Outside of a courtroom it should be tough to evaluate legal claims and counter-claims. This intersection between our legal system and our political system has grown murky in the decades since a bunch of disgruntled hillbilly litigators from Arkansas, butt hurt job seekers, and Little Rock political gadflies joined forces with the Team Bush to create a giant legal foundation dedicated to bringing politically motivated litigation against the Clinton family. It’s now a lucrative cottage industry that feeds hourly media cycles and drives ratings and page views.
Nevertheless, sincerely motivated lawyers representing legitimate clients still exist and can be difficult to distinguish from opportunists. There are clues. Lawyers who overtly seek to try their client’s case in front of cameras are a big one. Another thing to look for are public court filings characterized by lots of hyperbole and dramatic language designed to drive media speculation or favor a particular narrative. Yet another would be direct financial linkages between the clients, their lawyers, and specific political opponents. On the latter, in this case I’m not yet persuaded. One of the attorneys with the firm representing the plaintiff has made significant financial contributions to a failed initiative effort aimed at limiting trans access to public bathrooms. That’s not very direct. Nothing else really jumps out at this point.
In my view that neither lends credibility to the plaintiff’s claims, nor diminishes them. Which is as it should be. As onlookers we have to learn to let the process play out – except of course in the case of toothless, sister-fucking, hillbilly traitors. Those we must publicly burn at the stake. They were born guilty.

The argument against Murray’s accusers making this up: The potential for a huge libel verdict (yes, Murray is a public figure, but even public figures can recover for libel if they can prove malice). The argument against any law firm filing a frivolous lawsuit based on fabricated allegations: Potential Rule 11 sanctions and/or disbarment. Even in the mosh pit of politics, using the courts to inflict character assassination based on falsehoods can have serious consequences. So I’ll wait to see if there’s anything to this.

The other is obvious. In Boston as the scandal broke plenty of priests and ex-priests began to confirm what they knew to the press. The personnel files of the diocese confirmed many, many, many of the cases. Letters between the Arch Bishop and various parishes confirmed the accusations.
In Los Angeles, the presumed first American Pope Cardinal Roger Mahony couldn’t get away from the mountains of personnel files that clearly pointed to the reshuffling of suspected abusers from parish to parish rather than any actual investigation of the facts. That there was a very long report about a specific priest waiting for Mahony when he took over the Los Angles diocese which he either chose not to read or act upon didn’t help.
There is a mountain of actual evidence in one side of the this = that equation. Such evidence is not available in the other yet if ever at all.

It was a young man of 26 doing something with another young man of perhaps 15. And if the alleged victims were all actually 16 or older then there is no case unless there is some abuse of authority. Yes folks the age of consent in Washington state is 16 but one has to read the statute carefully. If one is a University Professor and does it with a 21 year old student of his he or she is guilty under the statute. I doubt though a prosecutor will touch such a case, though a university might fire the professor.
So is it politics, very possible. Best thing for the Mayor is the case dies very soon. So expect some kind of motion to kill the case ass soon as his attorney’s can file the motion. Which may not be soon enough for Ed’s political future. He’s going to need support folks. What you going to do?

When you are calling a teenager a child you are denying that human being of rights. The right of being able to choose who one has sex with is an essential right. Then if it does happen they can get people to wait for the next flight. Under normal circumstances the police would have asked, “Does he have a valid ticket? Can you show me a valid ticket for the person you want to put in that seat?”
When the answer was Yes and No that would be the end of it. One had a right to be on the plane, the other was someone United wished to be on the plane but had no greater right than the ticket holder. they should have walked and told The flight crew to go spit.

I bought tickets to the Ms game tonite. I might get hit with a batted ball or a broken bat, or spilled on by a fan in the seat behind me.
If it rains and the roof doesn’t close, forcing a postponement, I wasted time and money on the trip and the lost evening, and I might not find it convenient to attend the make-up game, costing me the price of my tickets as well.
You pays your money, you takes your chances. Somewhere, buried in all of the legalese having to do with a ticket purchase, there’s very likely verbage protecting United, which did not directly employ the guy who dragged the passenger out of the plane.
The cost to United is in the optics of the whole thing.
I don’t get to prevent a rainout because I can prove I paid for my ticket.

The bright legal minds on the TeeVees also say that United’s fine print allows them to bump people from overbooked flights. Having four of your employees need carriage without tickets is not due to overbooking.
In your example of the Mariners, a batted ball leaving the field of play is not in the Mariners control and is fully spelled out in the ticket contract. Ever read the back of it. Rain is also out of their control and their contract reads that if weather causes cancellation the ticket holder is entitled to a same price ticket at any remaining regular season game. You’re the person who if the game is called demands to be let in to buy a $9 beer and $12 burger aren’t you?
But, But, But…you have to obey the flight crew, that’s federal law. Nope, sorry. If the flight crew is issuing an illegal order (see once you’ve boarded) they are no longer acting within FAA rules. Same as if a cop tells you you must stop videotaping. You are under no obligation to obey and illegal command.

@69 You left out that even if a company has acted within the fine print of a legal contract that nobody ever reads, courts sometimes refuse to enforce the fine print because doing so would be contrary to the public interest and fundamentally unfair.
However, I’m pretty sure the fine print of that particular contract of carriage doesn’t include a provision that “if you don’t give up your seat when we ask you to, you agree to let us beat the shit out of you, and to hold us harmless for doing so,” or words to that effect.
Also, no matter what the contract says, nothing in it can require the flying public to choose United as their carrier when they book travel in the future.
If Doctor Dumbfuck chooses to fly on an airline that overbooks, bumps passengers, and beats unconscious those who object to giving up their seats, that’s his business.

Really, I think that’s setting the bar too low. Ordinary law-abiding citizens should not be more afraid of cops than they are of other ordinary law-abiding citizens. But polls now indicate that a majority of Americans are now more wary of police than they are of total strangers.
