– This litigation, admittedly, does seem to be based on a principle that has been around for nearly two decades; namely, Judge Costanza’s dictum that it’s not a lie if you believe it.

– I wonder how much of Seattle’s pretty good but could be improved pedestrian safety is on drivers and how much is on the pedestrians (and other factors). I mean it’s the only big city I’ve lived in where people don’t expect to jay walk. On the other hand, the people who do jay walk are really, really bad at it by and large.

– It’s embarrassing for everyone saying that this is all about humanitarianism to pretend that oil isn’t in the equation.

– Torture was torture, and it’s a shame the New York Times wasn’t more on top of that.

– I could use a Universal Converter Box.

    Well, Carl, I’m not sure how “Open Thread” morphed into “Old Pen Red” or why; maybe you’re trying to disguise the fact this is an open thread to discourage the trolls (all of whom are too stupid to figure out what “old pen red” means; for that matter, they probably don’t get that “8-12” is a date, either [i.e., today’s date], as this requires a mental capacity for abstract thinking [i.e., correlation] that’s well over their heads), in hopes it’ll remain relatively uncluttered (at least for a while).

    With that preliminary out of the way, there’s something to be said for Judge Costanza’s dictum, at least for the narrow legal purpose of determining whether a crime (e.g., perjury, false swearing, fraud, et al.) has been committed, because most crimes require “mens rea” (a/k/a “intent”), that is, for a lie to constitute a crime, there’s a volitional element that must be satisfied, and an act does not constitute a crime if any element of the crime is unsatisfied. Thus, a witness giving testimony under oath on matters about which he is mistaken is not a perjurer; he is merely “not credible.” Of course, liars are “not credible” also; but the law distinguishes between lying and mere ignorance of the truth. Thus, perjurers go to jail, and ignoramuses go free. (One could argue whether this is wise social policy; but that is not for the law to decide; it is a legislative matter.) It can be difficult to ascertain whether a person is lying or merely stupid, as exemplified by the statement made by a federal judge when sentencing a GOP congressman to prison for corruption: “Frankly, I have doubts of your guilty, because I think you’re too stupid to form a criminal intent.” It’s a conundrum. It’s also a “Get Out of Jail Free” card for virtually every GOP politician, because imo not a single one of them is smart enough to form what the law calls “mens rea,” that is, an intent sufficiently cognitive to constitute a culpable act. GOP intent is of a reptilian nature, a kind of reflexive muscle movement in response to a stimulus, as when a shark is attracted to the thrashing legs of a swimmer. This is easily demonstrated using a slightly more nuanced version of Pavlov’s bell, for example,

    “Benghazi!! Benghazi!! Ben-GAH-zi!! Bennnnn-GAAAAAH-ziiiii!!!”

    will, without fail, summon forth the primitive echo-location instincts of every Republican within detection range of it. By this reasoning, of course, no Republican can be adjudged a liar for legal purposes. Nor can Republicans fairly be condemned as “crooks,” for there again the requisite “mens rea” is missing due to the autonomic nature of their central nervous systems; like other bottom feeders, they are merely scavengers; therefore, instead of calling Republicans “crooks and liars” we should call them “rats and bats.”

    Speaking of jaywalking, and who’s at fault, I was walking north on Aurora Ave in the early afternoon just a day or two ago when I saw two 20-somethings standing at the intersection of ~79th and Aurora obviously getting ready to try to make it across. The cross-walk, complete with red light was just a block away. I didn’t butt in and explain their foolishness to them, and I didn’t hear any sirens later on, so I guess they made it across. This time, anyway.

    Two things. (1) They’re all profitable. (2) None of them owed or paid any federal income taxes last quarter.

    That’s right, if you owe even $0.01 of federal income tax for the period April – June 2014, you’re paying more federal income taxes than these 20 corporations put together.

    But you can bet that, collectively, they spend millions on lobbying for tax breaks. The rich and powerful always manage to find time to complain about taxes they don’t pay.

    Interesting blog on the basic nature of the Tea party.

    I’ve tried to explain to people about what the original Boston Tea party was. That is, it was a protest against a corporate tax cut that shifted the costs to the individual taxpayer while leaving no way for them to petition a court or address the concerns in Parliament.

    The modern Tea party is a openly Fascist/NeoConfederate Corporatist party that bears no resemblance whatsoever to it’s own namesake. In fact it is diametrically opposite to it.

    No less a personage than Boeing CEO Jim McNerney confirms what I’ve been saying all along, namely, that employers not only don’t value workers but affirmatively disrespect them. Here’s what McNerney told Wall Street analysts in a conference call when asked if he planned to retire at age 65 per longstanding company policy:

    This Officer that killed that kid did not even report it to the dispatcher for 10 minutes.

    The Police Are Lying

    … and interfering with news crews, and pointing guns at people heading toward the protests.

    More witnesses are coming forward and refuting the police version of the shooting. The cop, they all say, was the aggressor and shot the black teenager for trying to run away. They also say police claims of a struggle inside the squad car and that the victim reached for the cop’s gun are lies.

    Meanwhile, cops are firing teargas rounds at TV crews and detaining reporters. Looks like they don’t want media around in case they decide to do something provocative.
