The senate’s judiciary committee just voted seven to one for a bill that would provide legal immunity to those who call medics for someone overdosing on drugs. The bill is designed to encourage folks, who are afraid of getting busted, to call for help instead of abandoning an overdosing person to die. Drug overdoses killed 700 people in Washington in 2006. […] Only state senator Pam Roach (R-31) voted against the bill.
Which is ironic, considering that Roach is also the only state senator on the committee with a child who has been caught on videotape snorting oxycontin, and subsequently convicted on a felony drug offense. Go figure.

I hate to admit it, but I had similar questions as Troll did in # 4. How broad is the grant of immunity? Is it limited to the phone call, or anything observed by police or paramedics during the call, or could it provide a basis for arguing that any subsequent arrests derived from information learned during that call?
On the other hand, it’s better than (a) having the person’s friends abandon him/her while they are in distress, or (b) having them drop them off at the door of the emergency room, without staying around long enough to tell emergency room doctors information they need to know (type of drug, amoung ingested, etc.).

@4: Dear Moron troll – let me explain. If you are OD’ed on heroin you would not be calling anyone. You would be undergoing respiratory depression and would be out cold. Eventually, you would stop breathing. Without immediate medical help you would die.
The most common example of this is when a heroin addict who has quit takes one more hit at their old dose – and does not realize that they have lost the downregulation (tolerance) to the old dose. This old dose is now deadly. Another time this happens is when an adict is sold some new “stuff” and it is much more potent than the old stuff. In either case, it is accidental. Once the heroin is injected – it is too late to do anything excpet go to the emergency room and get assisted oxygen if there is respiratory depression. In most cases the victim would be “out” – the law is designed so that other people will not leave someone to die for fear of the law.
It makes sense for saving lives. It doesn’t have to be heroin – any drug that has CNS depressive effects would do – there is the case of a teenager (from Washington) left to die becuase her friends were too scared to call the police. She was not on heroin.

Let’s take this a step at a time.
First, it’s heroin, you dope.
Second, if you were not caught selling, you won’t be arrested, tried of convicted “for being a heroin dealer” under any circumstances.
Third, any heroin found in your house in the course of receiving medical attention can, and will in all likelihood, be seized. While it’s not specified in the bill whether the paramedics may be interviewed and their impressions used to constitute probable cause for a later search warrant, the fact that this goes unmentioned says to me that they can.
Fourth, it looks as though an incident of providing medical care that results in a seizure of heroin under this bill will NOT be allowed to generate a charge of what is commonly referred to as “possession with intent to sell.” However, if you have a major operation going, as I mentioned, they’re sure as hell not blocked from coming back after you. They’ll just need evidence that does not stem from the incident.
