A few years ago, Florida Republicans wanted a law that forced all employers to use the federal E-verify system.
This would make sure that none of the employees where undocumented.
And they almost got that law until Big Ag, Big Sugar and Big Entertainment sat them down and explained that business runs in this state on the backs of undocumented workers. So Republicans amended the law to make the E-verify check voluntary. You either use E-verify to prove your employees are undocumented or you have them sign a form stating that they can work in the US. And no-one is going to say on the form that they are here illegally, right?
There are 800,000 undocumented workers in Florida and everyone knows where to find them including DeSantis. He chose Texas cos it’s a border state and cos it wouldn’t upset his Florida donors.
So why is DeSantis doing this now? Apart from the fact that a lot of republicans hate migrants? Well now he doesn’t have to talk about the total abortion ban that he wants, or homeowners insurance, or rent prices or climate change.

But I’m also not trusting poll analysts and their excuses.
Over on Darryl’s Senate election thread I’ve talked a little bit about why I think polls have gotten fucked up, why they probably are not getting better, and why the typical solutions and analysis are probably missing a lot.
All polls depend upon modeling the electorate from a sample. The sampling is terrible and getting worse. The limits of modeling efficiency have probably been surpassed. The Oklahoma poll used a sample of 500 LVs collected by calling mostly landlines and a much smaller number of cell phones. Those responses were then weighted according to a relatively small proprietary list of demographic features such as age, gender, educational level, and party affil. Such surveys in recent months are obtaining a response rate of less than 6%. That is to say that almost 95% of the numbers called refuse the survey.
Now ask yourself, what kind of freak, in 2022 has a landline phone, answers it at dinner time, and agrees to sit for a 15 minute survey?
Then ask yourself how well you think that person can be modeled onto the total electorate? Modeling assumes that historical patterns associated with easily identified demographic features can be used to make the weirdos who agree to take a survey more closely represent the 95% of us who won’t. The nature of voters and the nature of surveys tells me that is no longer a reliable assumption.

This is not how voter surveys work.
Washington’s (or any state’s) population demographics is probably somewhat different from the demographics of people who actually vote in elections. So the model you are trying to match is probably a bad one to begin with. Instead of population demographics you need to come up with a model of projected midterm turnout. How you do that is going to fuck things up, probably no matter how hard you try not to. Because it requires you to predict the future at a time when the very thing you are trying to predict has suddenly become much less predictable.
Your state implemented AVR (automatic voter registration) in 2019, and limited it to DMV, state health insurance benefits, and a couple of other agency front ends. It probably doesn’t get everyone. But it gets a whole fuck ton more than before 2019. So there is absolutely no midterm election history available from which you can model the upcoming midterm turnout.
But even if you could produce a good model that accurately predicted your state’s turnout this year, you wouldn’t expect to perfectly match that with a random phone sample. You get what you get. Then you weight the responses in order to make it conform to your model.

You’re still making the mistake of concluding that the survey company hasn’t applied any weighting to the sample to properly reflect projected turnout.
That’s a bad mistake.
Then you are projecting 2022 midterm turnout from a 2020 presidential year turnout history. That’s probably a worse mistake.
You can go back to 2018 for your most recent midterm turnout.
But then you have to decide if AVR (implemented the following year) will have some effect on 2022 turnout. And if so how much and with what voters, etc.
Only then can you try to sniff around for some Dobbs effect on turnout not being picked up in polls and their projected turnout model.
I’m not here to postulate based on changes that you or I cherry pick. I wan’t Dobbs to matter to voters. And I think it does. Issue/preference polling seems to indicate that it does. But such polls are notoriously deceptive if they want to be. What question you ask and how you ask it can dramatically shift response. But in horse race polls previously the tried and true methods have been to project turnout and weight the response based on historical patterns. If we are accepting that those patterns are increasingly incorrect because of recent changes in the electorate, it does us no real good to project the turnout we prefer.
One of the big risks we run when we declare in advance both that the polls are wrong and that the polls are wrong for this precise reason that makes me feel good, is we miss the real reason. This pre-spin has been rampant obviously. It became a religion among Stop The Steal Republicans. They’ve now thrown away two whole years on their devotion to false beliefs with no end in sight. Democrats have been better, but far from perfect about it. And with all the structural and institutional disadvantages that we face we can’t afford to be very wrong.
We do not know what we do not know. We don’t know if conventional polls work anymore. And we don’t know precisely why either. We can speculate and suggest things that may be causing the changes that result in polls not working. But that’s still speculation. And I’m grown up enough not to be comforted by wish-casting, magical thinking, or lucky underwear when it comes to the shit that matters.
I think cell phones, AVR, and vote-by-mail are upending everyone’s ability to reliably predict election outcomes at the level of congressional districts and swing states. We can credibly argue that this poll or that poll is wrong. What we probably can’t do is say how to correct it.
And don’t look to hear anything like this from Nate Silver or Nate Cohn, or any big U poly sci center with a big financial stake in the polling industry. It’s bad for business.

Then one day you are violently arrested, imprisoned, and accused by the government of terrible crimes you don’t know anything at all about. You try your best to protect yourself from what must surely seem to be a machine of criminal justice gone out of control. You don’t talk to the police, because you know that anything you say will be used against you. They told you so. Or maybe you do talk to the police, thinking foolishly that you can talk your way out of it. It hardly seems to matter at all either way.
You wait days, at arraignment you see your assigned council for the first time, briefly exchange introductions, then you are led into court in a jail jumpsuit in handcuffs. The judge says some shit. The lawyers say some shit. And then it’s back to jail. Months go by. You lose your job. Your car is repossessed. Your family can’t make rent and they have to move in with parents or other relatives. You do your best to fit in to the day-to-day routine of jail. The complete lack of privacy is jarring and disorienting. The impersonal and detached indifference of the jail staff is frightening. You don’t have anyone to talk to or to trust. You have no idea why you are there or when you’ll find out.
Then your lawyer appears one day unannounced after a couple of months and tells you that they have been meeting with the government lawyers and that they’ve negotiated a “good” agreement for you. They tell you that if you plead guilty to just two felonies you can qualify for release in under three years. They tell you that the government has witnesses and physical evidence that tie you to the crimes. You mention that you have an alibi. Maybe it’s the alibi you told the police about. The one you thought would clear everything up. The one they didn’t seem to pay any attention to. Then your lawyer tells you that alibis are not worth very much. They tell you that the government will discredit your alibi and that the jury will probably be persuaded.
What the don’t tell you is that, as a public defender in your state they have twenty five other clients just like you assigned to them right now. They don’t tell you that their case load results in them working sixty hours a week even without ever going to trial. They don’t tell you that if they take your case to trial that for the duration of your trial all of their other clients will have to be reassigned to other attorneys in their office who are just as overworked as they are. They don’t tell you that the managing attorney for your office will be furious with them for doing that. They don’t tell you that after ten years of criminal defense practice they are paid just barely more than a new graduate of law school.
Instead they tell you that it’s your decision to make. And they tell you that if you decide not to take the deal they will do their best to provide you with a good criminal defense at trial, but that there are no guarantees. They tell you that the plea agreement is a guarantee.
In our system, for good or for ill, once police have decided to accuse you of a crime, unless you have a lot of money for good attorneys, you’re fucked. You are inside of a machine that is designed to coerce you into a guilty plea. For most people who find themselves in this situation it’s because they have fucked around with crime. They hid the gun, or they drove the drugs to Nevada, or they got blasted on tequila and got into their pickup and killed someone.
But if you are Black then you are seven times more likely to find yourself in this situation simply because you are Black.
Because that’s what police do sometimes.

It serves as a central repository of verified, court recorded data on legal exoneration across all U.S. jurisdictions. There are are hundreds of public interest non profit orgs pursuing appeals, stays, pardons, commutations, and exonerations on behalf of wrongfully convicted people in the U.S. The Innocence Project is but one of them, based out of the Yeshiva University School of Law. It’s work goes well beyond exoneration, and much of it focuses on improving criminal legal process and legal protections for the accused. Both of which are important issues that relate to the wrongfully convicted, but which focus on the beginning rather than the terminal end of the criminal justice process.
It’s an important distinction. Once a person has been convicted of a crime in the United States the opportunities within the law to reconsider those convictions are very rare, deliberately narrow, extraordinarily complex and difficult to litigate, and immensely expensive to mount and pursue. From a pure efficiency perspective it makes more sense to work to end racial profiling by police, to end race based policing in general, to improve the quality and availability of legal counsel to the accused, and to change the plea-based system of criminal prosecutions.
The data cited in my link say nothing at all about percentages of innocent people detained, threatened, physically abused, arrested, falsely accused, falsely charged, and falsely imprisoned pending trial, only later to be acquitted at trial, to have their case dismissed by the judge, or to have their charges dismissed by the prosecutor. The people represented by the statistics in that report are completely innocent people who have been through all that and more, and have then been convicted and sentenced.
We don’t actually know what the racial disparities are with respect to that much, much larger group of people. But I for one would argue that it’s certainly much worse.

There’s no accommodation in his thinking for the possibility of the innocence of the accused. Nor does he conceive of the system (investigators, prosecutors, judges, even juries) having any role in establishing that innocence.
