Roger Rabbit Commentary: Obviously, everyone on all sides needs to avoid rushing to judgment, step back, and wait for the results of a thorough investigation. There’s no necessity to push through a hasty and possibly ill-advised confirmation; it goes without saying we don’t want to wake up one morning to find out we’ve put a rapist on the Supreme Court. The vote on this nomination can wait; if investigation clears the nominee, there will be plenty of time next year to complete the confirmation process.
The Dow dropped pretty quickly after being up for most of the morning. What happen? Someone scratch their ass? Manafort?

My guess would be that this is about the forfeiture and his family.
Performance on his agreement means his family finances will probably remain intact. Most of that shit was pardon-proofed in the indictments. The White House could keep Manafort out of jail, but they could not (or would not) provide for his family’s financial support.
A Dallas cop came home from her shift, somehow entered the wrong apartment, and shot an unarmed black man dead in his own home. With a cop now facing serious charges, the smearing of the victim by the cops and Fox “News” has begun.

Interday right now… 83.54 52-week high, which is also company history record is 83.90 which it hit briefly yesterday before settling down a bit. Investors realized that 170,000 new Instagram followers and a record number of ‘Likes’ from American Facebook users may not translate to sales but does say something about the ‘backlash’ Nike was thought to be facing.

One of Manafort’s daughers in NYC changed her name a couple of weeks ago.
I would say it is pretty clear now that The Republican Presidential Campaign Manager’s def team have been the source for most of the reporting in the preceding week suggesting that a plea agreement was imminent. As party to a JDA it is inconceivable that Downing would have shared with the other attorneys about any movement toward a cooperation agreement. And yet for them to have completed such an agreement means that a proffer was made in advance and that the OSC had sufficient time to review and verify it thoroughly.
Still, for any such cooperation agreement to be successful its preparation would have to be kept secret from the JDA to avoid any interference from the White House, especially the dangling of a pardon and other inducements. So the OSC would have prefaced any such plea negotiations with a media gag as well as some initial negotiations around the JDA itself. Downing would have had to agree to not disclose any details related to the preparation of a cooperation agreement to the other parties.
Had Downing’s team simply dummied up, but gone ahead with delays in the schedule and a series of private meetings with the OSC that should have been incredibly alarming to the rest of the JDA. The “featured cooperator” suddenly goes radio silent, reschedules a bunch of hearings, and starts parading in and out of the OSC offices every day, right before starting the next big criminal trial, and right after losing the last one, would set off every trip wire and alarm.
So it’s very interesting that the series of media stories preceding this morning’s hearing were all focused on a plea agreement without any cooperation. That could only have come from Downing. It means he didn’t just leave the rest of the JDA in the dark. It means he might have deliberately misled them about what was going on.

Well, now that Kavanaugh has denied the incident happened, the hearing should be reconvened to get his denial under oath, then adjourned while the matter is investigated to determine who’s lying and who’s telling the truth; unless, of course, the Senate Republicans have a fixed policy of believing the male and not believing the female, and/or don’t care if they put a lying rapist on the Supreme Court. He is, after all, one of their own.

My guess is capping his potential time at 10 years and throwing Trump under the bus looks better to him than risking life behind bars and hoping for a Trump pardon. I assume a ticket into the Witness Protection Program after he serves his time is part of the deal. I don’t think 10 yrs is a significant downward departure from what he would have served anyway. Perhaps no more than 2 or three years. And I was surprised to discover that OSC had included forfeiture in this agreement, meaning Paulie will keep very, very little.
So why the deal? It is something you would have to recommend if you knew that a pardon would fulfill a corrupt act attaching to a conspiracy. If you knew that a Presidential pardon was impossible, then saving a few years and the cost of another trial would look pretty good.

Interesting story: in Breyer’s case it was about two dozen of his fellow Bay Area Eagle Scouts from back in the ’50s who signed the letter attesting to his exemplary character and stalwart circle jerk performance during outings to Cutter and the Big Basin Redwoods. Such a fine lad.
