If you, a private individual person, find yourself engaged in a criminal conspiracy using your iPhone, and you are too motherfucking stupid to disable caller ID, then you may be fucked. If the government subpoenas your phone company for your call information you can prevent it by invoking your Fifth amendment rights. But if the government obtains someone else’s phone records, and that someone else is one of your co-conspirators, you’re fucked. In essence you fucked yourself.
But there’s an interesting corollary in this example. Notice I specified “a private individual person”. That is because corporations in general do not (as yet) have any established Fifth amendment rights against self-incrimination. The government can, and often does, subpoena all kinds of corporate records, including what often turn out to be very incriminating records. And they obtain production without any fights over self incrimination. Whereas if you or I were dumb enough to make a private documentary record of a criminal conspiracy, we could resist a subpoena for that record from government discovery by invoking our Fifth amendment rights. But if a corporation has records of its own criminal misdeeds it must produce them as a settled matter of law.
