I really like that Seattle is always changing. Like, you can definitely complain about Amazon and expensive housing. But there isn’t a mythical time when Seattle was better. There are real problems to fix, but I am glad that we’re doing it in a city with a $15 minimum wage, and a growing public transportation system.

Anyway, please wash your hands right now, and get vaccinated if you haven’t yet.

    Support for #BLM. This is a piece in the NYT.

    The reason for the drop seems to be shifting attitudes among Republicans and white Americans, two large and often overlapping groups.

    After Mr. Floyd’s death, Republicans reported much stronger support for Black Lives Matter than they had earlier in 2020. For a party often characterized by its racial insensitivity and antagonism toward racial minorities, this increase in support was striking. But perhaps even more striking is its rapid decline.

    Well, yes. White conservatives soured on #BLM, particularly when it became very apparent that, once again, Democrats were using black people as a political weapon, and black people, once again, let it happen because they thought they’d get something out of it.

    Democrats also exhibit higher, and relatively stable, support for B.L.M. Perhaps this helps us understand why every Democratic presidential candidate stressed the importance of racial justice while campaigning.

    Not exactly. If you look at this image from the piece (Democrats in grey, GOP in pink), you’ll see that prior to George Floyd’s killing the GOP actually had a higher net support of #BLM than did Democrats. That’s because of assholes like Robinhood Dumbfuck Rabbit, who claim to be liberals but deep-down don’t support a movement that props up one group at the expense of all others. If you look at the spike in Democrat net support for #BLM right after George Floyd’s death, that’s not really support. That’s opportunism.

    And if you look at net Democrat support now, it’s on the decline, too. By about one-third. So far.

    Just wait until after the 2022 mid-terms, when both black people and the Democrat party realize that #BLM has become a huge negative.

    There’s one more chart in the piece. Check it out. #BLM net support is falling among black people. They know they got took. Again.

And the investigation will be handed over to the DOJ. Where Republicans will be prevented from even calling for briefings by the DAG.

    Based on what’s been released from seal this morning by Judge Amy Berman Jackson, it would appear that Paul Manafort can be charged and tried for other crimes not covered by his pardon.
    Included in that would be perjury and Sec. 1001 violations detailed in newly unredacted portions of Mueller report.

    Manafort violated his earlier cooperation agreement when he conspired with Kilimnik to obstruct and then lied about it to investigators. So there’s nothing preventing DOJ from filing and prosecuting aggressively.

    A portion of a memo cited as a reason not to pursue obstruction of justice charges against former President Donald Trump was released Monday night, but the Justice Department said it is appealing a judge’s order to release the rest of it.

    William Barr, then the attorney general, cited the memo, written by the department’s Office of Legal Counsel, as one reason he did not intend to pursue obstruction charges after he received the report of special counsel Robert Mueller, who investigated interference in the 2016 presidential election and other matters.

    The Office of Legal Counsel didn’t think charges against Trump were appropriate. From the memo:

    “Over the course of the Special Counsel’s investigation, we have previously discussed these issues within the Department among ourselves, with the Deputy Attorney General, and with you since your appointment, as well as with the Special Counsel and his staff. Our conclusions are the product of those discussions, as well as our review of the Report,” the lawyers wrote in the newly public section.

    For decades, Justice Department policy has held that sitting presidents could not be charged with a crime. But the memo went beyond that constitutional position, arguing “certain of the conduct examined by the Special Counsel could not, as a matter of law, support an obstruction charge under the circumstances. Accordingly, were there no constitutional barrier, we would recommend, under the Principles of Federal Prosecution, that you decline to commence such a prosecution.”

    It might be more painful to you, Steve, if you imagine this being stated in front of all the cameras by James Comey in mid-2016, using the words “no reasonable prosecutor”.

    Let’s recap: The DOJ under former AG Barr is caught having lied to the court. CREW sued for release of the Barr memo. Crew argued that “prosecutorial discretion” would not apply because Barr was not deciding whether or not to charge – policy says he can’t. Barr opposed. As part of his opposition Barr claimed that he was not making a charging decision, but that he was making a determination about whether the underlying conduct was chargeable – so discretion and therefor confidential. Berman examined the record, including all the filings and declared BULLSHIT. The previous filings state unreservedly that Barr was making a charging decision. Garland also however has requested that ABJ release the rest of the memo and accompanying opinion awaiting further proceedings on the part including Barr’s decision. The memo isn’t damaging to Trump. The memo is damaging to Barr. But also potentially to DOJ. They have a real interest in not disclosing the deliberations surrounding charging decisions. But it’s telling that Garland is agreeing with CREW on all the rest. And is agreeing to let CREW and ABJ continue to make further motions for the rest of the memo. They want it out. But they want it out in a way that preserves their normal right to confidentiality in charging. And not for nothing, that does not implicate DOJ in any future decision to charge… somebody with obstruction… named oh, I dunno, Barr?

    I think the bottom line comes down to this: an individual exercise of discretion is not binding precedent, but an appellate court decision from a judge may be.

    There is value in having ABJ issue a ruling on exactly what kinds of deliberations are “pre-decisional” and therefore not entitled to any deliberative process privilege, and what kinds are “decisional” and therefore protected from FOIA. Either Barr was not engaging in a decisional process (because of OLC policy) or he was but neither Barr nor the OLC ever had any authority to engage in that decision making process. Getting that on record as part of a ruling is also binding and has value. If an agent is restricted by policy from engaging in a decisional process then any deliberations they engage in are not entitled to the deliberative privilege protection. If an agent has no legal authority to make a decision then it may be held that agent’s deliberations may not be “decisional and must be disclosed.

    This of course can even be extended beyond DOJ potentially. But the important point here is that where DOJ is concerned, they can’t pretend that “the law” prohibits them from engaging in such protected deliberations while simultaneously asserting that when they do engage in them they are protected by privilege. That conflict is what necessitated the lying in the first place. It’s what pissed of ABJ. And it’s why people ought to look forward to a binding decision on the appeal.

    If Garland were to merely order the Deputy Assistant AG to decline to appeal the order and release all the memos it would have no authority over any future administration or department. And it would do nothing to clarify more precisely where DOJ deliberations are protected by privilege.
    The last thing in the world this represents is Garland agreeing with Barr. About anything.
