I should say to start that there may be times when a box of food instead of SNAP benefits might be beneficial. Save a trip or two worth of gas. Maybe for disabled, people not having to go to the grocery store is a positive.
The proposal isn’t that. And that said, there is a problem with the plan beyond how it infantilizes poor people. It’s that grocery stores are one of the few places where all strata of society meet. This proposal seems like another way for middle class and wealthy people to not think about poor people in their communities.

As you may recall, I’ve previously argued that private property owners, business owners, and other private citizens should tell ICE agents to go fuck themselves when they attempt to coerce entry into private spaces waiving around deportation orders.
Deportation orders are administrative documents that do not come remotely close to meeting the 4th Amendment warrant requirements for sworn affidavit and independent judicial review. A gubmit hack employed by the agency seeking entry is responsible for signing them.
In the case of Seattle, until Monday it was this government hack. Since Monday it’ll have to be one of his former assistants cranking out phony, “I Can’t Believe It’s Not a Warrant” documents to frighten unwary citizens out of their rights. He’s currently preoccupied going door to door at Westlake Tower trying unsuccessfully to secure criminal defense counsel.
Steve spews:
@2 So if #blacklivesmatter isn’t about black lives, what’s it about, he who gets off on the deaths of blacks?
WTF? spews:
Just before the news of food in a box, I had the same idea.
I agree 100% with what Carl said. In NYC of all places, where a bottle of beer (domestic) costs $6 in a bar, you can still go to Wendy’s and get a large Chili for under $4.00; if you add in a side salad it still costs around $7.00; with taxes! And it’s a relatively healthy meal.
So with that said – if a profit based business can do that, then why can’t a non-profit be able to provide food and meals for the same or less? Expand the menu with other healthy cheap eats.
There may be times when a better solution and a less costly solution can be achieved to fulfill the needs of the poor; maybe the homeless (those that are on the street) can have a place other than a shelter or soup kitchen to get a meal and not have to beg on the street. What is worse to be “infantilized” in this manner or to have to beg to a stranger for food?

I side with Jed Rakoff. Given the statistically significant rate of false conviction, the death penalty amounts to a procedural denial of due process.
Perhaps like you, I’m not particularly persuaded by most of the humanitarian arguments opposing the death penalty. But I still haven’t found a compelling justification for the known fact that some innocent people have been executed before they could successfully challenge their convictions. And the statistical certainty that innocent people will be executed before they can successfully challenge their convictions.

Roger Rabbit spews:
@45 It’s valid to argue that some jurisdictions can’t be trusted not to convict innocent people. However, there are heinous cases where guilt isn’t in doubt, and I think it should be available for those cases.
I doubt there’ll be any risk of false conviction in today’s school shooting case. Rather, the disputes will center around the shooter’s mental capacity. But the legal standard is not whether he suffered from a mental illness or defect, but whether he could distinguish right from wrong; and, at the time of execution, whether he understands why he’s being put to death.
We’ll have to wait and see how this case plays out in the legal process; but based on the acts committed, I would consider the perpetrator a candidate for capital punishment, subject to a determination of exculpatory insanity.
In other words, I’m not entirely put off, in all cases, by the state killing someone who walks into a school and kills a dozen or more innocent children.
Politically Incorrect the "Pathetic" Millionaire spews:
“Death While Incarcerated” is a good compromise with those who advocate the death penalty and those who want to end the death penalty.
Put the guy or gal in prison for life and let the killer die of whatever health issue arises. So, if a guy gets sentenced under this plan, he/she will die of the heart disease, stroke, cancer, kidney failure, diabetes or whatever he/she develops as he/she lingers in prison waiting for the disease to take him/her. No medical intervention with the diseases. I suppose we could be kind and provide palliative care only.
Advantages: the guy or gal dies, which satisfies the pro-death penalty people, and, while he/she is in prison, the anti-death penalty folks can be working on evidence to exonerate the guy/gal, assuming it exists.
Disadvantages: the guy or gal could be healthy and live a long, long time without developing a fatal disease or condition. Taxpayers could be on the hook for some time with the healthy killers.
Politically Incorrect the "Pathetic" Millionaire spews:

Oddly enough, IRS Publication 590 has some withdrawal tables that approximate the new thinking and should be considered by those wanting to make their retirement accounts last a long time.

curious. How would you propose to write such a statute that would protect due process while allowing for an irreversible (once carried out) sentence? I can’t see any way of crafting the language that in the end wouldn’t leave it in the hands of hundreds of thousands of prosecutors and judges. Like Roy Moore.
I suppose the risks could be reduced (but probably not eliminated) through very generous taxpayer funding of aggressive post conviction investigation and appeal by an army of highly qualified and experienced criminal attorneys (as opposed to sleep deprived 3Ls looking to burnish their resumes). But somehow I suspect the taxpayers would rather just lock ’em up. They won’t all be Dylann Roofs.

In your case my guess is it will be Rickets. But I’m hoping it will be Dercum’s.
Roger Rabbit spews:
@58 One thing you can do with statutes is make post conviction review more, rather than less, accessible. There’s been a tendency by conservative judges to prioritize finality over avoiding miscarriages of justice. Credible innocence claims and new evidence should get a hearing at any stage of the process. There should be no limits placed on reopening a case if there is indication that a mistake may have been made. And the fact that many of the wrongful convictions exposed by recent innocence project work were caused by sloppy or tainted forensics work demonstrates the need for more rigorous training and supervision of forensics work that will be used in criminal trials. Courts should give higher priority to avoiding wrongful convictions, especially in death cases, and this involves among other things giving greater recognition to the unreliability of eyewitness testimony. It also should be made easier to weed untrustworthy people out of the system; for example, a cop who’s caught lying in court shouldn’t be allowed to work in law enforcement again. That can be accomplished through a licensing system. Our criminal justice system needs these improvements regardless of whether there’s a death penalty.

We’ve still got jurisdictions where Gideon isn’t recognized. And not just in the White Supremacist deep south. In your own state. Ask Gerry Alexander. He’s probably still driving around Yakima trying to convince those assholes to adequately fund public defense counsel.
If we can’t get affluent states to adequately fund public defense in the simplest cases (dui, domestic, etc), how can we expect to provide due process to people convicted of terrible murders? Sure, it’s all very neat and tidy in a purely theoretical sense. But the real life criminal legal system driven by willfully stupid police, and assembly line plea bargaining is anything but neat and tidy. Maybe a constitutionally adequate death penalty statute is something to work toward “some day”. But don’t you think we might want to figure out how to prevent people from being murdered by jail guards first?
Until taxpayers agree to fund it, you can’t reasonably argue that the state can provide due process.

The state should set standards for public defender training and caseloads, and decertify programs that fail to meet those standards. Decertification should be grounds for a new trial. An argument can be made for putting public defenders in a state agency, supported by state funding, in place of the piecemeal county system we have now.

It might be worth remembering that the government’s “food assistance” programs (and those 25 cent school lunches us old creaky boomers used to eat) had multiple purposed, and the primary one wasn’t to help out poor folks in the cities. It was to keep a lot of farmers from going broke. We got really good at producing lots and lots of food for the GI’s in WWII, and after that the choice was to let two-thirds of the people in the food industry rot in hell, or find something else to do with what they produced. It seemed like good politics to help out all the soldiers when they returned, so Uncle Sam sorta-kinda solved two problems at once. I remember years ago some friends of ours of quite modest means were literally being forced to accept more “gubmint cheese” than they could use before it molded, so they gave some to us. The real reason Remington and other gun makers are in trouble is because gun sales fell off a cliff after Trump got elected. You see, the rubes expected Obama to outlaw guns, so they rushed to get ’em while they could. But after Trump came in, there was no longer any big rush to stock up on more AR-15s, so now they’re spending more of their paychecks on cases of Milwaukee’s Best and front seat blowjobs, and less on guns. So it’s Trump’s fault.

Mark Adams spews:
Carl the point of SNAP or food stamps is too provide food to poor people. It’s not about the poor gong to a grocery store. It’s about how government can provide the poor, food, at a specific place and time. The Department of Agriculture does buy food. The food stamp program is only in part about providing food to the poor it’s also about the government buying excess crops from farmers and providing those crops to the poor. If putting the food into boxes and delivering the food directly to the poor is more efficient, and provides healthy calories, at the least cost to the poor and participants in the food stamp program then it should be considered. This is not about how people feel about being around the poor. Or putting the poor out of sight and mind, It’s about feeding people. If it’s more efficient to put out tables, and long benches in the middle of Seattle, and feeding the poor out of a stew pot and that is the most efficient way of providing the poor calories then it should also be considered.
The plan has some merit, but attacking the plan with identity politics misses the point of having food stamps in the first place. If it’s just to ensure some poor people cannot have lobster tail once a year that is a far better objection than your point. And the poor would still have the remainder of their EBT on the card, so they could still get lobster tail depending on the details.

@4 Sure those businesses can do that, and ICE should go to a Federal Judge and get a warrant, and then do the search, and charge accordingly if the folks the deportation orders are for. People who have no rights die to their status, the folks hiding them or employing can then enjoy exercising their rights. Of course many will come to the conclusion it is cheaper, and much less hassle to go tell the ICE agent there he is. Many northerners particularly in butternut areas found it cheaper and easier to cooperate with slave catchers. Some areas did pull one over on slave catchers, but once it got into the courts the slave catchers generally prevailed unless the slave escaped again.
Mark Adams spews:
@4
NOLO does not agree with you on this. If ICE is waving a deportation order, it’s an order signed by a Judge. Usually ignoring such an order is contemptuous. Generally it’s cheaper to send the detainee home than add the cost of doing new charges. If you want to experience the removal experience you can always try emigrating to Mexico or Canada.

@50 Unfortunately the case will be in the courts far past the time the point where any behavior modifying effect on others is a legitimate argument. Florida like many southern states rules on insanity makes such pleas useless, and the defense will have better success with a stand your ground defense.
@51 One good thing about the death penalty is that defendants in most states actually do get good representation, and efforts continue as long as the person remains on death row. Prisoners with a life sentence are not provided with the same level of resources during the appeal process those on death receive. Death while incarcerated is not justice. Now if inmates were playing football at the college or professional level they would receive legal aide from the court, and their couch would be paid more than the governor. Inmates with a life sentence are forgotten by the system.

@59 There is the rub how do you do that. Arguably you have just had a financial hit, so your gun should be taken away, and your old and old rabbits are unstable as a rule and should have their guns taken away.
In a majority of these shootings there is no legitimate reason that the shooter should have had their guns taken away, they were just law abiding citizens just like you.
Your proposed solution is naïve and simplistic. And not viable without repealing or changing the second Amendment.
Mark Adams spews:
@61 Or the problem is the English Common law system and we should adopt the Napoleonic Code. Have professional judges as jurors. Have them at the appeal level. Yep the Italian system was so superior to our own in that Amanda Knox case.
Mark Adams spews:
@64 In our system it’s sufficient that the accused gets a fair trial. If convicted it’s too late, The innocent should not be found guilty, but it does happen, but once found guilty that is the presumption the courts go off whatever the crime. Which is why it’s better the guilty go free than the innocent be found guilty. In property protecting the guilty the innocent should be winnowed out.
The constitution specifically states that death is suitable punishment. The US and Washington State constitutions explicitly allow the death penalty as punishment. Due process need be adequate and fair, it is too much to expect the courts, prosecutors and juries to be omnipotent, and to make that the standard that must be met for justice to take place. After all it is said Justice is blind, and she also holds scales in one hand and a sword in the other. And that sword cuts often in more than one way.
Mark Adams spews:
@67 The gun functioned as designed. The bullets functioned as designed. Some systems meant to prevent or mitigate this type of event may not have worked so well, or contributed.
Law enforcement apparently in this case was able to arrest the person accused of the atrocity.
In one of the songs Johnny Cash sung at Folsom Prison there is a line:
“I shot a man in Reno, just to watch him die.”
That might be the truth in this case or in part. Maybe something will come out that will allow us to make sense out of a senseless act. We don’t like having to look at ourselves in the raw. That we are also animals that have this dark side to all of us, that allowed our species to survive for thousands of years on the plains of Africa, that we killed other animals and other humans or human like beings to survive. That our ancestors at times were brutes, and that competes with us being also social animals. Perhaps it is very much which of our two wolves we decide to feed. These events are why we desire the anti hero like Jack Reacher to be there. An ugly SOB who will do what is necessary to protect the innocent, and even the not so innocent and will gets justices retribution.

Mark Adams spews:
@71 The problem is not guns. It’s our gun culture. Disarming most police most of the time would go a long way in changing our culture, but that is not very likely to happen. OUr giving in to the police demands that must be armed and remember the police work for us. We tell the police how they work for us. Yet is it unlikely that what works in Britain and other nations will be adopted here. I’s because of our collective gun culture.
Mark Adams spews:
@76 Sounds nice but a 1/3 won’t comply, and others will work around your fixes, and nothing is stopping anyone from pointing and shooting their legal gun at someone. Or many someones. And such a system will require that there be a working battery in the gun which makes it less reliable, and it may not function in a life and death situation. And with as many guns as there are in America it will take decades to do what you suggest even with gunsmiths doing nothing but that for years on end, and there will be many many guns that you cannot retrofit. Some of historic value, and the military certainly is not going to go along with your suggestion, it’s too much of a pain in the ass, and just as at Stalingrad and any other battle soldiers may have to pick up the fun of their Comrade to have a working weapon. Read @76 again, specifically, “nonconforming guns will be illegal and subject to confiscation”
“such a system will require that there be a working battery in the gun which makes it less reliable, and it may not function in a life and death situation”
You can say exactly the same thing about the International Space Station, not to mention military and civilian aircraft, submarines, cruise missiles, etc., the point being that battery technology is at a point where we can make reliable batteries.
“And with as many guns as there are in America it will take decades to do what you suggest even with gunsmiths doing nothing but that for years on end”
Please show, step by step, the math you used to arrive at this statement.
“and there will be many many guns that you cannot retrofit. Some of historic value”
I concede it won’t work on matchlocks, arquebuses, or any other gun design where you have to light a fuse instead of pulling a trigger.
“the military certainly is not going to go along with your suggestion”
I didn’t suggest it for the military. My suggestion applies only to civilian weaponry.
“it’s too much of a pain in the ass”
Burying schoolchildren, worshipprs, and concertgoers by the dozens is an even bigger pain in the ass.
“just as at Stalingrad and any other battle soldiers may have to pick up the fun of their Comrade to have a working weapon”
I didn’t suggest it for the Red Army. My suggestion applies only to weapons in possession of civilians within the borders of the U.S.A.
“Would not be too useful if it only works for one person.”
A person who owns a firearm for hunting or target shooting could still hunt or shoot targets with it. Thieves, children, and ex-felons could not. So, yes, its utility would be more limited than at present, which is the whole fucking idea.
“Doubt the North Vietnamese would agree with you on this RR. give them a good laugh though.”
My comment wasn’t addressed to the NVA, but since you asked, my suggestion there is that NVA weapons be equipped with triggers than can only be fired by American soldiers. They would still be able to shoot arrows at us, but even so, it would be a much more relaxing war.

Honestly Roger. The essence of his argument (and the essence of most gun-hugger arguments in the wake of these senseless tragedies) is this:
“There is nothing anyone can do to prevent this”.
And the only reasonable response is to simply point out that this is the only place where these things happen so predictably. The gun-hugger argument only makes works if you ignore every other example of effective gun safety – which is all of them.
The challenge isn’t to refute stupid, pointless, empty arguments supporting carnage and misery. The challenge is to confront the uncomfortable truth that 63 million drooling, ignorant, meatheads who mindlessly lap up and repeat stupid, pointless, empty arguments supporting carnage and misery have an out sized influence on public policy.

Kiss Your Tax Cut Goodbye Dep’t
“A 25-cent gasoline tax, reportedly endorsed by President Donald Trump, would help wipe out 60 percent of the benefit from the tax breaks he recently signed into law for individuals, according to Strategas Research.
“Daniel Clifton, Strategas head of policy research, said the increase in gasoline prices would also be nine times larger than the estimated $4 billion workers are receiving from employers due to the corporate tax cut.”
https://www.cnbc.com/2018/02/15/trumps-gas-tax-would-wipe-out-60-percent-of-tax-cut-benefit.html
Roger Rabbit Commentary: So what? Trump’s “middle class tax cut” is an illusion anyway, as are the one-time bonuses in lieu of permanent pay raises that companies are doling out to workers they have to pay more anyway.
America needs to rebuild its infrastructure if we want a thriving economy. We have to pay for it. The federal gas tax isn’t indexed to inflation and hasn’t been raised since 1993. It’s the logical place to start.
This is one tax that SHOULD fall on the middle class. They drive on our highways and bridges by the millions. When gas is cheap they buy gas guzzling SUVs and pickups. If gas is less cheap, not as much. That’s bad?
To put numbers in perspective, a 25-cent gas tax increase would cost consumers about $40 billion, or roughly 1/30th of what Trump wants to spend on infrastructure. It’s exactly equal to what Trump wants to spend on a border wall. If the SUV and pickup drivers who want a border wall don’t want to pay for better roads and bridges then let ’em drive on what we have.
It’s obviously not enough, in fact, these numbers graphically illustrated just how puny Trump’s “middle class tax cuts” are —
they’re getting about $120 billion of the $1.5 trillion with the rest going to the rich. So additional funding mechanisms will have to be found.
Trump’s “solution” is to dump most of the infrastructure costs on states and municipalities, who will pay for it either by raising state and local taxes or diverting funds from other services they provide. And private investment, which will be compensated with tolls and other user fees. Guess who’ll bear these burdens? If the middle class is going to pay for infrastructure, which they are anyway, you might as well raise the gas tax. It’s the most direct and efficient way to tax the middle class for infrastructure, and has the side benefit of discouraging large passenger vehicles and fossil fuel consumption.
I think raising the federal gas tax to help fund road and bridge repair is an excellent idea and such an excise tax increase is long overdue.

Forty billion dollars for a border wall, but not one cent for school security.
Wait for it: The GOP’s “solution” for this will be to arm teachers with guns they buy themselves, send them to self-defense courses they’ll pay for themselves, and pass a law shielding them from legal liability if they miss the shooter and hit a kid.
Security guards and metal detectors cost money, lots of it, but you can’t even get a bump stock ban out of these people, so don’t expect any money to protect schools.

Seriously, apparently the increase is due to adjustments in federal tax withholding after passage of the federal tax cut bill.
So even retirees are seeing a benefit. It’s like EVERYONE is seeing a benefit.

I agree with you that PERS 1 is, essentially, a dowry.
Roger Rabbit spews:
@199 Yeah, I got a bump in my PERS1 pension, too, and so did Mrs. Rabbit in her PERS1 pension, from lower withholding. But so what? What matters is what we owe on April 15, 2019, not what the monthly pension deposit is. The withholding adjustments, per se, don’t mean a damn thing.
PERS1 retirees don’t get COLAs. And, trust me, this “middle class tax cut” is a loss leader which you’ll have to pay back in various ways. It’s exactly like buying discount chicken and paying more for milk or whatever at the grocery store; a price cut there has to be offset by a price increase over here.
Over the next 10 years, you’ll be lucky if you break even with this so-called tax cut. Somebody’s gotta pay for that trillion dollars Trump and the GOP Congress showered on the billionaire class, and it ain’t the billionaires who’ll pay for it, which leaves the rest of us. If even kids can see through this, why can’t you?

Nor do i care what RR claimed about other mass-murders’ political ideology, it isn’t germane to the simple direct question presented to you by me.
All you do is spew gibberish and deflect.
What if it was your child, gunned down in cold blood? Would you care what color the shooter was? Would you care about ethnicity? Sexual orientation? Political leanings? Religious affiliation? If the weapon used was legally obtained? I don’t believe when a parent is faced with planning the funeral for one of their children that any of that matters at that moment, but apparently you think some of those are OK if they are the correct parameters in your book.
In other words you would be ok with a person, that was a member of your church, that bought an AR-15 legally, all of a sudden busted into your child’s school, suprised and killed the armed guard, and was able to gun down a bunch of kids, one of which was yours? From the sounds of it, that would be fine by you.
Roger Rabbit spews:
@201 An AR-15 with a bump stock is worse than an assault rifle, it’s effectively a machinegun. You don’t even need the bump stock. You can get the same effect with your trigger finger and a string; all you have to do is look up the technique in videos readily available on YouTube. THAT is one more reason why AR-15s should be banned — not because you can modify them, but because you don’t have to modify them, to get a rate of fire that would enable a single madman to shoot 500+ people before even the fastest and most efficient police response could get to him.

This paragraph from the Seattle Times’ “Friday morning brief” (an email summary of today’s news) illustrates the hypocrisy and disingenuity of the Republican response to yet another needless school tragedy:
“‘A teen who looked out for underdogs, and another who “smiled all the time.’ A teacher who was blocking a door to keep students safe. They’re among the 17 people who died in Wednesday’s massacre at a Florida high school. As anxiety spreads through U.S. schools, one gun law in our state is getting more attention. And President Donald Trump is calling for a focus on mental health and school safety, but his budget would make cuts in both areas. Meanwhile, some key questions out there: whether the FBI missed warning signs, and how old a gun buyer should have to be.”
Yes, there were heroes in that school. Yes, Trump is an infuriating hypocrite. No, his FBI isn’t functioning as it should, just as Bush’s FBI didn’t function effectively in the days leading up to 9/ll; and standard management theory teaches that when you have major problems with execution in an organization, you clean house at the top. Meaning starting with the guy who appoints the guys who run the DoJ and FBI. I’d also been thinking about the issue of gun-buying age before ST tweaked the issue: Should there be a minimum age of 21, or even 25 or maybe even 30, to buy an AR-15? Experience strongly suggests these guns shouldn’t be available to people who’ve recently graduated from, or been kicked out of, high school.
