Yesterday a San Bernardino CA woman was awarded a $50,000 settlement for unlawful detention under an ICE admin order.
Most of that money, along with her attorney fees will come out of San Bernardino Co tax payers. And that’s why competent govt attorneys advise against cooperation with ICE. Feds who show up waving robo-signed photo copies of their sophmore year book reports should be served coffee and otherwise politely ignored.
I wanted to add, relative to 1,
-that was just as true when a very popular black dude who was a two-term Democrat was living in the White House. It really has absolutely nothing to do with the President and pretty much everything to do with a huge bunch of conservative members of Congress who for three decades have been totally unwilling to even consider comprehensive reform legislation for our antiquated immigration laws.
For local governments things may have been a bit easier with the other Presidents who instructed DHS to focus their enforcement efforts on real criminals who could actually be identified with certainty. It did mean that, from time to time pretty bad guys walked free because the information from ICE was bullshit and totally useless. That remains on the Congress to fix that, not on local governments who respect the rule of law and the civil rights of our fellow citizens.
Since the current administration has turned to rounding up random brown hotel cleaners, drywall installers and pregnant ladies it’s quite a bit worse. Since a very large percentage of the people being rounded up are citizens or legal residents with documentation. Local authorities just don’t have the time or resources to fix ICE mistakes. So the smart move is to stay the fuck out of it.
