Quite often those risk managers will engage in a perverse calculus to determine a settlement. They will estimate the expected cost to try the case to a jury verdict and make an early settlement offer somewhat less than the expected trial costs. In a very narrow sense this is regarded as “saving” taxpayers money, even in cases that may seem frivolous to outside observers.
The fundamental flaw in this system is that it starves the virtuous cycle of robust torts defense and rewards personal injury prospecting. Over time risk pools and self-insured municipalities come to be regarded as dairy cows for personal injury firms. This is particularly the case in jurisdictions featuring joint and several liability, although that would not apply in the case of Mr. Nelson.

I may be missing some details, but at first look it appears to me that Yertle’s proposal to move forward to a floor vote on a deficit financed repeal of ACA taxes and mandates would not comply with the Byrd Rule. While this scheme may get Yertle and his fellow Hillbilly Traitor incompetents off the Schneid for the time being, whatever bill it produces from conference would almost certainly face significant court challenges for having violated the legal voting requirements for deficit measures.
In other words, a very meaningless fig-leaf that still forces politically vulnerable Hillbilly Traitors to take a costly and unpopular vote to kill babies, while trying to shift accountability to the House and prolong the political debate into next spring.

The Senate voted 50-50 to debate the House health care bill. This vote doesn’t pass a bill, and it remains to be seen whether Republicans can round up 50 senators to support throwing 15 million people off health insurance and raising premiums by 20% for the rest (CBO estimates) in order to give tax breaks to billionaires.
I hope they stick it to Trumpbillies, who have it coming, and then lose big in 2018. That would be poetic justice. Capitalists like me will take their loss to the bank.
I bought more AT&T just before the market closed. T’s earnings, reported after closing, beat analyst estimates and the shares jumped 2.5% in after-hours trading. I timed that one nicely. Held back some cash, though, in case telecoms go lower because of the wireless price war, or gov’t blocks the Time Warner deal, or Republicans crash the market with a Treasury default and/or gov’t shutdown on Oct. 1. Lots of opportunities in near future for GOPers to wipe out trillions of paper wealth, and then vultures like me swoop in and buy, buy, buy.
