And then, with Powell’s encouragement, he proceeded to make filings that contained false statements. Cooperation agreements like these are solemn agreements made with the court. Guilty pleas, allocutions, affidavits, and motions are sworn statements to the court. Lying to the court, and cheating the court are precisely the kinds of things that get you jail time when you would not otherwise.
