Amanda Knox has been re-convicted of murder by an Italian court. At this point, it’s a little tricky to figure out what it means for her.
Without doubt, she’ll appeal, and there’s always the chance a higher court will reverse this verdict. She and her lawyers maintain there’s no evidence of her guilt; in an American court, a verdict unsupported by substantial evidence normally would be reversed by appellate court on those grounds.
But let’s assume for a moment the verdict of the Italian retrial stands. Then the question becomes whether (1) Italy seeks extradition, and if it does, whether (2) the U.S. grants or refuses extradition. The U.S. does have an extradition treaty with Italy, but I’ve seen it argued in the media (citing legal experts) that the U.S. would refuse extradition in her case because the retrial constitutes double jeopardy.
I’m no expert on Italian law, and I’m reluctant to question the legal opinions of bona fide experts on extradition, but it’s not clear to me this is double jeopardy. My understanding goes like this:
1. Knox was convicted by an Italian trial court.
2. The verdict was said aside and a finding of innocence was entered by an Italian intermediate appellate court.
3. The intermediate appellate court’s decision was set aside by Italy’s highest court, which remanded the case for a new trial.
4. Knox was convicted in the retrial.
Under the U.S. system, this is not double jeopardy. A murder defendant (or any other defendant) whose conviction is vacated on appeal can be retried if a higher court sets aside the intermediate appellate decision but, instead of reinstating the original conviction, orders the trial court to retry the case. That is not double jeopardy under our system, and if that’s what happened in Italy, which is what it looks like to me (superficially, anyway), then I don’t see why U.S. authorities would refuse extradition on those grounds.
However, that still leaves open the possibility of the U.S. refusing extradition on some other grounds. Right now, I don’t want to speculate what those grounds might be, but I’m sure her lawyers will argue any grounds that might exist if Italy does seek extradition.
Overall, I think the odds are very small that she will spend more time in Italian prisons. But unless this verdict, too, is set aside by a higher Italian court, it will be a sword of Damacles hanging over her. Even if Italy doesn’t seek extradition, or the U.S. refuses extradition, she could not travel outside the U.S. without putting herself at risk of being seized by the authorities of another country and handed over to Italy. Like Dick Cheney, she’ll have to write a European vacation off her bucket list.

If you fail to obey their commands, even if one is deaf or unconscious, you are “failing to obey a lawful order from an officer”. This completely justifies use of deadly force.
If you scream and put your hands up to protect yourself while they’re beating you with their Tonfas or their tazers or their fists and boots, you are “resisting arrest with violence”, also a Felony. Also a justification for the use of Deadly force.
Police officers train on simulators that show various scenarios, such as, a 7 year old kid pointing a handgun at them, or a pregnant 14 year old girl pointing a handgun at them, or a 50 year old construction worker pointing a handgun at them, or a 80 year old woman pointing a handgun at them. The problem with that, is that humans instinctively react to facial expressions, not the apparent presence of a weapon. The face is the absolutely first thing the brain recognizes. So now, any apparently angry or distressed facial expression, as the simulators always use on the shooting subjects, becomes the instinctive trigger for the officer’s reaction with an escalation of force, including with a deadly weapon whether that subject is actually holding a weapon or not. So now you’re seeing officers shooting pregnant women, and young kids, and little old ladies that just might have a legitimate reason to be upset and be wearing those facial expressions. The training is exactly similar to Pavlovian Response, it is designed to generate an instinctive, non-thinking and very specific reaction to stimuli.
That’s military shit, that’s soldiers training.
Oh, and by the way. 90% of those simulator targets have non-European ethnicity.
