No public servant can substitute his/her personal beliefs for what the law says. Nothing in the Constitution says “God’s authority” is higher than the law of the land. The Cheneys understand the chaos that would ensue if elected officials or government employees could ignore laws at their choosing.

    This subject can get a little confusing, because public officials do have a great deal of discretionary authority over some things, for example, a prosecutor’s authority to charge or prosecute a crime. But the issuance of marriage licenses is what the law calls a “ministerial act,” which means there’s no decision for the county clerk to make that involves discretionary use of judgment. Registering voters is a ministerial act; if an applicant for voter registration satisfies the legal requirements to vote, the elections official has to issue the registration.

    As I’ve said before, Kim Davis may think she’s like the Minuteman standing his ground on the Concord Bridge, but in reality she’s more like George Wallace standing in the schoolhouse door, defying the law because she disagrees with the law. President Eisenhower sent troops, and the federal judge that Davis has to face tomorrow, although he lacks the power to remove her from office, will use the judiciary’s traditional contempt sanctions to compel Davis to comply with the law, as he should. Anyone who thinks this woman is some kind of hero is essentially an anarchist.

    My personal belief or opinion, even as a gay person, is I don’t really care if she doesn’t want to issue a marriage license to a gay couple. And maybe I am giving in too much, and I’m sure it would be like opening Pandora’s Box, but really, so long as their is someone else in her office that is capable of doing their job and issuing a license, I don’t care if she got her way. I think if the American taxpayers want to put up with someone and pay for someone that isn’t going to do their job, and have to incur more costs to employee a second person to that persons job, then so be it…..but someone at that Clerk’s office needs to be able to issue a license if a gay couple wants one.

    But I’m sure the whole point of this is not that woman’s religious freedom, I’m sure the radicals are looking at this more as a way to stop or overcome the Supreme Court ruling that they don’t like.     Some time ago, an idiot troll, who has since disappeared and whose screen name I no longer remember, laughed at me for arguing that it’s easy to make 8% a year in the stock market.

    The significance of the 8% figure is that it’s commonly used by pension funds as a target for investment returns. The context of our dispute in the HA comment threads was whether pension funds are underfunded. As you know, conservatives, having won their war against unions, are now waging war against workers’ pensions, especially the pensions of public sector workers.

    Now, I have statistical evidence from an independent news source. A CNBC article published today says, “Market performance in the last six years has been rather extraordinary; the S&P 500 has risen an average of 17 percent a year. And in the very long run (going back to 1928) stocks have risen more than 11 percent in the average year, according to data from NYU finance professor Aswath Damodaran.”

    Of course, that’s not the entire story. There’s an issue of whether these returns will slow down in the future. But asking that question doesn’t make it a fact. Truth is, no one knows what the future holds. Logic argues that a weaker economy with slower growth implies lower investment returns in the future. But even that isn’t necessarily true. Corporate profits, and investors’ returns, have soared recently despite the sluggish economy and falling wages. It’s perfectly possible for investors to profit from workers’ poverty, simply by taking from labor and giving to capital, and that’s exactly what’s happening in our economy.

    I don’t know if stock investors will be able to make 8% a year in the future. All I can say for sure is that it’s been easy to do for the last 87 years, and I’ve been doing it ever since I began investing in stocks 33 years ago. It’s the stock market, not my puny state salary, that briefly made me a millionaire earlier this summer, although I’m temporarily not a millionaire anymore, due to the market’s current buying opportunity. (Which doesn’t bother me a bit, because given a choice, I’d much rather buy cheaper stocks than stare at a meaningless paper net worth number.)

    @50 Kentucky law requires the county clerk’s signature on marriage licenses, regardless of whether the clerk or an employee issues the license. One of the arguments her lawyers made in court today was there are alternatives to forcing her to sign same-sex marriage licenses against her religious beliefs, two of which are (1) to have the state instead of counties issue marriage licenses, or (2) redesign the form so county clerks don’t have to personally sign them. But under current law, she can’t get out of signing the marriage licenses she objects to, except by refusing to issue the licenses.

Inasmuch as she refused either (a) or (b), the judge acted legally and appropriately by imposing (c). The judge doesn’t have authority to remove her from office.

    A new development in the case: Five of the six deputy clerks have agreed to issue same-sex marriage licenses (Davis’ son was the only holdout), and the judge has agreed to release Davis from jail this afternoon if she agrees not to interfere.

    Davis’ lawyers argued the deputy clerks can’t issue licenses against her authority, but the judge rejected that argument and ruled they can. The judge also said, “”The legislative and executive branches do have the ability to make changes [in Kentucky’s marriage license laws]. It’s not this court’s job to make changes. I don’t write law.”

    The judge has provided Davis with an easy out. She doesn’t have to issue same-sex marriage licenses, or sign them, all she has to do is allow one or more of her employees to do so. That means she’s not required to do anything against her personal beliefs, and there’s no conflict between her religious liberty and same-sex couples’ right to a marriage license in Rowan County.

    If Davis continues to obstruct the issuance of those marriage licenses, it’s for political reasons, not any religious objection.

    Low wages is the main reason U.S. labor participation is so low. In a free society that doesn’t have legal slavery, people won’t work without at least minimal incentive. And while U.S. wages are declining across the board, the biggest declines have been in low-wage occupations such as home health care, retail, and restaurants.

    (Contrary to Bickle’s whining about “restaurants closing,” restaurant owners are among the employers who have benefited most from lower labor costs; so why would they close their restaurants?)

    Statistics show the biggest drop in labor participation is in the prime working age group — i.e., workers aged 25-54, especially males. Why are these workers dropping out of an improving economy with increased hiring? Because the incentives to work are too weak to attract them into the labor force, that’s why.

    Keep in mind that $7.25/hr. is gross pay, not what a worker takes home. By the time you factor in the costs of working, some workers actually lose money by working for that wage rate. They’re money ahead to stay home, so that’s what they do.

    The problem isn’t productivity. Data show the economy has made solid productivity gains since 2000. No, the problem is greedy employers and executives who have kept all those gains for themselves, and shorted their workers who actually produce that wealth. You can succeed at beating down wages, as the last 35 years of Reagan economic policies demonstrate, but at some point people won’t work because it doesn’t pay to work. That point has been reached.

    The biggest pay deficit is at the bottom of the wage scale, so America obviously needs drastic increases to the minimum wage. Not just in a few cities here and there, but across the board, nationwide. If we don’t do that, we’re not going to get these millions of dropouts back into the workforce, and America’s long-term productivity, growth, and GDP will suffer.
