On the other hand, Sanders has always been a notorious whack-job, so I gotta think the Times editorial board might not have found itself in this unusual and embarrassing situation if it had only based its original endorsement on the candidates’ legal qualifications rather than Sanders’ reliable record of writing anti-government, anti-labor, pro-business opinions.

Thing that bugs me about this is as I recall the original story was written some days after the event and it sounded as if it was based on hearsay. More details are needed and the blanks need to be filled in.
In my opinion this story was bad reporting.
First the Seattle Times blocks me from making comments in their comment sections because I dare ask Seattle blacks how electing Democrat mayors for half a century is working out for them, now they are unendorsing Justice Sanders for speaking the truth about blacks and their propensity to commit crimes.

I’ve met Sanders and talked with him, and have a mixed opinion about him. First of all, many years ago, he represented a client in a case in which I was the judge and did what I thought was a really crappy representation job.
Sanders is a very smart guy and I get a kick out of discussing constitutional law issues with him, even when I disagree with him. His IQ and legal knowledge are not issues for me. But he has a big mouth and has done things that arguably are ethically borderline for a sitting justice. and I’ve always felt undercomfortable about his willingness to use judicial office as a “bully pulpit” for his political views.
But Sanders is not a bought-and-paid-for shill for the BIAW or anyone else — least of all the BIAW. No one owns him. He does his own thinking and is a truly independent justice.
Sanders is not Republican or conservative, he’s libertarian, and makes no bones about it. He is the court’s most ardent defender of individual liberties and the Bill of Rights, often taking the defendant’s side in criminal cases where overreaching by the police is at issue. He believes in limited government and restraints on government power, and is not one of those righties who wants to blur or erase the line between church and state. I sleep better at night with someone like that on the court. I’ve never had any reason (at least before now) to consider him a racist, and unless he has changed recently, I honestly don’t think he is. I do feel that way about Jim “Indian Hater” Johnson, who was Slade Gorton’s hatchet man in the tribal fishing wars (in which Gorton, as state attorney general, pandered to redneck voters by adopting a blatantly anti-Indian litigation policy).
I’ve voted for Sanders, with reservations, a couple of times because his challengers were nonentities I couldn’t vote for. I feel Sanders is basically qualified to be a state supreme court justice, in terms of intellectual ability, and that he is not a harmful ideologue in the way that Jim Johnson is. But give me a good candidate to replace him, and I’ll vote him off the court. Wiggins is such a candidate, so Sanders won’t be getting my vote this time.
What’s said, though, is Jim Johnson is running unopposed for reelection to the court. Johnson is an odious presence on the court, and getting him off the court is far more imperative than replacing Sanders. Sanders I can live with. Johnson is a racist ideologue who is owned lock-stock-and-barrel by BIAW and the so-called “property rights” movement. The best thing you can say about Johnson is that he has only one of nine votes on the court, so he can’t do too much damage by himself.

Just wondering about judicial ethical behavior. Would the fact that a sitting Justice’s wife founded a think tank and writes opinion papers declaring certain issues that will come before her husband “unconstitutional” prior to judicial review be enough to require the justice to recuse himself?

I concur with Rabbit above. Sanders is okay. Wiggins, however, could be a true superstar on the Court. Our Court has lacked such a star since the days of Robert Utter.
