Please remind yourself right now, that your qualified retirement plan is shielded from capital gains taxes, and so is the appreciation in value in your primary residence if you own it. So we are really talking about billionaire families. According to the Tax Policy Center, fully 80 percent of the benefit of the special rates accrues to the highest-income 1 percent of Americans—those with incomes of more than $819,000. Fifty-eight percent of the benefit accrues to the highest-income 0.1 percent of Americans—those with incomes over $3.45 million. The average annual tax savings for these individuals is $825,000.
Right now, when you hear Sen. Joe Manchin arguing to “take a pause” on the reconciliation budget, you need to think about all this. His hesitancy has nothing whatsoever to do with the spending side of the bill. It’s the pay fors. And it’s this pay for in particular. Because right now he’s being lobbied by his old colleague Heidi Heitkamp, who now runs a multi-billion dollar dark money super-fund specifically aimed at protecting these billionaire family tax breaks.
She is hired by these secret, anonymous billionaire families for this one purpose. They hired her because she has direct, immediate access to Joe Manchin. And they hired her to scuttle the single greatest progressive budget achievement in modern history. And this is why we, as Democrats, can all say “good riddance” to her. And depending on how he goes forward on the bill, why we can also say “good riddance” to Manchin if he does as the secret, anonymous billionaire families are demanding of him.
If Democrats are not successful at shutting down this back door in the Senate it will be the end and Republicans will win back the House and Senate, Trump will return to the White House in 2025, and America will begin an irreversible death slide toward fascist authoritarian party rule.

Ask yourself, how would those five “conservative” Justices have decided an identical case from a state like California it had passed a law empowering citizens to sue individually over gun ownership, sales, or promotion?
Now shuttup. Because nobody believes you. Nor do they believe Thomas, Alito, Gorsuch, Kavanaugh, or Coney Barrett. And that’s the problem.
Roberts tried repeatedly to broker a compromise on this and those five told him to fuck off. I don’t personally think he’s going to give up any time soon. For the reasons stated above, it would be abandoning what he sees as his role as C.J. But that will depend an awful lot on how things unfold. And it seems very clear now that how things will unfold will be a total shitshow. And that may answer your stupid question more definitively.

The Texas bounty law seeks to bypass that, by creating a framework for individual citizens to bring civil suit against anyone performing, obtaining, or assisting with an abortion outside the statutory six week limit, but still well within the protected timeframe of Roe. Since state actors are not directly involved in burdening the right, the argument is that Roe does not apply.
Again, this means that any similar statutory scheme could be employed in any other state to bypass any other precedent. So Heller would not apply either.
It raises several very significant and fairly novel constitutional questions having nothing at all to do with either Roe or Heller.
Are state courts, obligated to enforce any judgements in these lawsuits, serving as state actors?
Are sweeping, universal indemnities against civil procedural rules consistent with due process?
Can a state legislature assign plaintiff jurisdiction beyond state borders?
And all or nearly all of these potential deficiencies are at the heart of the shitshow. Because I’m not exaggerating. There is really nothing in this Texas law that would dissuade me from naming every single registered Republican voter in Texas as a defendant in a lawsuit brought under this statute. The Republican legislature and governor have granted me that right. And they even went out of their way to make it fairly risk free, inexpensive, and easy to do.
They have essentially transformed their own state court system into a playground for vexatious Shitlords. And this is entirely of a piece with every single other remarkably stupid bit of performative self-harm you and your fellow “conservatives” have been engaged in since you nominated Trump. Of course there will be collateral damage to pregnant teens and Texas “Leftists”. But in the end, aside from the predictable boycotts and economic harms, Texas will have deprived itself of a functioning civil court system.

But that was before.
It’s obviously a short-term big blow for supporters of both reproductive rights and rule of law. And it certainly signals a real and very immediate intent among The Five to fuck around with Roe in the upcoming term.
But all of that comes with significant baggage, both political and judicial. Trump and Trumpism are harming the long term political and legal interests of “conservatism”. Insofar as Abbott’s Bounty Law exemplifies Trumpism, it probably does so as well. “Conservative” hopes for suppressing turnout next year are probably gone. The Five hacking away at the foundational and deliberative middle of The Court may force the CJ to move to a more politically ideological outlook. And there’s no guarantee that outlook will favor “conservatives”. Plenty of other examples exist.
None of this is guaranteed. Nothing is. But as an exemplar of a long term political trend within “conservatism” the prospects are not promising. Past performance may be no guarantee of future outcomes. But they are highly predictive. Trumpism worked out well politically one time, over four years ago. Trumpism worked out exceptionally well three times. But each of those three successes depended upon unpredictable, black swan moments. There’s nothing particularly predictable in any of them. Other than that it’s been an unbroken record of failure and decline.
But along the way voters have become conditioned to predict a whole lot of future outcomes where Trumpism is concerned. Voters now know that a Republican House majority will impeach a Democratic President. They know that a Republican Senate will never convict a Republican President no matter what. They know Republicans will restrict voting. They know that a Republican majority will invest greater authority with little or no accountability to the constitution in violent law enforcement at every level. They know that Republicans work work to weaken and delegitimize federal courts and rule of law. They know that Republicans will try to outlaw all forms of reproductive freedom. They know Republicans will cut vital social spending programs and give tax cuts exclusively to giant corporations and very wealthy families. They know Republicans will engage global partners and opponents with equal belligerence, increasing global security tensions and heightening the chances of military conflict. And they know that Republicans will attempt to pack the federal courts with idealogues determined to impose a minority political agenda.
It’s not a point of credible debate that most Americans oppose all of these things. Just a question of how much they care.

Fifty-eight percent of the benefit accrues to the highest-income 0.1 percent of Americans—those with incomes over $3.45 million. The average annual tax savings for these individuals is $825,000.
Right now, when you hear Sen. Joe Manchin arguing to “take a pause” on the reconciliation budget, you need to think about all this. His hesitancy has nothing whatsoever to do with the spending side of the bill. It’s the pay fors. And it’s this pay for in particular. Because right now he’s being lobbied by his old colleague Heidi Heitkamp, who now runs a multi-billion dollar dark money super-fund specifically aimed at protecting these billionaire family tax breaks.
She is hired by these secret, anonymous billionaire families for this one purpose. They hired her because she has direct, immediate access to Joe Manchin. And they hired her to scuttle the single greatest progressive budget achievement in modern history. And this is why we, as Democrats, can all say “good riddance” to her. And depending on how he goes forward on the bill, why we can also say “good riddance” to Manchin if he does as the secret, anonymous billionaire families are demanding of him.
If Democrats are not successful at shutting down this back door in the Senate it will be the end and Republicans will win back the House and Senate, Trump will return to the White House in 2025, and America will begin an irreversible death slide toward fascist authoritarian party rule.

The Texas bounty law seeks to bypass that, by creating a framework for individual citizens to bring civil suit against anyone performing, obtaining, or assisting with an abortion outside the statutory six week limit, but still well within the protected timeframe of Roe. Since state actors are not directly involved in burdening the right, the argument is that Roe does not apply.
Again, this means that any similar statutory scheme could be employed in any other state to bypass any other precedent. So Heller would not apply either.
It raises several very significant and fairly novel constitutional questions having nothing at all to do with either Roe or Heller.
Are state courts, obligated to enforce any judgements in these lawsuits, serving as state actors?
Are sweeping, universal indemnities against civil procedural rules consistent with due process?
Can a state legislature assign plaintiff jurisdiction beyond state borders?
And all or nearly all of these potential deficiencies are at the heart of the shitshow. Because I’m not exaggerating. There is really nothing in this Texas law that would dissuade me from naming every single registered Republican voter in Texas as a defendant in a lawsuit brought under this statute. The Republican legislature and governor have granted me that right. And they even went out of their way to make it fairly risk free, inexpensive, and easy to do.
They have essentially transformed their own state court system into a playground for vexatious Shitlords. And this is entirely of a piece with every single other remarkably stupid bit of performative self-harm you and your fellow “conservatives” have been engaged in since you nominated Trump. Of course there will be collateral damage to pregnant teens and Texas “Leftists”. But in the end, aside from the predictable boycotts and economic harms, Texas will have deprived itself of a functioning civil court system.

It’s obviously a short-term big blow for supporters of both reproductive rights and rule of law. And it certainly signals a real and very immediate intent among The Five to fuck around with Roe in the upcoming term.
But all of that comes with significant baggage, both political and judicial. Trump and Trumpism are harming the long term political and legal interests of “conservatism”. Insofar as Abbott’s Bounty Law exemplifies Trumpism, it probably does so as well. “Conservative” hopes for suppressing turnout next year are probably gone. The Five hacking away at the foundational and deliberative middle of The Court may force the CJ to move to a more politically ideological outlook. And there’s no guarantee that outlook will favor “conservatives”. Plenty of other examples exist.
None of this is guaranteed. Nothing is. But as an exemplar of a long term political trend within “conservatism” the prospects are not promising. Past performance may be no guarantee of future outcomes. But they are highly predictive. Trumpism worked out well politically one time, over four years ago. Trumpism worked out exceptionally well three times. But each of those three successes depended upon unpredictable, black swan moments. There’s nothing particularly predictable in any of them. Other than that it’s been an unbroken record of failure and decline.
But along the way voters have become conditioned to predict a whole lot of future outcomes where Trumpism is concerned. Voters now know that a Republican House majority will impeach a Democratic President. They know that a Republican Senate will never convict a Republican President no matter what. They know Republicans will restrict voting. They know that a Republican majority will invest greater authority with little or no accountability to the constitution in violent law enforcement at every level. They know that Republicans work work to weaken and delegitimize federal courts and rule of law. They know that Republicans will try to outlaw all forms of reproductive freedom. They know Republicans will cut vital social spending programs and give tax cuts exclusively to giant corporations and very wealthy families. They know Republicans will engage global partners and opponents with equal belligerence, increasing global security tensions and heightening the chances of military conflict. And they know that Republicans will attempt to pack the federal courts with idealogues determined to impose a minority political agenda.
It’s not a point of credible debate that most Americans oppose all of these things. Just a question of how much they care.

Gee, who would’ve guessed MPD cops might be mistaken for white supremacists? I’m thinking possibly just about everybody.
But the main moral of this story seems to be that if you pretend you’re not a cop, juries won’t convict citizens for defending themselves when they think you’re something else.
Oh, and not to be overlooked: “There have been numerous complaints and lawsuits filed by innocent bystanders who were struck and in some cases blinded by police munitions during the protests.”

I remember when he wanted Bowie Bergdahl left behind in Afghanistan, then wanted him summarily executed without trial. He defended the Kenosha vigilante by pointing to the alleged criminal records of the victims. It seems to bother him that our laws don’t appoint 17-year-olds to carry out summary executions of people he doesn’t like in the streets of our cities.
So why would he be upset about his brother’s death? After all, his brother was gay, and we know how Bob feels about gays. Maybe blood is thicker than water, or the slush inside his cranial cavity? Maybe he’d feel differently if the POW held by the Taliban, the vigilante victim, or the victim of a gay hate crime was his brother?
With him, it’s hard to say. I do get the impression from comments here that he’s not highly trusted in medical facilities.
