I’ve now read responses from four different nationally conducted focus groups of “pro-life” Republican women who voted for Trump in 2016 from swing state suburbs – Wisconsin, Michigan, Arizona, Pennsylvania, Georgia. Conducted by long time GOP survey companies after Dobbs.
Of course there’s an expected diversity of responses about specific candidates and specific legislation. But the most impressive consistent theme is how much they regard Republicans as now being “extreme” and “overreaching” with regard to reproductive rights. Whether they support total bans or support choice or fall somewhere in between, whether they support states deciding, or patients deciding, they all now regard Republicans as the “dangerous”, “extreme” party when it comes to reproductive health.
Dobbs is going to have a massive impact on this mid term and in future cycles. And that’s both because Dobbs has activated women and younger lean-D voters, but also because it has permanently alienated a very large and very key demographic among lean-R voters. The seeds of that alienation were planted in places like Texas with Abbott’s Bounty Law. But they continue unchecked in every other Republican controlled state with ever more extreme new laws. And however much frauds like Oz or Masters scrub their socials and their campaign websites, that onslaught of wildly extreme state laws will continue well into the foreseeable future.
Because that is precisely what Roe was holding back for the past fifty years. There was never any chance that Republican Evangos and thumpers were going to be anything less than blind, crusading zealots about abortion. At the state level they are often the most empowered, most unified, and most aggressive wing of the Republican party. And the state level is precisely where Dobbs seated all the power with respect to reproductive choice. It will take at least a decade to transform Republican state party organizations and legislative caucuses into something less strident and extreme, and more reflective of the mean views of their own voters. In that time they will permanently lose up to a third or more of all white women. And as much as half of all college educated white women.
They won’t be able to election-rig their way out of that. But they’ll have to try, I guess. Not going to be surprised when they start offering new voting restrictions specifically targeting women.

In their reply brief Trump’s clown car included a bunch of nonsense about presidents having a broad authority to declassify materials, and arguing that “disagreement exists” about the classification status of some of the materials. Noteworthy in the extreme is the fact that nowhere in their brief raising the issue do they ever argue even once that Trump did indeed perform such a declassification with respect to the recovered materials that they are suing the government over (and thus rendering their argument entirely irrelevant with respect to their own lawsuit). Not a single time in this most recent response, nor in any of the previous motions or responses.
A note on why this continues to matter technically:
The Clown Car wants Judge Cannon to consider “declassification”, even though in order for her to do so there must be evidence presented that the materials in question were declassified. She’s liable to do it anyway, given her performance thus far. But the fact remains and will remain that the evidence is missing from the record. And the 11th will base their review on the record. The Clown Car can make whatever the fuck arguments they like to the circuit. But the circuit will base their review, and their consideration of such arguments, on the record. So omitting that evidence will eliminate consideration of any such arguments and would render any lower court orders citing such arguments as in error.

In that sense this is probably forced birth republican’s best strategy. They need to keep signaling to their base that they’re on their side and this is an incredibly safe way to do it.
In a deep red state? Vote yes and signal to your base you have their back and to the base in other states that the party has their back.
In a purple state? Vote no to show that you’re one of the good ones.
In a blue state? Do either as suits your goals.

Maybe in some other, fantasy private healthcare system envisioned by forced birth Republicans like Degen, all expectant mothers would have good communication from their caregivers and timely access to checkups, monitoring, testing, and support. Every expectant mother in that imaginary forced birth system would know well ahead of the fifteen week cutoff that their unborn child was guaranteed to die suffering upon delivery and might kill or injure them in the process. Every expectant mother would have the time needed to make the terribly sad decision and arrange to terminate their pregnancy in a neighboring state.
But we live in the real world. And especially in places like Texas, if you aren’t lucky enough to be a pretty blond lady with good employer provided platinum health insurance, you won’t get that constant contact from providers. Your husband’s employer’s insurance company will hate you for getting pregnant, especially if you are high risk. Because you are high risk you’ll have enormous difficulty finding a doctor at all. You won’t get timely access to testing and monitoring. And in plenty of cases you’ll find out too late for any imaginary, Utopian, pie-in-the-sky arbitrary 15 week cutoff. Your insurance will not pay for travel to another state for treatment. And your relatives might not even be allowed to help you pay for it. You’d probably be encouraged to consider sterilization, just like Kailee is now being encouraged. But you would not have the option of moving to another state like Kailee still does.
If Degen’s proposed ban were to be imposed nationwide Kailee DeSpain might be just as dead today as her unborn fetus is. The only safe way for her to avoid that would be to undergo a sterilization procedure to prevent all future pregnancies. Because there would be no option for her to travel to New Mexico to escape Greg Abbott’s Gilead. It would certainly be close. Maybe she could somehow arrange to have an exceptional doctor who would proactively order tests and schedule appointments. Maybe Kailee would take it upon herself to pester and nag her providers and her insurance companies to order and approve the testing. Maybe she’d find out in time. Maybe New Mexico clinics would have an appointment available within the cutoff. Maybe her relatives would come through with the funds in time to pay for her travel and procedure in another state.
But in the real world, probably not.
In the real world envisioned by Degen and the GOP all high risk women like Kailee can do is get sterilized.
Even a fake doctor can’t even get this shit right. Fifteen weeks clearly is not “exactly” where any arbitrary cutoff should be. It would not account for the reality of prenatal health care services in the United States. And it would never account for the variability of circumstances that make each woman’s pregnancy unique.
But this may be the most authentic “doctor” thing Degen has ever posted. It would be entirely typical of any doctor of his advanced years to treat all patients as scientifically identical widgets conforming to a mean, to be examined, tested, and then lazily processed with a checklist of treatments regardless of their unique circumstances and health status. It’s because they know they need to show results. That is they need to show their rabid base of Bible Thumping, Evango-loon zealots that they have made progress, not just in ruining lives and stripping women of their rights and freedoms, but in reducing abortion numbers. Pro Choice doctors and activists have been preparing for this moment for at least a decade. There is even a potential risk that despite overturning Roe there won’t be any meaningful reduction in the numbers of abortions in the U.S. Republicans know they can only distract from that for so long.
91% of all abortions in the U.S. take place in the first trimester. 95% (or more) of all abortions in the U.S. take place by the fifteenth week of gestation. 98.7% of all abortions by week 20. For any proposed nationwide ban to have any political salience among the Christo-Fascism, Pro-Gilead base, enough for it to produce a change in turnout by November, they have got to promise numbers.
The voters Graham and his fellow Christo-Fascists are appealing to already know all of these numbers by heart. These people are the true believers. They live and breathe this insanity every day. It is their life’s cause. They know week by week the precise number of abortions any cutoff would eliminate. The number can’t be too small. In round numbers, five percent nets them about 30,000 fewer abortions. That’s a number you can talk about and use to make people feel things. And it falls at an arbitrary point where the numbers of true horror stories that will arise from it can be managed. Yes, women will die. Yes a bunch of fetuses with profound defects incompatible with life will be delivered at enormous expense to the healthcare system and insurance companies. Yes, some adolescent girls will be forced to give birth to and coparent their own father’s rape-babies. But not so many as to provoke a full blown crisis. The baggage is manageable and can be made to seem distant and abstract.
But it will give them a number they can talk about and reference for political purposes.
As a starting point, of course.
