According to their own internal investigation, police ran Gray down, tackled him, cuffed him, and then searched his person, whereupon a knife was discovered and cited as the cause for the arrest. Defense counsel has sought to exclude any technical presentation at trial around the issue of whether or not the knife was legal under city code. In all likelihood the knife was legal. Many east coast municipalities have similar codes. They serve as a convenient pretext for arrests that would otherwise be illegal. But more importantly they feed CompStat data and provide officers with a rather easy, trouble free way of recording felony weapons arrests, which lead to promotions.

As anyone can see, these are folding utility knives in rather common use by contractors, electricians, technicians, etc. With some dexterity and practice they can be made to perform in a way that meets the definition in these city’s codes.
In cities like New York, workers who use knives like these have learned to keep them concealed, particularly when riding the subway, as NY Transit police look for them in order to boost their arrest numbers and gain promotion. Gray’s knife is said to be of a similar design, albeit with integral blade instead of the disposable blade.
It is worth some note that the events that preceded Mr. Gray’s arrest facially cannot be construed to constitute grounds for detention, even under the very broad discretion granted under Terry. Arresting officers indicate Mr. Gray “made eye contact” and immediately thereupon “departed from the area”. But we remain stuck with the “tough on crime” reasoning of William Rhenquist that any citizen not under arrest and free of suspicion who chooses to exercise their freedom to leave is displaying “the consummate act of evasion”. In Rhenquist’s dubious estimation we become “suspicious” as soon as we choose to act like free citizens with rights.
So under this legal rubric, which remains the status quo in many U.S. cities, citing Terry the police can target any individual they so desire, seize and physically subdue that person, place that person in handcuffs, perform a physically invasive search, and then use whatever they find as a result of that search as justification for both the “Terry stop” and any subsequent arrest. No matter how egregious their conduct, police can very easily meet the standard for “lawful arrest” so long as they insist that they “believed” that the arrest is lawful, and that their belief is broadly reasonable. Even when it clearly is not.
Believers in civil liberties should support efforts to change this legal status quo in police conduct.

None of the arresting officers have x-ray vision, nor are pre-cog adepts. So when they decided to run down Mr. Gray, tackle him to the ground, subdue him, place him in handcuffs, and perform an intrusive full body search the only “cause” they could cite for doing so was that “he made eye contact with them” and he thereupon attempted to leave the area.
I’m not arguing that his “detention” and subsequent arrest were unlawful. As unbelievable as it may seem to an upright person like yourself, police have qualified immunity for “doing their job”, even when they decide that it is “their job” to attack bilious radiologists minding their business and exercising their common civil rights. At the time of his “detention” Mr. Gray was unknown to the arresting officers, and they had made no observations related to any criminal acts or giving rise to suspicions about criminal acts. In other words, it could have been you. The basis for his ride was a knife which, though it might technically be considered falling outside the legal standards in effect in Baltimore, can be found worn every day by tens of thousands of tradesmen, contractors, and technicians throughout the city of Baltimore, and even a few police officers. Seldom do city prosecutors file felony charges over knives like this one. When they do, it is usually to cover up an otherwise bad arrest and also to pad their statistics at the expense of some “lesser” citizen. Quite easily done when opposing counsel is a mail-order public defender who reads the police report for the first time minutes before arraignment. Yes, these knives have “a spring” or can be made to appear as if “they have a spring” and that is all any police officer needs to justify an arrest and confiscate the knife. Their commanders count it as a felony weapons arrest. And they count the confiscated knife as a “deadly felony weapon removed from the streets of their city”.
It’s a game to them.
Even though the knife may have been “spring assisted” anybody other than a disabled board certified radiologist can easily understand that a police officer can’t determine such a thing by “making eye contact”. Knives are legal. People carry knives around in public legally. They may do so for any reason. The Constitution guarantees that they don’t have to give a reason. And the Constitution guarantees that police are not empowered to compel any such reason. A search must be preceded by probable cause. Hunches aren’t allowed. So even if Mr. Gray had been openly carrying his knife in his hand at the time police contacted him, it would not be legal justification for an arrest, or for such a search.
The tactics and procedures employed by these officers in violently detaining, searching, and arresting Freddie Gray may not be criminal. But they put the public and officers at obvious risk (did you happen to notice Mr. Gray died?). And much of the time the result is nothing more than statistics – statistics I’m confident Mosby has employed to benefit her career many, many times.

I’d give this source a bit more credibility in this case because it’s Ebony:
It’s an area where police are constantly patrolling, even deploying bicycle officers to assist with apprehension. Gray was familiar to police because he had been arrested before. A later arrest report would quote officers as saying “Gray looked at us funny.”
Upon this encounter, Gray and his friends went running in different directions, chased by officers on bicycles.
So, it couldn’t have been me, because the one time I was arrested it wasn’t in my own neighborhood. Plus, after seeing that white dude smashed against a wall and turned into a vegetable after running away from a cop in Seattle a few years ago, I’m smart enough not to run from the police. Or, as you put it above, ‘exercise my freedom to leave’. You probably used that term because running is good exercise, I bet.
In addition, I don’t make it a habit to hang out in known high-crime, high-drug use areas in which the prosecutor has asked the police to be more vigilant. One more thing that separates me from Freddie Gray. Trial Day #5
This day opened with the prosecution agreeing to stipulate that the area in which Gray was arrested is, in fact, a high-crime area. The high-crime nature of the area is a key factor in establishing reasonable suspicion based on Gray’s flight from police.
Had the prosecution not agreed to this stipulation, the defense was prepared to call as witnesses numerous staff from State’s Attorney Marilyn Mosby’s office to testify as to email communications from her office asking for an increased police presence in the neighborhood.
So the chase was justified on Terry grounds and the search was justified on reasonable suspicion based on known criminal history of Gray and the requests from Mosby’s own office.
As far as whether charges based on knife possession are commonly to cover for otherwise groundless stops of others, I’m in no position to argue against that possibility, other than to reply that your own willingness to conflate a switchblade with a folding X-acto knife badly damages your own credibility in making such an allegation.

Baltimore City code says a person can’t carry or possess any knife “with an automatic spring or other device for opening and/or closing the blade, commonly known as a switch-blade knife.”
A Baltimore police task force, commissioned to investigate Gray’s death, analyzed the knife and determined that it was “spring assisted” and in violation of the city’s law.
So if we take a leap of faith and assume that CNN and the Baltimore Sun writer and editor are not lying, then dead Fred may very well have been carrying what Baltimore’s code would define as a switch blade knife.
Since the defense had to file a motion to actually see the knife (first link), I suspect that there’s something about that knife that Ms. Mosby really, really didn’t want leaked until, say, after her husband’s run for Baltimore mayor was over.
Or maybe I’m just becoming a bit jaded as I age. But here’s the thing, DR:
twice, on the top page, Gray is charged with possession of a switch blade knife. Said knife has not (to my knowledge) been shown to the public. How, then, am I to know that it is not? And how does merely repeating information in the charging documents make me a liar?

I certainly don’t think Mr. Gray deserved to die. But I also don’t doubt that Freddie Gray deserved to be arrested. I just oppose the way the arresting officers went about it. Given the scope of limited immunity granted to LEOs, I think it’s a stretch to bring an indictment like these two. Which is why it really surprises me that idiots like Fuckwad Jr. get so carried away that they feel like they have to double down and make shit up about the arrest. Considering what a strong defense case there was to start, it’s unnecessary. And to lie about the case in the wake of an acquittal really demonstrates some kind of deeply biased motivation. Something about the larger scope of events surrounding this trail really seems to make Fuckwad Jr. angry. And I don’t think the anger is directed at Mr. Gray. According to their own internal investigation, police ran Gray down, tackled him, cuffed him, and then searched his person, whereupon a knife was discovered and cited as the cause for the arrest. Defense counsel has sought to exclude any technical presentation at trial around the issue of whether or not the knife was legal under city code. In all likelihood the knife was legal. Many east coast municipalities have similar codes. They serve as a convenient pretext for arrests that would otherwise be illegal. But more importantly they feed CompStat data and provide officers with a rather easy, trouble free way of recording felony weapons arrests, which lead to promotions.

As anyone can see, these are folding utility knives in rather common use by contractors, electricians, technicians, etc. With some dexterity and practice they can be made to perform in a way that meets the definition in these city’s codes.
In cities like New York, workers who use knives like these have learned to keep them concealed, particularly when riding the subway, as NY Transit police look for them in order to boost their arrest numbers and gain promotion. Gray’s knife is said to be of a similar design, albeit with integral blade instead of the disposable blade.
It is worth some note that the events that preceded Mr. Gray’s arrest facially cannot be construed to constitute grounds for detention, even under the very broad discretion granted under Terry. Arresting officers indicate Mr. Gray “made eye contact” and immediately thereupon “departed from the area”. But we remain stuck with the “tough on crime” reasoning of William Rhenquist that any citizen not under arrest and free of suspicion who chooses to exercise their freedom to leave is displaying “the consummate act of evasion”. In Rhenquist’s dubious estimation we become “suspicious” as soon as we choose to act like free citizens with rights.
So under this legal rubric, which remains the status quo in many U.S. cities, citing Terry the police can target any individual they so desire, seize and physically subdue that person, place that person in handcuffs, perform a physically invasive search, and then use whatever they find as a result of that search as justification for both the “Terry stop” and any subsequent arrest. No matter how egregious their conduct, police can very easily meet the standard for “lawful arrest” so long as they insist that they “believed” that the arrest is lawful, and that their belief is broadly reasonable. Even when it clearly is not.
Believers in civil liberties should support efforts to change this legal status quo in police conduct.

None of the arresting officers have x-ray vision, nor are pre-cog adepts. So when they decided to run down Mr. Gray, tackle him to the ground, subdue him, place him in handcuffs, and perform an intrusive full body search the only “cause” they could cite for doing so was that “he made eye contact with them” and he thereupon attempted to leave the area.
I’m not arguing that his “detention” and subsequent arrest were unlawful. As unbelievable as it may seem to an upright person like yourself, police have qualified immunity for “doing their job”, even when they decide that it is “their job” to attack bilious radiologists minding their business and exercising their common civil rights. At the time of his “detention” Mr. Gray was unknown to the arresting officers, and they had made no observations related to any criminal acts or giving rise to suspicions about criminal acts. In other words, it could have been you. The basis for his ride was a knife which, though it might technically be considered falling outside the legal standards in effect in Baltimore, can be found worn every day by tens of thousands of tradesmen, contractors, and technicians throughout the city of Baltimore, and even a few police officers. Seldom do city prosecutors file felony charges over knives like this one. When they do, it is usually to cover up an otherwise bad arrest and also to pad their statistics at the expense of some “lesser” citizen. Quite easily done when opposing counsel is a mail-order public defender who reads the police report for the first time minutes before arraignment. Yes, these knives have “a spring” or can be made to appear as if “they have a spring” and that is all any police officer needs to justify an arrest and confiscate the knife. Their commanders count it as a felony weapons arrest. And they count the confiscated knife as a “deadly felony weapon removed from the streets of their city”.
It’s a game to them.
Even though the knife may have been “spring assisted” anybody other than a disabled board certified radiologist can easily understand that a police officer can’t determine such a thing by “making eye contact”. Knives are legal. People carry knives around in public legally. They may do so for any reason. The Constitution guarantees that they don’t have to give a reason. And the Constitution guarantees that police are not empowered to compel any such reason. A search must be preceded by probable cause. Hunches aren’t allowed. So even if Mr. Gray had been openly carrying his knife in his hand at the time police contacted him, it would not be legal justification for an arrest, or for such a search.
The tactics and procedures employed by these officers in violently detaining, searching, and arresting Freddie Gray may not be criminal. But they put the public and officers at obvious risk (did you happen to notice Mr. Gray died?). And much of the time the result is nothing more than statistics – statistics I’m confident Mosby has employed to benefit her career many, many times.

So, it couldn’t have been me, because the one time I was arrested it wasn’t in my own neighborhood. Plus, after seeing that white dude smashed against a wall and turned into a vegetable after running away from a cop in Seattle a few years ago, I’m smart enough not to run from the police. I certainly don’t think Mr. Gray deserved to die. But I also don’t doubt that Freddie Gray deserved to be arrested. I just oppose the way the arresting officers went about it. Given the scope of limited immunity granted to LEOs, I think it’s a stretch to bring an indictment like these two. Which is why it really surprises me that idiots like Fuckwad Jr. get so carried away that they feel like they have to double down and make shit up about the arrest. Considering what a strong defense case there was to start, it’s unnecessary. And to lie about the case in the wake of an acquittal really demonstrates some kind of deeply biased motivation. Something about the larger scope of events surrounding this trail really seems to make Fuckwad Jr. angry. And I don’t think the anger is directed at Mr. Gray. I think the larger circumstances, and especially the broad, populist, and nationwide reaction to this entire affair really upsets him. A status quo is being disrupted here. And its a status quo that Fuckwad Jr. feels a strong affinity for. To me that suggests more than racism is motivating his reaction. His comments @57 above insisting that someone like him could never share a fate like Mr. Gray’s is pretty telling. It’s very important to Fuckwad Jr. that he is “smarter” than people like Mr. Gray and that he doesn’t have to spend time in “high crime” areas. More important I suspect is that people who aren’t as “smart” as Fuckwad Jr. who live in “high crime” areas are treated very differently by the police. That’s clearly a big concern to him here.
