There are procedures for constitutional change, and if you cannot pass those tests, you don’t get your changes.

WA state constitution, Article I Section 22:
SECTION 22 PASSAGE OF BILLS. No bill shall become a law unless on its final passage the vote be taken by yeas and nays, the names of the members voting for and against the same be entered on the journal of each house, and a majority of the members elected to each house be recorded thereon as voting in its favor.
That’s called a simple majority, bitch. And it’s the law of the land in Washignton until the constitution is amended.
Yet, to Mark1, the explicit literal meaning of the state constitution, and the fact that our constitution also specifies how it can be changed (Article XXIII, Section 1) and that ain’t by the passage of an initiative, is some fucking “smoke screen.”

This is Dennis “Let Mark Foley Bone the Pages” Hastert’s old seat, and the Democrat is running neck-and-neck in a district formerly so Republican that the Speaker of the House came from there. The RNC has had to sink $1 million that they could really, really use for other races in the general election into this race and they might lose it. We’ll know by end-of-day.
Hopefully, it’s a harbinger of massive Democratic victories to come in 2008. If not, a hard fought race that drains their resources for minor gains,and organizing for the fifty-state strategy in the future.

BTW, re: waterboarding. It already is illegal under the UN Convention against torure, whic the US has signed and ratified and is therefore the law of the land. We know this fucking president doesn’t give a shit about following the law, but this bill would further restrict the CIA and other agencies to use only the interrogation techniques specified in the US Army Field Manual. We cannot be world leaders or have any moral authority without being transparent and accountable. By continuing his illegal interrogation programs, the president is sacrificing our strategic advantage for what are known to be failed methods of achieving tactical gain.

SECTION 29 CONSTITUTION MANDATORY. The provisions of this Constitution are mandatory, unless by express words they are declared to be otherwise.
So here you go, JBD. The Constitution says that a simple majority is all that is required to pass a bill. I-960 says that bills that contain “tax increases” require either a two-thirds vote in each house of the legislature or voter approval. But that’s not what the constitution says. And in a constitutional republic, when that happens, the constitution wins.
Like I said, if you think it works some other way, please fill us all in on your special wisdom.

Mr. Eyman and his backers knew very well that the initiative was unconstitutional. While many of his supporters probably thought they were supporting something that would limit taxes, Mr. Eyman knew that all they were doing was giving their base a talking point for the next election.
Look at what is happening. They put limits on taxes that they know are needed to support the services that even they know are needed.
The taxes will be passed. If there was any chance that the tax would actually fail to pass, enough Republicans would be allowed to “vote their consciences” to make it pass.
What they want is to be able to complain about “liberal activist judges” in order to let BIAW make another try at electing their hand-picked judges, and to give them a talking point for their candidates in the next election.
If they had really wanted to limit taxes, they would have written an initiative that had a chance to pass Constitutional muster.
Either Mr. Eyman and his backers are certifiable morons (which I do not believe) or they deliberately wrote the initiative in a way that they knew was unconstitutional.
They’ll please their base, get some election talking points and get another chance at the Washington Supreme Court. This was the goal from the beginning, and even Jane’s dog could figure that out.

So California just certified their primary results today. The net result of the final count is that Clinton lost 4 from her media totals and Obama gained 4 more, erasing Hillary’s gains in Ohio and Texas. Go figure.

Look, everyone.
Mr. Eyman and his backers knew very well that the initiative was unconstitutional. While many of his supporters probably thought they were supporting something that would limit taxes, Mr. Eyman knew that all they were doing was giving their base a talking point for the next election.
Look at what is happening. They put limits on taxes that they know are needed to support the services that even they know are needed.
The taxes will be passed. If there was any chance that the tax would actually fail to pass, enough Republicans would be allowed to “vote their consciences” to make it pass.
What they want is to be able to complain about “liberal activist judges” in order to let BIAW make another try at electing their hand-picked judges, and to give them a talking point for their candidates in the next election.
If they had really wanted to limit taxes, they would have written an initiative that had a chance to pass Constitutional muster.
Either Mr. Eyman and his backers are certifiable morons (which I do not believe) or they deliberately wrote the initiative in a way that they knew was unconstitutional.
They’ll please their base, get some election talking points and get another chance at the Washington Supreme Court. This was the goal from the beginning, and even Jane’s dog could figure that out.
