisions, mergers, revelations, and so on, I’m not even going to try to tackle which religions would be covered.
The Bush administration would like that, but the courts have ruled otherwise long ago.
Of course, this leaves us with the situation that the Constitution clearly gives ordinary citizens the right to own and maintain any weapon used by the military.
While I’m something of a Constitutional purist, even I consider that to be an unacceptable situation. Hence the kludge of gun control laws that appear to be unconstitutional on their face, but are so necessary to the public good that the courts invent some rather twisted reasoning as to how regulating and restricting a citizen’s right to own and carry a weapon is not infringing on that citizen’s right to bear arms.

Any clear reading of the Second Amendment allows citizens to keep and bear any weapon that the military currently uses.
Any rational person (which eliminates most of the NRA) understands that in a time when one properly armed soldier can easily wipe out a small town, or even a large city, this is simply not an acceptable answer.
Any reasonably intelligent politician knows that any attempt to change the Second Amendment is political suicide.
Welcome to the situation as it currently exists.
So the courts will continue to find ways to ignore both the clear language and stated intent of the folks that drafted the Second Amendment, and we’ll keep having fights with people that (in many cases) honestly believe that their rights as defined by the Constitution are being violated.
I just want to own guns and have them available to me, and I don’t care what you all think of that.

In answer to your question, please read the original post. A properly armed individual soldier can wipe out a major city. The Second Amendment, together with an understanding of the intent of the framers of the Constitution, clearly allows any citizen to own and maintain any weapon available to the military.
Yes, I realize exactly what I’m saying there, and also realize that the situation described is clearly unacceptable. Hence we have judges that have properly decided that survival of humanity is more important than strictly following the Constitution.
Even though the Second Amendment clearly allows you to keep a nuke in your home, (purely for protection of your family, of course) it’s still not going to be allowed. Constitutional purist that I am, I’m ok with that answer. The founding fathers never envisioned a time when one person could wipe out a major city.
Please understand that in these posts, I’m not advocating for or against personal ownership of weapons. I’m simply trying to cut through some of the BS that the gun control advocates keep spewing.
Frankly, I feel that if the gun control advocates would clearly state the full ramifications of the Second Amendment as it is currently written, that most people would find them unacceptable, and we could then have an actual debate as to what controls are acceptable, and then enact them Constitutionally.
But to say that any clear reading of the Second Amendment allows the State to regulate handguns, rifles or similar firearms simply infuriates and entrenches people who, quite rightly, see these rights as protected by the Constitution, and see the arguments as being thinly veiled attempts to violate their Constitutional rights.
No wonder we can’t find some common ground for reasonable dialog.
Read the debate and discussion among the founding fathers. They disliked and distrusted standing armies, and it was their clear intent that the armed citizenry should be able to defeat the federal military, should the central government ever get out of control.
In a time when the weapons available to both sides were limited to individual violence, this was a reasonable answer. One of the founding fathers’ few failures of vision was that they did not conceive of, nor plan for a time when weapons would be as destructive as they have become. Hence, they did not exclude weapons of mass destruction from the “arms” that citizens had a right to “keep and bear”.
Had they the slightest inkling of the destructive power of today’s weapons, my suspicion is that they would have forbidden the central government from ever having them as well.

No arguement from me that much of our laws and iconic symbols are borrowed for Europe, and particularly England. Many of the principles of our Constitutional Law can be traced to the Magna Carta Libertatum (Great Charter of Freedom).
