I’m not very sympathetic to the “War Against Crime” era idea that criminal trials and the criminal justice system are intended to serve victims or “resolve” disputes between parties.
I think the injection of victims and their families and supporters into criminal trials and sentencing has perverted our system almost beyond hope. We are the only developed nation that still routinely sentences adolescents to die in prison. We are the only developed nation that still routinely sentences adults to die in prison for non-murder offenses. Communities driven into rage and seeking vengeance by click-pimping media make for very poor justice.
I’m sorry if Derek Chauvin’s jury was in any way persuaded to convict by community anger. And I hope instead that they were persuaded by the facts and evidence presented at trial.

In hundreds of jurisdictions if the exact same events not involving a police officer had been recorded and witnessed and then played out for all the world to watch in agonizing detail, the charge would have been intentional murder in the 1st degree with a potential death sentence.
This jury had no particular difficulty concluding very early that the specific measures Chauvin took to subdue Floyd that were later determined to have stopped his breathing and heartbeat were not within the scope of his duties as a police officer. That single question is the only thing that separates this case from any other murder not involving a police officer. You don’t have to travel too far in any direction in the US to find a prosecutor who would have charged intentional murder here and given notice of seeking the death penalty, had this not involved a police officer. Pandering to just that kind of community bloodlust is what gets these fuckers reelected.
In particular, if any Brown or Black person is recorded kneeling on a white victim’s neck for nine minutes leading to their death, it is fucking guaranteed to be a capital case I think that would be wrong. The facts do not support an intention to kill. But any other person does it and they face life behind bars or the death penalty in many, many jurisdiction. The only reason Derek Chauvin faced any kind of criminal accountability for his actions was entirely because of community anger. I’m hoping more people figure that out in the days ahead.

Most unions offer these services through a special fund, often statewide, but sometimes specific to large agencies. Very large funds (almost as if they are expecting to need it?). I would assume that Minnesota is no exception. Funded by the CBA members (not taxpayers) these funds pay for attorneys to specifically represent police when they are accused of crimes (often including crimes that fall well outside of normal duties – most typically domestic violence defense and DUI defense). The funds operate like a normal legal pool, with a fund manager acting as a fiduciary. I don’t think they keep attorneys on retainer, but they do seem to steer work to certain attorneys – often former cops or prosecutors.
It’s a very nice perq. Especially considering the union also pumps big money into local and state elections for county prosecutors, Attorneys General, and Judges. Often its the police unions who are the largest single contributors.
That “fuck you” stare you see on Chauvin’s face glaring at pleading onlookers while he’s taking Floyd’s life is pretty much exactly what it looks like. Police unions own the criminal justice system in America. When it goes against them you can be sure it’s only because police are remarkably lazy and stupid.

DOJ announced today they will launch a pattern and practice investigation into Minneapolis Police Department.
These are slow and thorough investigations that invite lots of inclusion and participation by the agency being investigated. So nobody should expect some kind of quick turnaround. That isn’t the point. And it isn’t the outcome we should want either.
These investigations and the settlements they negotiate are rooted in the administrative mechanics of the agency, and go into a lot of detail about staffing practices, training, recruitment, etc. So they take time. But they often fix deep-rooted institutional deficiencies.
Chauvin was reported for this kind of violence over 22 times previously and none of it was investigated. MPD has something wrong with it to have allowed an officer with a well understood tendency toward callous infliction of injury to citizens to not only go uninvestigated, but to actually be selected to train other officers.
But the best news in this is that this clearly announces Garland intention to bring back these pattern and practice investigations. It’s not a panacea. The settlements can only go so far. But they have the valuable effect of casting light on how practices of police management and funding produce hyper-aggressive, murder-bot policing. And that helps city councils and state legislatures recognize how it’s often the ill-conceived, do-gooder laws they pass that drive bad management practices in the first place.
“Flooding the streets” with armies of poorly trained mostly unsupervised paramilitary goons does not increase public safety.
